Notice respecting Proposed Borough of Opotiki, County of Opotiki.

Wellington, 3rd April, 1911.
PURSUANT to section 117 of the Municipal Corporations Act, 1908, His Excellency the Governor directs it to be notified that a petition has been presented to him praying for the constitution of the area described in the Schedule hereto as a borough under the said Act, to be named the Borough of Opotiki. All persons affected are hereby called upon to lodge any written objections to or petitions against the constitution of, the said borough which they may desire to lodge within one month from the first publication of this notice, such objections or petitions to be addressed to the Minister of Internal Affairs, Wellington.
SCHEDULE.
DESCRIPTION OF BOUNDARIES OF PROPOSED BOROUGH OF OPOTIKI.
ALL that area in the Auckland Land District bounded towards the north-west and north-east generally by the Otara River from its confluence with the Waioeka River to a point in line with the southern side of Duke Street; thence towards the south by a right line to the southern side of Duke Street; by the southern side of that street and its production to the Waioeka River; and thence towards the west generally by the said Waioeka River to the place of commencement.

Notice suspending Operation of Section 2 of Counties Amendment Act, 1910, in County of Ashley.

PURSUANT to subsection (9) of section 2 of the Counties Amendment Act, 1910, His Excellency the Governor in Council directs it to be notified that the operation of section 2 of the said Counties Amendment Act, 1910, is suspended for a period not exceeding twelve months after the first day of April, one thousand nine hundred and eleven, in the County of Ashley.

THE following special order, made by the Mount Roskill Road Board, is published in accordance with the provisions of the Road Boards Act, 1908.

MOUNT ROSKILL ROAD BOARD.
IN pursuance and exercise of the powers vested in it by the Road Boards Act, 1908, the Public Health Act, 1908, and its amendments, and by all or any other statutes it hereunto enabling, the Road Board of the Mount Roskill Road District doth hereby ordain as follows :—
Interpretation.
In the interpretation of these by-laws, unless inconsistent with the context,—
“Dwellinghouse” includes any house or building in which human beings dwell or are intended to dwell, but does not include offices appurtenant to a dwellinghouse :
“Board” means the Mount Roskill Road Board :
“District” means the water-supply area of the Mount Roskill Road District as defined in Gazette, 1902, No. 2, page 19 :
“Site” means a piece, lot, allotment, or subdivision of land intended to be appropriated to the purposes of one dwellinghouse :
“An offence” shall mean an offence against these by-laws, and shall include the omission or neglect to comply with any part thereof.
Building-site Area.

No person shall erect a dwellinghouse in the district upon a site of a less area than one-fifth of an acre, and unless such site shall have a frontage of at least 50 ft. to a road.

If after the passing of these by-laws a dwellinghouse be erected upon any site in the district of greater area than one-fifth of an acre, no person shall erect another dwellinghouse thereon unless each dwellinghouse shall have a site of at least one-fifth of an acre and each site shall have a frontage to a road of at least 50 ft.

Nothing contained in these by-laws shall apply to any allotment of land shown on a plan of subdivision deposited at any lands or deeds registration office, or approved by the Board, before the passing of the Public Health Amendment Act, 1910.
Every person who after the coming into operation of these by-laws shall do or cause to be done, or be concerned in doing, anything contrary to the same or any of them, or any provision therein contained, or who shall omit to do anything required by the same or any of them to be done by him, shall be deemed to have committed a breach of the same.
Any person committing a breach of any of the foregoing by-laws shall be guilty of an offence, and shall be liable to a penalty not exceeding £5 for every offence, and in the case of a continuous offence to a penalty of not more than £5 for each day during which such offence continues after the first day.
