(3.) No such consent shall be given unless the Governor is satisfied that the said Native is able to maintain himself by his own means or labour, and that the transaction consented to is not contrary to the public interest :

And whereas, to enable confirmation of a lease from the owner of Karaka No. 1 Block, the Waikato-Maniapoto District Maori Land Board recommends that such consent shall be given: And whereas it is expedient so to do:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting my and with the advice and consent of the Executive Council thereof, doth hereby consent to the confirmation of the aforesaid lease, notwithstanding the fact that the Native may thereby become landless within the meaning of the said Act. And it is hereby declared that this Order in Council is made under the provisions in that behalf of the Native Land Act, 1909, and shall operate accordingly as a consent of the Governor in Council to the proceedings hereby authorized.

Regulations relating to Election of Committees of Management for Farms managed by Maori Land Boards under Section 292 of the Native Land Act, 1909.

ISLINGTON, Governor.
ORDER IN COUNCIL.

At the Government House, at Wellington, this thirteenth day of March, 1911.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the Native Land Act, 1909, it is enacted that the Governor may from time to time by Order in Council make regulations for the purposes specified in the said Act :

And whereas by subsection five of section two hundred and ninety-two of the said Act it is provided that whenever land is so set apart and managed as a farm, the owners may from time to time, in manner prescribed by regulations, elect from among their number a Committee of Management: And whereas it is expedient to make regulations relating to the mode of election of such Committees :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the regulations following.

REGULATIONS.

  1. In these regulations, unless a contrary intention appears, the expressions following have the meanings attached thereto :—

"The Act" means the Native Land Act :

"Board" means the Maori Land Board of the district to which the particular matter in the context refers :

"President" means the President of a Maori Land Board :

"Committee" means the Committee of Management.

All other terms used in these regulations have the same signification as when used in the Act, unless a contrary intention appears.

ELECTION OF COMMITTEE.

  1. A meeting of the beneficial owners of any land being farmed by a Board under section 292 of the Act, for the purposes of electing a Committee, shall be summoned by the President at the instance of the Board in such manner and at such time and place as the President considers expedient.

If two or more parcels of land owned by different sets of owners are contiguous or so situated that in the opinion of the Board such two or more parcels can be conveniently and advantageously worked as one farm, the President may convene a meeting of all the owners of all the parcels of land so grouped, for the purpose of electing a Committee for all such parcels.

  1. An owner may appoint a proxy by writing under his hand in the Form No. 14 in the Second Schedule to the Regulations relating to the Maori Land Boards dated the 13th day of June, 1910, attested by some person authorized by the Act to attest a will of a Native. Such proxy shall not be available except by leave of the representative of the Board at the meeting, and shall be handed in to the Board or its representative previous to the commencement of the meeting.

  2. If at any time and place appointed for the meeting, or within one hour thereafter, a quorum is not present, or for any reason the meeting cannot be held at that time

it shall stand adjourned from day to day at the same time and place until the seventh day thereafter, when the meeting, if not held, shall lapse.

  1. At such a meeting five beneficial owners present in person or represented by proxy shall form a quorum, of whom three must be present in person. The ex officio member as provided by subsection (6) of section 292 of the said Act shall preside at the meeting. The said Chairman shall not be entitled to vote on the election.

  2. The meeting shall, before entering on the election, determine the number of persons (being not less than four and not more than six) to be elected.

  3. The Chairman shall then call for nominations of persons, who shall be owners, whom it is desired to elect. Each person so nominated shall be proposed by one of the owners, and seconded by another owner.

  4. If the number of persons nominated is not more than the number required to be elected, the Chairman shall declare them to be elected.

  5. If the number of persons nominated exceeds the number required to be elected, the Chairman shall call upon the meeting to elect from the persons nominated the number required, and may appoint one or more scrutineers for the purpose of counting the votes recorded. The votes may be given by a show of hands, or in such other manner as the meeting determines.

  6. In the case of equality of votes the Chairman shall have a casting-vote.

  7. The Chairman shall declare those persons (not being more than the number of persons required to be elected) who have received the highest number of votes to be duly elected as the Committee.

  8. A list of the names of the persons so elected shall forthwith be prepared by the Chairman, and signed by him and countersigned by an owner, and shall be forwarded to the Board.

  9. The Committee so elected shall remain in office for three years from the date of the election, when another election shall take place.

  10. In the event of a vacancy occurring on the Committee, the same may be filled by the Board on the recommendation of the members remaining on the Committee at the time the vacancy occurs.

MEETINGS.

  1. The members of the Committee shall meet together for the despatch of business at the times and places as the Chairman of the Committee considers expedient.

  2. Minutes of the proceedings of the Committee shall be recorded in a minute-book, and the minutes of any meeting shall be read and confirmed at the next succeeding meeting. The minute-book shall be in the custody of the Chairman, who shall forward same to the President or Board whenever required so to do.

ALLOWANCES.

  1. Every member of the Committee other than the Chairman thereof shall be paid, out of revenue from the farm, a sum to be determined by the Board, but not, in any one case, to exceed the sum of 7s. 6d. for each day on which he is actually engaged on the business of the Committee.

Regulations under Section 274 of the Native Land Act, 1909.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirteenth day of March, 1911.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the power and authority conferred by section two hundred and seventy-four of the Native Land Act, 1909, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulation for the purposes of the said section.

REGULATION.

The term of any advance under the said section two hundred and seventy-four may be fifteen, twenty-five, or forty years, as the Minister of Finance think fit, and every instalment shall be calculated and payable in accordance with the appropriate table in the schedule hereto. The first half-yearly instalment shall be payable six months after the date of the making of the advance,
