Validating the Special Order in connection with a Loan of £2,000 applied for by the Makerua Drainage Board for Drainage-works in Special District No. 3.

ORDER IN COUNCIL.
At the Government House, at Wellington, this seventh day of August, 1911.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Makerua Drainage Board lately proposed to raise a loan of two thousand pounds, under the Local Bodies’ Loans Act, 1908, and amendments, for the purpose of drainage-works in Special District No. 3: And whereas in the consent of the ratepayers to the raising of the loan it was stated that the special rate to be levied for the payment of interest and other charges on that loan should be payable on the first days of May and November in each and every year, while in the resolution making and levying that rate it was provided that the special rate should be payable on the first days of February and August in each and every year: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section one hundred and twenty-one of the Local Bodies’ Loans Act, 1908, and section seven of the Local Bodies’ Loans Amendment Act, 1910, and acting by and with the consent of the Executive Council of the said Dominion, doth hereby declare that the said consent of ratepayers shall be valid, and shall be read as if the words “February and August” had been originally inserted therein in place of the words “May and November,” and that the proceedings relative to the said loan shall not be called in question by reason only of the irregularity aforesaid.

Vesting Control of a Reserve under the Tourist and Health Resorts Control Act, 1908.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL

IN pursuance and exercise of the power and authority conferred on him by section five of the Tourist and Health Resorts Control Act, 1908 (hereinafter termed “the said Act”), His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby vest the control of the hot springs reserve described in the Schedule hereto in the Minister of the Crown for the time being having the administration of the said Act, and doth hereby declare that the said reserve shall be administered under the said Act.

SCHEDULE.

ALL that area in the Wellington Land District, containing by admeasurement 57 acres 1 rood 5 perches, more or less, being Section 1, Block V, Town of Tokaanu, commencing at the north-western corner of Section 3, Block V, Town of Tokaanu. Bounded towards the south-west, north-west, and north by Native land, 3125·6 links, 1780 links, and 287 links respectively; towards the north-east and east generally by a road and river-bank reserve along the western bank of the Tokaanu River, by Section 2, said Block V (Native reserve), again by a road and river-bank reserve, by Section 1A, Block V aforesaid (a Native reserve), again by a road and river-bank reserve, and by a public road; and towards the south-east by Section 3 of said block: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. 275/5, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Authorizing the Alienation of Native Land, notwithstanding the Provisions of Part XII of the Native Land Act, 1909.

ORDER IN COUNCIL.
At the Government House, at Wellington, this seventh day of August, 1911.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section two hundred and three of the Native Land Act, 1909, it is enacted that the Governor may by Order in Council, in any case in which he deems it expedient in the public interest so to do, authorize the acquisition, alienation, or disposition of Native land or of any interest therein, notwithstanding any of the provisions of Part XII (relating to limitation of area) of the aforementioned Act:

And whereas it is expedient that authority be granted for the acquisition, alienation, or disposition of the land mentioned in the Schedule hereto, notwithstanding any of the provisions of Part XII as aforesaid of the said Act:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby authorize the acquisition, alienation, or disposition of the land mentioned in the Schedule hereto, notwithstanding any of the provisions of Part XII (relating to limitation of area) of the Native Land Act, 1909. And it is hereby declared that this Order in Council is made under the provisions in that behalf of the Native Land Act, 1909, and shall operate accordingly as a consent of the Governor in Council to the proceedings hereby authorized.

Authorizing the Maori Land Board to approve of an Alienation of Timber on Native Land.

ISLINGTON, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this seventh day of August, 1911.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section two of the Native Land Claims Adjustment Act, 1910, it is enacted that, notwithstanding the repeal by the Native Land Act, 1909, of section twenty-six of the Maori Land Claims Adjustment and Laws Amendment Act, 1907, and of sections twenty-six and twenty-eight of the Maori Land Laws Amendment Act, 1908, any recommendation duly made by a Maori Land Board under those sections before the repeal thereof may be proceeded with and acted upon, and for this purpose all powers conferred by those sections upon the Native Minister, the Maori Land Board, and the Governor in Council, or any other person, may be exercised in the same manner, and the exercise thereof shall have the same effect, as if these sections were still in force; and for the purposes of that section every reference in those sections to a Board shall be construed as a reference to the Maori Land Board having for the time being jurisdiction in the district in which the land is situated to which the recommendation relates:

And whereas application has been made, under section twenty-six of the Maori Land Claims Adjustment and Laws Amendment Act, 1907, to the Maori Land Board for the district for its approval to an instrument dated the tenth day of May, one thousand nine hundred and four, purporting to alienate the timber on part of Puketapu Block:

And whereas, after due inquiry, made prior to the aforesaid repeal of the said section twenty-six, the Maori Land Board for the district reported to the Native Minister that such alienation, with suggested modifications, should be permitted:
