Disallowing By-laws made by Auckland Harbour Board.

ISLINGTON, Governor.

WHEREAS it is enacted by the fiftieth section of the Harbours Act, 1908, that, within six months after the receipt of a copy of any by-law made by a Harbour Board has been acknowledged by the Minister, the Governor may disallow the same or any part thereof:

And whereas certain by-laws made by the Auckland Harbour Board were adopted by the Board at a meeting held on the tenth day of May, one thousand nine hundred and ten, and the receipt thereof was acknowledged by the Minister on the ninth day of June, one thousand nine hundred and ten:

And whereas it is desirable to disallow certain of such by-laws:

Now, therefore, the Governor of the Dominion of New Zealand, in pursuance and exercise of the hereinbefore-recited power and authority, doth hereby disallow clauses 141, 142, and 143 of the said by-laws—that is to say, the following, viz.:

“141. Before any license is issued to any vessel, such vessel shall be approved by the Harbourmaster, and certified by him as in all respects properly equipped and reasonably fit for the purpose for which the license is sought. The Board may at any time during the currency of a license cancel same upon proof that the conditions upon which the license was granted have not been continuously fulfilled, and after an opportunity shall have been afforded to the licensee of showing cause to the Board why such license should not be cancelled.

“142. Such license shall state the number of passengers and the quantity of cargo, ballast, water, or otherwise any boat or vessel may with safety be permitted to carry.

“143. In the case of steam-vessels, the number of passengers allowed shall in no case exceed the number stated in the certificate of survey granted by the Marine Department, and the number of passengers allowed to be carried shall be painted in a conspicuous manner on a board on the upper deck of such steam-vessels in the following form: ‘Licensed to carry Passengers.’”

PURSUANT to the authority conferred upon me by the two-hundred-and-eighty-eighth section of the Justices of the Peace Act, 1908, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, do hereby notify and declare that the persons set out in the Schedule hereto, being persons holding the office of Postmaster under the Post and Telegraph Act, 1908, at the places set opposite their names in the said Schedule, are authorised to take and receive statutory declarations under the two-hundred-and-eighty-eighth section of the Justices of the Peace Act, 1908.
