Exempting Brook and Beach Streets, Island Bay, in the City of Wellington, from the Provisions of Section 117 of the Public Works Act, 1908, subject to certain Conditions as to the Building-line.

ISLINGTON, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this seventh day of August, 1911.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council :

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose :

And whereas the Wellington City Council, the local authority having control of the streets known as Brook and Beach Streets, Island Bay, described in the Schedule hereto, has by resolution declared that the provisions of the said section one hundred and seventeen should not apply to the said streets :

And whereas it is deemed expedient that such resolution should be approved, subject to the conditions hereinafter mentioned :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said streets within a distance of thirty-three feet from the centre-line of the said streets.

SCHEDULE.

ALL that street in the City of Wellington, known as Brook Street, situated in the Island Bay District, commencing at its junction with Beach Street, and proceeding thence in a westerly direction generally for a distance of about 9 chains.

Also all that street in the City of Wellington, known as Beach Street, situated in the Island Bay District, commencing at its junction with Valley Street, and proceeding thence in a north-easterly direction generally for a distance of about 12 chains to its junction with the Esplanade.

As the said streets are more particularly delineated on the plan marked P.W.D 29763, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.

Exempting Portion of Majoribanks Street, Wellington, from the Provisions of Section 117 of the Public Works Act, 1908, subject to certain Conditions as to the Building-line.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

And whereas on the twenty-second day of March, one thousand nine hundred and ten, the Wellington City Council, the local authority having control of the portion of the street known as Majoribanks Street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street :

And whereas it is deemed expedient that such resolution should be approved to the extent described in the Schedule hereto, and subject to the condition hereinafter mentioned :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution in so far as it affects the portion of street described in the Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on either side of the said portion of street within a distance of thirty-three feet from the centre-line of such portion of street.

SCHEDULE.

ALL that portion of Majoribanks Street, in the City of Wellington, situated between the Town Belt and Brougham Street, being a distance of 15Β½ chains, more or less; as the said portion of street is more particularly delineated on the plan marked P.W.D. 28166, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.

Consenting to Land in the City of Wellington being taken for the Purposes of Constructing a Tramway to Wadestown.

ISLINGTON, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this seventh day of August, 1911.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the Public Works Act, 1908, it is, in section fifteen thereof, inter alia, enacted that, except for the purpose of a railway or defence purposes, or for the purposes of any other work to be made under the authority of a special Act, nothing in this Act contained shall authorize the taking of any land occupied by any building, yard, garden, orchard, or vineyard, or in bona fide occupation as an ornamental park or pleasure-ground, without the previous consent of the Governor in Council :

And whereas an application has been made by the Wellington City Council for the issue of an Order in Council under the said section consenting to the taking of the land described in the Schedule hereto, which is partly occupied by buildings and gardens, for the purpose of constructing a tramway to Wadestown :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken by the said City Council for the purposes above mentioned.
