Notice of Meeting of Owners under Part XVIII of the Native Land Act, 1909.
REGULATION No 48.
THE Maori Land Board for the Waikato-Maniapoto Maori Land District hereby notifies that a meeting of the owners of Waitakaruru No. 2c will be held, in pursuance of Part XVIII of the Native Land Act, 1909, at Auckland, on Friday, the 29th day of September, 1911, at 10.30 o’clock in the forenoon, for the purpose of considering the following proposed alternative resolutions:—
“(1.) That the said land be sold to Thomas Albert Coxhead, of Miranda, for the sum of £2 10s. per acre.
“(2.) That this said land be sold to William Motion, of Pokeno, for the sum of £3 per acre.”

Maori Lands for Lease by Public Auction.

NOTICE is hereby given, in terms of the Native Land Act, 1909, and the regulations thereunder, that the lands described in the First Schedule hereto will be offered for lease by public auction, at the Native Office, Wanganui, at 2 o’clock p.m. on Wednesday, 27th September, 1911, on the terms and conditions set out in the Second Schedule hereto.

These three subdivisions are situated off the Pipiriki-Raetihi Road. Bush country, fairly rough, but fertile. Portions of the block have already been settled, with good results. Classified as second-class land.

The above suburban lots are situated on the Wanganui River frontage, where the Ohotu Road junctions with the River Road, and have a special value as providing accommodation for moving stock. Classified as second-class land. The smaller areas partly cleared; the larger areas in light bush.
NOTE.—Lot 5 is subject to a right of road to be taken in the event of any one other than the lessee of Section 1 adjoining being the successful bidder. Lot 16 is burdened with a valuation of £100 for the wool-shed and yards thereon. This sum must be paid to the Board in the event of the successful bidder being other than the person recognized by the Board to be equitably entitled to the value of the improvements.
SECOND SCHEDULE.
CONDITIONS OF SALE.

The leases are offered at the upset rentals shown opposite to each section described in the First Schedule hereto.

The highest bidder shall be the purchaser of the lease of each lot. In the event of any lots not being disposed of at first offering, the Board may put any of them up again either separately or in groups. Any lots not disposed of at the auction sale shall remain open for selection at the upset rental.

In the event of any disputed bid, the lot in dispute may be put up again at the last undisputed bid.

The purchaser of a lease immediately after the sale shall sign an agreement hereon to complete his lease according to these conditions, and shall pay to the Board’s representative three months’ rent at the rate bid by him, together with a fee to cover the cost of preparation, stamping, and registration of his lease. The lease will be prepared by the Board. One or more sections may, at the option of the lessee, be included in one lease. For Lots 1 to 9, inclusive, the lease fee will be £3 3s., plus the cost of stamping and registering the lease. For Lots 10 to 32, inclusive, the fee will be £1 11s. 6d., plus the stamping and registration fees, unless more than one section be included in a lease, in which case the fee will be £3 3s., plus registration and stamping.

The successful bidder will be required, within fourteen days from the date on which the lease shall be tendered to him by the Board for execution, sign the lease in triplicate. In the event of his failure to do so, the Board may forfeit the rent and lease fee paid by him, and again offer the lease for sale at the upset rent, freed from any obligations to the defaulting purchaser.

The bidding shall be advanced by such sum as the auctioneer may agree to accept, and no bidding shall be retracted.

The purchaser of a lease of any lot on which a valuation for improvements is payable, shall, if required by the Board to do so, pay the amount of such valuation to the Board before obtaining his lease.

The right is reserved to withdraw any lot or lots from sale at any time before the time appointed for the sale.
CONDITIONS OF LEASE (ABRIDGED).

The term of the lease shall be twenty-three years from 1st July, 1911, at the rent bid, with a right of renewal for one further term of twenty-three years at a rental assessed at five per centum on the unimproved value of the land at the time of renewal, such valuation in the event of dispute to be determined by arbitration. Compensation for substantial improvements shall be allowed to the lessee at the expiration of the second term of the lease, as provided in section 263 of the Native Land Act, 1909.

(a.) Rent shall be payable half-yearly in advance.
(b.) Lessee will not assign the lease without the consent of the Board.
(c.) Lessee will cultivate the land in a husbandlike manner and keep the land free of noxious weeds.
(d.) Lessee will keep fences and buildings in repair.
(e.) The lessee will fence, without any right of resort to the Board for contribution on account of the Board owning or occupying adjacent land; but this provision shall not deprive the lessee of any rights he may have against any subsequent occupier (other than the Board) of such adjacent land.
(f.) The lessee and his assigns must make the declaration required from a lessee of Native land that he is not the owner or occupier of 3,000 acres of third-class land, or its equivalent in other classes of land.

The lessee will be allowed a rebate of rent for the three months from 1st July to 30th September, 1911.

A copy of the lease can be inspected at the post-office, Raetihi, at the office of the Under-Secretary, Native Department, Wellington, and at the Board’s office, Wanganui. Full particulars may be obtained at the office of the Under-Secretary for Native Affairs, Wellington, and at the office of the Aotea District Maori Land Board, Wanganui.
The lands are described for the general information of intending selectors, who are recommended, nevertheless, to make a personal inspection, as the Board is not responsible for the absolute accuracy of any description.
