thermal, or historic reserves : And whereas the said Board was duly directed to inspect and report on the land described in the Schedule hereunder, and has recommended that the said land should be permanently reserved for scenic purposes, and it is expedient to give effect to such recommendation :
Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers contained in the said Act, do hereby proclaim and declare that the land described in the Schedule hereunder shall be a scenic reserve under the Scenery Preservation Act, 1908, and subject to the provisions thereof.

SCHEDULE.
OTAIHAPE SCENIC RESERVE.
ALL that area in the Wellington Land District, containing by admeasurement 4 acres and 11 perches, more or less, being Section No. 80, Block XIV, Ohinewairua Survey District. Bounded towards the north and north-west generally by a road reserve on the bank of the Otaihape Creek; towards the south-east by Section No. 80A, Block XIV, Ohinewairua Survey District; and towards the south-west by a public road: as the same is delineated on the plan marked L. 359/16, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.
Given under the hand of His Excellency the Right Honourable John Poynder Dickson-Poynder, Baron Islington, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House, at Wellington, this twentieth day of February, in the year of our Lord one thousand nine hundred and eleven.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this thirteenth day of February, 1911.

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
PRESIDING IN COUNCIL.
WHEREAS by the Public Works Act, 1908, it is, in section 15 thereof, inter alia, enacted that, except for the purpose of a railway or for defence purposes, or for the purposes of any other work to be made under the authority of a special Act, nothing in this Act contained shall authorize the taking of any land occupied by any building, yard, garden, orchard, or vineyard, or in bona fide occupation as an ornamental park or pleasure-ground, without the previous consent of the Governor in Council :
And whereas portion of the land described in the Schedule hereto is occupied by an orchard and an ornamental park or pleasure-ground :
And whereas the Minister has recommended the Governor to issue an Order in Council under the said Act consenting to the taking of the said land for the purposes of a road :
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes above mentioned.

SCHEDULE.
ALL that portion of land required for the proposed Whangarei to Whangarei Heads Road, commencing at or near the westernmost corner of Section 3, Block IX, Whangarei Survey District, and running in a south-easterly direction generally along or near the harbour frontage of the said Section 3, Parish of Parahaki, Block IX, Whangarei Survey District; as the approximate position of the said portion of road is delineated on the plan marked P.W.D. 28402, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured blue.

WHEREAS by subsection (a) of section one hundred and thirty-three of the Public Works Act, 1908, it is enacted that a local authority shall not declare any county road or district road to be stopped, and such road shall not be deemed to be stopped, until the consent thereto of the Governor by Order in Council gazetted is obtained :
And whereas the Wallace County Council has applied for such consent in respect to the road described in the Schedule hereto :
Now, therefore, in pursuance and in exercise of the above-in-part-recited Act, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the closing of the road mentioned in the Schedule hereto.
