the Native Land Purchase Board, or to any exchange of Native land, notwithstanding the fact that any Native may thereby become landless within the meaning of this Act; and thereupon the said confirmation, purchase, or exchange may take place and shall have effect in the same manner as if that Native retained Native freehold land sufficient for his adequate maintenance:
-
No such consent shall be given except on the recommendation of the Native Land Court or of the Maori Land Board of the district in which the land is situated:
-
No such consent shall be given unless the Governor is satisfied that the said Native is able to maintain himself by his own means or labour, and that the transaction consented to is not contrary to the public interest:
And whereas, to enable confirmation of a sale by the owner of Section 7A, Block XI, Aroha Survey District, the Waikato-Maniapoto District Maori Land Board recommends that such consent shall be given: And whereas it is expedient so to do:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby consent to the confirmation of the aforesaid sale, notwithstanding the fact that the Native may thereby become landless within the meaning of the said Act. And it is hereby declared that this Order in Council is made under the provisions in that behalf of the Native Land Act, 1909, and shall operate accordingly as a consent of the Governor in Council to the proceedings hereby authorized.

ISLINGTON, Governor.
ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this sixth day of April, 1911.
Present:
THE HONOURABLE J. A. MILLAR PRESIDING IN COUNCIL.
WHEREAS the Whangamomona County Council lately proposed to raise a loan of £350 under the Local Bodies’ Loans Act, 1908, and the amendments thereof, for the construction of about three-quarters of a mile of the Mangaowhata Road, or for as far as the money would permit of, by way of reforming, grading, and metalling such length of the said Mangaowhata Road: And whereas public notice of the special order authorizing the raising of the said loan was given once in each of four weeks, but was not published once in each of the four weeks immediately preceding the day on which the subsequent meeting to confirm the resolution making the special order was held as required by section ninety-seven of the Counties Act, 1908: And whereas it appears that the ratepayers of the special rating area have not been misled by such irregularity, and it is expedient to validate the said public notifications:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred by section one hundred and twenty-one of the Local Bodies’ Loans Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the said public notifications, and doth hereby declare that the proceedings relative to the said loan shall not be called in question by reason only of the irregularity aforesaid.

visions of the Local Bodies’ Loans Act, 1908, for the purpose of metalling the Waikaka and Rimu Roads: And whereas an irregularity has occurred in the procedure to obtain such loan, inasmuch as public notice of the resolution passing such special order, and of the time and place fixed for such meeting of the said County Council subsequent to the meeting at which such special order was made, was not given in the week immediately preceding such subsequent meeting, as is required by section ninety-seven, subsection one (c), of the Counties Act, 1908: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the aforesaid proceedings:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section one hundred and twenty-one of the Local Bodies’ Loans Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the said special order shall be taken to be valid as though the public notice required to be given by section ninety-seven, subsection one (c), of the Counties Act, 1908, had been duly given; and His Excellency the Governor, with such advice and consent aforesaid, doth hereby validate such proceedings, and doth further order and declare that the proceedings in connection with the said loan shall not be called in question by reason only of the irregularity aforesaid.
