Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the hereinbefore-recited power and authority, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke clause two of the said regulations of the thirtieth day of December, one thousand nine hundred and nine, and doth hereby make the following regulation in lieu thereof :—
REGULATION.

No person shall put, throw, drag, draw, or place, or allow to be put, thrown, dragged, drawn, or placed, any net or seine of any description (except a landing-net) for taking fish of any description whatsoever in those portions of the New River Estuary described in the Schedule hereto, and known as the netting-prohibited areas.

The penalty for breach of the above regulations shall not be less than £5 nor more than £50.

SCHEDULE.
The netting-prohibited areas hereinbefore mentioned shall be all those areas forming portions of the New River Estuary and Harbour described as follows :—

All that portion of the New River Estuary at the mouths of the Waimatua and Waipaka Rivers, situated towards the east of a line connecting the north-east corner of Section 21, Block VI, Campbelltown Hundred, with the intersection of high-water mark by the prolongation in a westerly direction of the south side of the road forming the northern boundary of Section 1, Block VI, Campbelltown Hundred, the said line being defined on the ground by three beacon-posts painted white with black tops; the approximate positions of said posts being shown, and the said area being coloured red and marked A, on the plan referred to hereunder.

All that portion of the New River Estuary at the mouth of the Oreti or New River, situated towards the west of a line being the prolongation in a southerly direction of the west side of the road forming the eastern boundary of Section 19, Block XX, Invercargill Hundred, till intersected by a line proceeding due east from the north-eastern corner of Native Reserve 181, Block XXIII, New River Hundred, which last-mentioned line forms the southern boundary of the said area; each of the said lines being defined on the ground by two beacon-posts painted white with black tops; the approximate positions of said posts being shown, and the said area being coloured red and marked B, on the plan referred to hereunder.

All that portion of the New River Harbour situated to the north of a line being the prolongation in a westerly direction of the south side of Spey Street, Borough of Invercargill, till intersected by a line being the prolongation in a southerly direction of the boundary between Sections 33 and 117, Block XV, Invercargill Hundred, which last-mentioned line forms the western boundary of the said area; the approximate positions of two beacon-posts defining the first above-mentioned line being shown, and the said area being coloured red and marked C, on the plan referred to hereunder.
All in the Land District of Southland, as the said areas and posts are delineated on the plan marked M.D. 3562, deposited in the office of the Marine Department, at Wellington, in the Provincial District of Wellington.

Declaring that the Rodney County Council shall exercise the Powers of a Harbour Board, and defining the Limits of the Port or Harbour of Whangateau-Omaha.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fourth day of October, 1910.
Present :
His Excellency the Governor in Council.
WHEREAS it is, among other things, provided by section one hundred and eighty-five of the Counties Act, 1908, that, in any place where there is no Harbour Board, the Governor, on the request of the Council of any county bordering on any estuary or arm of the sea, may, by Order in Council duly gazetted, declare that such Council shall, from a date to be fixed in such Order, exercise all the powers of a Harbour Board within such limits of such estuary or arm aforesaid as the Governor defines for that purpose :
And whereas the Council of the County of Rodney, which borders on the Port or Harbour of Whangateau-Omaha, in the Rodney County, has requested that it may be declared that it shall exercise all the powers of a Harbour Board within such port or harbour :
And whereas it is desirable that such request should be acceded to, and that the limits of such port or harbour should be defined as hereinafter appears :
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the hereinbefore-recited power and authority, and by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that, from and after the first day of December, one thousand nine hundred and ten, the said Council shall exercise the powers of a Harbour Board within the limits of the port or harbour hereinafter set forth, and which said port or harbour is called Whangateau-Omaha Harbour.
And in further pursuance and exercise of the hereinbefore-recited power and authority, His Excellency, with the advice and consent aforesaid, doth hereby define the limits of the said port or harbour within which the Council of the County of Rodney is to exercise the powers aforesaid as follows, that is to say :—
All that area forming part of the waters of Omaha Bay and all the estuaries thereof, and bounded as follows : Commencing at Cape Rodney at a point on high-water mark, where intersected by the circumference of a circle the centre of which is on high-water mark on the prolongation in a southerly direction of the boundary between Sections Nos. 152 and 153, Block II, Rodney Survey District, and having a radius of three nautical miles; proceeding thence generally in a southerly direction on an arc of the circumference of the said circle to a point on high-water mark on the northern boundary of Tawharanui Reserve 1874, Block II, Kawau Survey District; thence generally in a westerly and a northerly direction along high-water mark on the water frontages of Blocks II and I, Kawau Survey District, Block IV, Mahurangi Survey District, Block XV, Pakiri Survey District, and Blocks II and I, Rodney Survey District, to the commencing-point : as the above area and limits are shown coloured blue on the plan marked M.D. 3576, and deposited in the office of the Marine Department, at Wellington, in the Provincial District of Wellington.

Licensing Alexander McKay to use and occupy a Part of the Foreshore of Mangonui Harbour as a Site for a Boat-shed and Slip.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-seventh day of October, 1910.
Present :
His Excellency the Governor in Council.
WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned under the Harbours Act, 1908 (hereinafter called “the said Act”), Alexander McKay (hereinafter called “the licensee”) has applied to the Governor in Council for a license under the said Act to occupy a part of the foreshore at Mangonui Harbour, in order to construct a boat-shed and slip thereon; and, in accordance with the one-hundred-and-fiftieth section of the said Act, has deposited plans in the office of the Marine Department, at Wellington, marked M.D. 3586 (two sheets), showing the area of foreshore intended to be occupied, and the manner in which it is proposed to construct the said boat-shed and slip: And whereas it has been made to appear to the Governor in Council that the proposed work will not be or tend to the injury of navigation; and the said plans have, prior to the making of this Order in Council, been approved by the Governor in Council: And whereas it is expedient that a license should be granted and issued to the licensee under the said Act, for the purpose aforesaid, on the terms and conditions hereinafter expressed :
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the object for which the said license is required by the licensee as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and
