THE NEW ZEALAND GAZETTE.
[No. 1

“Road” shall mean any road within the county, whether surveyed or not, which is under the care, control, or management of the Whangarei County Council :

“Writing,” “written,” or any term of like import includes words printed, typewritten, painted, engraved, lithographed, or otherwise traced or copied, and when anything is required to be written or printed, or to be in writing or in print, it may be either written, printed, or typewritten, or partly in writing or typewriting and partly in print: Provided that nothing herein contained shall be read or construed to apply to any signature.

Words importing the singular number include the plural number, and words importing the plural number include the singular number, and words importing the masculine gender include females.

Every schedule to these by-laws shall be deemed a part thereof. Whenever forms are prescribed, slight deviations therefrom (but to the same effect and not calculated to mislead) shall not vitiate them.

PART I.
VEHICLES.

Tires.

  1. No person shall drive or cause to be driven upon, across, or along any road any vehicle carrying a load the weight of which—

(1.) Shall exceed 12 cwt., and shall not exceed 18 cwt. for each pair of wheels unless the tires of each wheel are of a uniform width of not less than 2 in.

(2.) Shall exceed 18 cwt., and shall not exceed 1¼ tons for each pair of wheels unless the tires of each wheel are of a uniform width of not less than 2½ in.

(3.) Shall exceed 1¼ tons, and shall not exceed 1½ tons for each pair of wheels unless the tires of each wheel are of a uniform width of not less than 3 in.

(4.) Shall exceed 1½ tons, and shall not exceed 1¾ tons for each pair of wheels unless the tires of each wheel are of a uniform width of not less than 3½ in.

(5.) Shall exceed 1¾ tons, and shall not exceed 2 tons for each pair of wheels unless the tires of each wheel are of a uniform width of not less than 4 in.

(6.) Shall exceed 2 tons, and shall not exceed 2½ tons for each pair of wheels unless the tires of each wheel are of a uniform width of not less than 5 in.

(7.) Shall exceed 2½ tons, and shall not exceed 3 tons for each pair of wheels unless the tires of each wheel are of a uniform width of less not than 6 in.

  1. For the purpose of computing the weight of the contents of any vehicle or machine engaged in ordinary or heavy traffic,—

(a.) A measured ton of firewood shall be deemed to be 14 cwt.

(b.) 500 ft. superficial of sawn kauri shall be deemed to be 15 cwt.

(c.) 63 cubic ft. of kauri shall be deemed to be 1 ton.

(d.) 40 cubic ft. of rimu, puriri, totara, or kahikatea shall be deemed to be 1 ton.

(e.) 13 cubic ft. of solid stone shall be deemed to be 1 ton.

(f.) 25 cubic ft. of earth shall be deemed to be 1 ton.

(g.) 22 cubic ft. of clay shall be deemed to be 1 ton.

(h.) 27 cubic ft. of scoria shall be deemed to be 1 ton.

(i.) 30 cubic ft. of stable manure shall be deemed to be 1 ton.

(j.) 22 cubic ft. of gravel or sand shall be deemed to be 1 ton.

(k.) 20 cubic ft. of broken or crushed road-metal shall be deemed to be 1 ton.

(l.) 19 cubic ft. of bricks shall be deemed to be 1 ton.

(m.) 48 cubic ft. of coal shall be deemed to be 1 ton.

(n.) And 25 cubic ft. of kauri-gum shall be deemed to be 1 ton.

And so on in proportion as any of the said respective several substances or things shall exceed the said measurement respectively.

  1. No person shall at any time use, or cause or permit to be used, any bullock as a traction animal upon any metalled road.

  2. Whereas the Council is of opinion that the conduct of the particular kinds of traffic mentioned in this clause will cause serious injury to certain roads under its control, no person shall conduct or cause to be conducted all or any of the following kinds of traffic—that is to say, the carriage, haulage, or cartage of unmilled timber, coal, or of mining props—upon or along any of the following roads, that is to say:—

The Great North Road between Blackburn’s Junction, Mangapai, and Hukerenui; the Mangapai Wharf to Waikiekie Road; the whole of the road known as the Whanwhau Valley Road; the whole of the Whangarei-Maungatapere Road; the whole of the road between Riponui and Jordan; the whole of the road known as the Otonga Main Road; the road known as the Three-mile Bush Road between Kamo and Ruatangata; the whole of the Kamo Purua Road between Kamo and Aponga; the whole of the road between Whangarei and Kiripaka; and the whole of the Marua Road between Hikurangi and McPhee’s Bridge, Marua—

unless the cost estimated by the Council of reinstating the road consequent upon the injury to be occasioned by such traffic upon or along which such traffic is to be conducted is previously paid to it.

  1. Every person who commits a breach of clause 7 hereof is liable to a fine not exceeding £20.

  2. For the purpose of ascertaining the cost of reinstating the road or roads upon or along which such traffic as is mentioned in clause 7 hereof is to be conducted, any person desirous of conducting such traffic upon or along any such road as is therein mentioned may make an application to the Council in the form in the First Schedule hereto, and no person shall make any untrue statement in any such application. The Council will then proceed to deal with such application.

HEAVY TRAFFIC.

  1. In this by-law, unless inconsistent with the context, “heavy traffic” means—

(a.) The transportation of any vehicle, engine, or machine which itself or together with any thing or things being transported thereon weighs more than 1½ tons avoirdupois to each pair of wheels :

(b.) The traction of any vehicle or thing by means of bullocks, notwithstanding that such vehicle or thing may separately or together with any load thereon weigh less than 1½ tons avoirdupois :

(c.) Any traffic which may from time to time be declared to be “heavy traffic” by Order in Council.

  1. No person shall during the months of May, June, July, August, and September in any year engage in heavy traffic upon or along any road.

  2. No person shall at any time whatsoever engage in heavy traffic upon or along any road, bridge, or ferry within the county until he shall have first given to the Council security to the satisfaction of the Council to repair any special damage that may accrue to any road, bridge, or ferry by such heavy traffic.

  3. Any person desiring to engage in heavy traffic upon or along any road, bridge, or ferry within the county, and desiring the Council to fix the security provided for in clause 12 hereof, may make an application in the form in the Second Schedule hereto, and no person shall make any untrue statement in any such application. The Council will then proceed to deal with such application.

  4. No person shall drive, lead, or take along any road any vehicle in such a way that the wheel or wheels of such vehicle shall be in or upon the sides of a water-table, provided that such road has a formation width of more than 14 ft.

  5. No person shall drive, or shall cause to be driven or drawn, any vehicle of any description whatsoever over any bridge in the county having a greater length than 40 ft. at any pace other than a walk in the case of a horse vehicle, nor at any pace faster than five miles an hour in respect of a motor-car or self-propelled vehicle.

  6. No person shall lead or drive, or cause to be led or driven, any vehicle over, across, or along any public road within the county after sunset and before sunrise, unless such vehicle shall have at least one light fixed and properly burning on the right-hand side thereof in the direction in which such vehicle shall be proceeding.

LICENSING VEHICLES.

  1. No person shall ply for hire with any vehicle for the carriage of passengers or goods within the county, unless the same shall be duly licensed so to ply in manner hereinafter provided.

  2. Every person who being the owner or one of the owners of any vehicle intended to be used in plying for hire shall desire to obtain a license for the same shall sign and deliver to the Clerk an application in writing in the form of the Third Schedule hereto, stating the name
