regulations made thereunder, and that are now or may hereafter be in force.

  1. The ballast of all vessels loading at the said wharf shall be taken away by the Council and deposited above high-water mark, or at such place as may be approved of by the Minister, or by any person appointed by the Minister for that purpose.

  2. The rights, powers, and privileges conferred by or under this Order in Council shall continue to be in force for fourteen years from the date hereof, unless in the meantime such rights, powers, and privileges shall be altered, modified, or revoked by competent authority; and the Council shall not assign, charge, or part with any such right, power, or privilege without the previous written consent of the Minster first obtained.

  3. The said rights, powers, and privileges may be at any time resumed by the Governor, without payment of any compensation whatever, on giving to the Council three calendar months’ previous notice in writing. Any such notice shall be sufficient if given by the Minister, and delivered at or posted to the last known address of the Council in New Zealand.

  4. The Council shall be liable for any injury which the said wharf may cause any vessel or boat to sustain through any default or neglect on its part.

  5. In case the Council shall—
    (1.) Commit or suffer a breach of the conditions hereinbefore set forth, or any of them;
    (2.) Cease to use or occupy the said wharf for a period of thirty days—
    then and in either of the said cases this Order in Council, and every right, power, or privilege conferred hereby, may be revoked and determined by the Governor in Council without any notice to the Council or other proceeding whatsoever; and publication in the New Zealand Gazette of an Order in Council containing such revocation shall be sufficient notice to the Council, and to all persons concerned or interested, that this Order in Council, and the license, rights, and privileges thereby granted and conferred, have been revoked and determined.

  6. The erection of the wharf shall be sufficient evidence of the acceptance by the Council of the terms and conditions of this Order in Council.

Consenting to the Taking and Laying-off of a Road in Block V, Waoku Survey District.


ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-first day of August, 1911.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the Public Works Act, 1908, it is, in section ninety-four thereof, enacted that there shall not be taken under the authority of the last preceding section any land occupied by any pa, village, or cultivation, or any buildings, gardens, orchards, plantations, or any burial-ground or ornamental grounds, without the previous consent of the Governor in Council:

And whereas portion of the land described in the Schedule hereto is occupied by a cultivation:

And whereas it is expedient to take and lay-off the road described in the Schedule hereto, portion of which road passes through a cultivation:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the taking and laying-off of the said road.

Domain Board appointed to have Control of the Waitahuna Domain.


ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-first day of August, 1911.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section forty of the Public Reserves and Domains Act, 1908 (hereinafter termed “the said Act”), it is enacted that the Governor may from time to time, with respect to any public domain, appoint such persons (not exceeding nine) as he thinks fit to be a Domain Board having, subject to Part II of the said Act, control of such domain:

And whereas by an Order in Council made on the twenty-second day of November, one thousand eight hundred and ninety-seven, and published in the New Zealand Gazette of the twenty-fifth day of November, one thousand eight hundred and ninety-seven, certain powers were delegated to the Havelock (Otago) Domain Board in respect of the Havelock (Otago) Domain, no period being specified:

And whereas by section fifty-four of the said Act the period for which the said Board shall hold office will expire on the twenty-fifth day of August, one thousand nine hundred and eleven:

And whereas it appears expedient to again appoint a Domain Board to control the domain:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

WILLIAM JOHN LIVINGSTON,
WILLIAM MCKENZIE,
FRANCIS WHELAN, and
HUGH MCSTAY,

as from the twenty-sixth day of August, one thousand nine hundred and eleven, to be the Waitahuna Domain Board, having control of the land described in the Schedule hereto for the purposes of and subject to the provisions of Part II of the said Act; and doth hereby appoint Saturday, the ninth day of September, one thousand nine hundred and eleven, at half past seven o’clock p.m., as the time when, and the Waitahuna School as the place where, the first meeting of the Board shall be held.


SCHEDULE.

WAITAHUNA DOMAIN.

ALL that area in the Otago Land District, formerly known as Havelock (Otago) Domain, and containing by admeasurement 5 acres 1 rood 32 perches, more or less, being Section 21, Block XXXII, Town of Havelock. Bounded towards the north-west by part of Section 82, Block VII, Waitahuna East Survey District, and by the abutment of a road, 1082 links; towards the north-east by Section 20, Block XXXII, of aforesaid town, 504 links; towards the south-east by part of Section 22, Block XXXII, of said town, 1082 links; and towards the south-west by a street reserve, 504 links: as the same is delineated on the plan marked L. 1445, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.
