THE following special order, made by the Werekino Road Board, is published in accordance with the provisions of the Road Boards Act, 1908.

WEREKINO ROAD BOARD.

By-law regulating Heavy Traffic and the Licensing of Vehicles.

IN pursuance of the powers, provisions, and authorities contained in the Road Boards Act, 1908, the Public Works Act, 1908, and the Acts amending the same respectively, and of all other powers, provisions, and authorities it in this behalf enabling, the Corporation of the Inhabitants of the Werekino Road District, by the Werekino Road Board (hereinafter, save where inconsistent with the context, termed “the Road Board”), doth hereby make and ordain the following by-law :—

  1. In this by-law, if not inconsistent with the context,—

“Heavy traffic” shall have the meaning given to it by subsection (1) of section 139 of the Public Works Act, 1908 :

“Engine” shall include machine and any locomotive (not being used on a railway or tramway) propelled by electricity, oil, steam, petrol, or other mechanical power :

“Vehicle” means any dray, cart, trap, wagon, carriage, or other conveyance of any sort whatsoever (other than an “engine” as hereinbefore defined) :

“Owner,” as applied to any vehicle or engine, includes a bailee entitled to the possession and use or profit of any vehicle or engine :

“Road” includes any bridge, gate, culvert, drain, and all other things belonging to, upon the line, or within the limits of a road ; and includes every road within the meaning of section 101 of the Public Works Act, 1908, which is or shall be under the care, control, or management of the Road Board.

  1. No person shall, without the permission of the Road Board in writing for every occasion in that behalf first had and obtained, engage in heavy traffic on any road under the care, control, or management of the Road Board during the months of May, June, July, August, and September in each year.

  2. No person shall use any such road by the traction thereon of any engine or vehicle for the purposes of heavy traffic during the months of October, November, December, January, February, March, and April in any year, unless such engine or vehicle shall be licensed in manner hereinafter set forth for the period during which such engine or vehicle shall be so used.

  3. No person shall use bullocks as traction animals during the months mentioned in clause 3 hereof upon the gravelled or metalled portion of any such road, except where no unmetalled or ungravelled portion of such road is available for traffic.

  4. The yearly license fee payable in respect of every engine or vehicle having four wheels or more shall be £10, and in respect of every two-wheeled engine or vehicle shall be £5 ; and upon application to him by the owner of any engine or vehicle or his agent for that purpose, and payment of the proper fee, the Clerk of the Road Board shall issue a license, and also a docket with a mark thereon designating the date of issue ; and such license shall continue in force for one year from the date of issue.

  5. The owner shall affix such docket to the near side of such engine or vehicle, and keep the same affixed during the currency of the license in respect of which such docket is issued.

  6. The owner of every engine or vehicle which by this by-law is liable to a license fee shall cause the correct weight of such engine or vehicle when unloaded to be at all times marked in some conspicuous place thereon in figures 2 in. in length and of proportionate width.

  7. If any duly licensed engine or vehicle becomes destroyed or unfit for use, the owner may, with the previous consent in writing of the Clerk to the Road Board, detach the docket mentioned in clauses 5 and 6 hereof, and affix it to another engine or vehicle of the like description, which shall thereafter be deemed the licensed vehicle for the remainder of the period of the said license.

  8. No person shall deface or alter or tamper with any docket or, except as aforesaid, remove the same during the period for which it shall have been issued.

  9. Each of the engines or vehicles enumerated in the first column of the first schedule hereto, having the number of the said schedule, and licensed to carry or carrying respectively the weight mentioned in the third column of the said schedule, shall have tires on each wheel of a width not less than that mentioned in the fourth column of the said schedule.

  10. For the purposes of this by-law, and for the purposes of estimating the weight carried by any engine or vehicle as in the last preceding clause mentioned, the
