Regulations under the Immigration Restriction Acts.

ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirteenth day of March, 1911.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the power and authority conferred on him by the Immigration Restriction Act, 1908, and the amendments thereof, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations prescribing the conditions on which any person may be permitted to land in New Zealand without complying with the provisions of the Immigration Restriction Act, 1908.


REGULATIONS.

  1. THESE regulations shall apply to bona fide merchants, tourists, or students, including Chinese, who cannot comply with the provisions of the Immigration Restriction Act, or to Chinese merchants, tourists, or students who, although able to comply with such provisions, do not wish to pay poll-tax.

  2. Certificates in the form set forth in the Schedule hereto, signed by the Collector of Customs at the port of issue, will be issued to bona fide merchants, tourists, or students who can produce passports issued by the Governments of their respective countries and vised by the British Consul in those countries or by any other duly authorized British authority:

Provided that no certificate shall be issued to any person debarred from landing by paragraphs (b), (c), and (d) of section 14 of the Immigration Restriction Act, 1908:

Provided also that in any case where in the opinion of the Minister of Customs there are special circumstances, he may authorize the issue of a certificate without the production of a passport upon a bond being given for £100, with security satisfactory to the Collector, that the person named therein shall leave New Zealand upon the expiry of a period not exceeding six months.

  1. (1.) Merchants or tourists coming under these regulations may land and remain in New Zealand for a period not exceeding six months, and students may land and remain for a period to be ascertained within one month of arrival, but not exceeding six years.

(2.) Such persons shall not again be granted a certificate should they return to New Zealand before the expiry of five years from the date of their departure upon the preceding visit, except on such special conditions as may be prescribed by the Minister.

  1. The Minister may in cases of extreme urgency extend the certificate of any merchant, student, or tourist for such time and subject to such conditions as he thinks fit.

  2. (1.) Every person applying to the Collector of Customs for a certificate shall provide two photographs of himself taken within one year of such application. The photographs shall be securely attached to the certificates, one of which shall be handed to the applicant and the other filed by the Collector.

(2.) The applicant shall also deposit a sum of £10 with the Collector as security that he will report upon departure from New Zealand, and that sum shall be returned to him by the Collector at the port of departure upon identification and upon complying with these regulations.

(3.) The amount deposited on account of any person who departs without being identified or who remains in New Zealand beyond the time permitted by his certificate shall be forfeited and paid into the Public Account.

  1. Immediately before departure from New Zealand the holder of a certificate shall personally deliver up the same to the Collector of Customs at the port of departure.

  2. Certificates delivered up at a port of departure shall be forwarded to the Collector at the port of issue, to be filed with the duplicate.

  3. Notwithstanding anything hereinbefore contained, any prohibited immigrant or Chinese arriving at a New Zealand port en route to some place beyond New Zealand may be permitted to land for a period not exceeding twenty-one days, provided that a bond, with security satisfactory to the Collector of Customs, is given that the person named therein shall report himself to the Collector upon departure from New Zealand within the time specified. Such bond shall be in the following amounts:—

(a.) In the case of Chinese, £200.

(b.) In the case of all other prohibited persons, £100.

SUBSECTION (2) OF SECTION 5 OF THE IMMIGRATION RESTRICTION AMENDMENT ACT, 1910.

“With respect to every person who lands in New Zealand under any such regulations, the provisions of the principal Act shall not apply so long as he faithfully observes the conditions prescribed by those regulations or such of them as are applicable to him; but if he does not so observe the prescribed conditions, he shall be deemed to have unlawfully landed in New Zealand.”

Regulations for Deer-shooting, Otago.

ISLINGTON, Governor.

IN exercise of the powers vested in me by the Animals Protection Act, 1908 (hereinafter called “the said Act”), I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, do hereby make the following regulations prescribing the deer-shooting season in the Otago Acclimatization District, comprising the Counties of Bruce, Clutha, Maniototo, Peninsula, Taieri, Tuapeka, Vincent, Waihemo, and Waikouaiti, and part of the County of Southland (except within the area described in the First Schedule hereto), and the conditions affecting the same, and also the form of license and the fee payable therefor.
