Defining the Middle-line of a Further Portion of the Gisborne-Rotorua Railway—viz., Part of the Matawai Section.

A PROCLAMATION.

WHEREAS the portion of the Gisborne-Rotorua Railway from Karaka to Motu (hereinafter termed “the said railway”) is a railway the construction of which is authorized by the Public Works Act, 1908: And whereas the said railway has been partly constructed, and it has been determined to construct and maintain a further portion of the same, part of the Matawai Section:

Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers and authorities conferred on me by the Public Works Act, 1908, and in exercise of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the middle-line of the said further portion of the said railway shall be that defined and set forth in the Schedule hereto.

SCHEDULE.

COMMENCING at a point in Subdivision 1 of Section 6, Block XV, Motu Survey District, which point is marked 38 miles, and is also the termination of the railway described in a Proclamation dated the 10th day of February, 1909, and published in the New Zealand Gazette No. 13, of the 18th February, 1909, proceeding thence generally in a north-westerly direction for a distance of six miles, and passing in, into, through, or over the following lands, viz.: Subdivision 1 of Section 6, and Section 5, Block XV; Sections 12, 5, 13, and 14, Block XI; Sections 6, 7, and 1, Block X; Section 9, Block XI; Section 4, Block VI; and terminating in said Section 4, Block VI, at a point marked 44 miles: including all adjoining and intervening places, lands, reserves, roads, tracks, rivers, streams, and watercourses: all in the Motu Survey District, in the Land District of Hawke’s Bay: as the same is delineated on the plan marked P.W.D. 27072, deposited in the office of the Minister of Public Works, at Wellington, in the Provincial District of Wellington.

Given under the hand of His Excellency the Right Honourable John Poynder Dickson-Poynder, Baron Islington, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House, at Wellington, this twenty-fifth day of October, in the year of our Lord one thousand nine hundred and ten.

Lands reserved under the Scenery Preservation Act, 1908.

A PROCLAMATION.

WHEREAS by the Scenery Preservation Act, 1908 (hereinafter referred to as “the said Act”), a Scenery Preservation Board is constituted, and it is enacted that such Board shall, when so directed by the Minister charged for the time being with the administration of the said Act, inspect any lands possessing scenic or historic interest, or on which there are thermal springs, and make inquiries respecting the same, and report to the Governor; and shall from time to time recommend what lands, whether Crown or private, shall be permanently reserved as scenic, thermal, or historic reserves: And whereas the said Board was duly directed to inspect and report on the lands described in the Schedule hereunder, and has recommended that the said lands should be permanently reserved for scenic purposes, and it is expedient to give effect to such recommendation:

Now, therefore, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers contained in the said Act, do hereby proclaim and declare that the lands described in the Schedule hereunder shall be a scenic reserve under the Scenery Preservation Act, 1908, and subject to the provisions thereof.

SCHEDULE.

CATLIN’S RIVER SCENIC RESERVE.

All that area in the Otago Land District, containing by admeasurement 3 acres and 28 perches, more or less, being Section No. 21, Block IV, Woodland Survey District. Bounded towards the north-west generally by a public road, and towards the east and south generally by a road reserve; as the same is delineated on the plan marked L. 42/10, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

All that area in the Otago Land District, containing by admeasurement 5 acres 3 roods, more or less, being Section No. 21, Block IV, Woodland Survey District. Bounded towards the north-west generally by a public road, and towards the north-east and south-east generally by a road reserve; as the same is delineated on the plan marked L. 42/10, deposited in the Head Office, Department of Lands, at Wellington, and thereon coloured red.

All that area in the Otago Land District, containing by admeasurement 16 acres, more or less, being Section No. 25, Block IV, Woodland Survey District. Bounded towards the north, east, and west by 1-chain road reserve fronting Catlin’s River; and towards the south generally by a public road: as the same is delineated on the plan marked L. 42/3, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Given under the hand of His Excellency the Right Honourable John Poynder Dickson-Poynder, Baron Islington, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House, at Wellington, this thirty-first day of October, in the year of our Lord one thousand nine hundred and ten.

Amending Regulations re Netting in New River Estuary.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fourth day of October, 1910.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS it is enacted by the Fisheries Act, 1908, that the Governor in Council may from time to time, by Order in Council gazetted, make regulations (to have force and effect throughout New Zealand or only in such waters or places as are specified in such regulations) for, amongst other things, imposing conditions and restrictions on the taking of fish, providing for the more effective protection and improvement of fish, and prohibiting the use of nets or seines of all descriptions or of any specified description:

And whereas by Orders in Council dated the twenty-first day of September, one thousand nine hundred and four, the twenty-third day of August, one thousand nine hundred and seven, and the twenty-first day of October, one thousand nine hundred and seven, and published in the New Zealand Gazette No. 78, of the twenty-second day of September, one thousand nine hundred and four, and No. 76, of the twenty-ninth day of August, one thousand nine hundred and seven, and No. 92, of the twenty-fourth day of October, one thousand nine hundred and seven, regulations were made prohibiting the use of nets at the mouth of, or entrance to, certain rivers and streams, including the New River Estuary:

And whereas by Order in Council dated the fourteenth day of December, one thousand nine hundred and nine, and published in the New Zealand Gazette No. 105, of the sixteenth day of the same month, regulations were made prohibiting the use of nets in a portion of the New River Estuary or in any river or stream running therein:

And whereas by Order in Council dated the thirtieth day of December, one thousand nine hundred and nine, and published in the New Zealand Gazette No. 1, of the thirteenth day of January following, regulations were made amending the hereinbefore-recited Orders in Council in so far as they relate to the New River Estuary and at or near the mouth or entrance thereof, and in the rivers and streams running into the estuary:

And whereas it is desirable to further amend such regulations:
