Excepting Land from the Operation of Section 117 of "The Native Land Court Act, 1894."

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this seventeenth day of January, 1910.
Present :
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS by section four of "The Native Land Laws Amendment Act, 1895," it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of "The Native Land Court Act, 1894" (hereinafter called "the said Act"), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bona fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act : Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette:
And whereas the Waikato District Maori Land Board, by a recommendation made on the fourth day of November, one thousand nine hundred and nine, and received on the thirteenth day of December, one thousand nine hundred and nine, has recommended the Governor to except from the operation of section one hundred and seventeen of "The Native Land Court Act, 1894," for the purpose of alienation by way of sale, the block or parcel of land particularised and set out in the Schedule hereto:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section four of "The Native Land Laws Amendment Act, 1895," and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby except the said land from the operation of section one hundred and seventeen of "The Native Land Court Act, 1894," in order to enable the same to be sold.
SCHEDULE.
All that piece or parcel of land, situate in the Coromandel Survey District, containing 100 acres, more or less, known as Matariki South, and comprised in an order of the Native Land Court, on investigation of title, bearing date the 26th day of July, 1907.

WHEREAS by an order of the Native Land Court made the tenth day of November, one thousand eight hundred and eighty-three, purporting to determine the successors to the share or interest of Honatana, deceased, in the land known as Te Akau Block, certain persons were declared to be the successors to the said share or interest:
And whereas it has been alleged that the said order was made through an error, mistake, or omission within the meaning of section thirty-nine of "The Native Land Court Act, 1894":
And whereas an application has been made to His Excellency the Governor in Council to consent to the making of an application to the Chief Judge of the Native Land Court, in pursuance of the provisions of section thirty-nine of "The Native Land Court Act, 1894," to amend the said order for the purpose of rectifying the said alleged error, mistake, or omission:
And whereas on inquiry, held in pursuance of the provisions of "The Land Titles Protection Act, 1908," it appears that a prima facie case has been established, and that it would be inexpedient to dispose of it by remedial legislation, or by any other procedure which would obviate litigation:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance of all powers and authorities in that behalf vested in him by "The Land Titles Protection Act, 1908," or otherwise howsoever, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the making of an application to the Chief Judge of the Native Land Court, in pursuance of the provisions of the said section thirty-nine of "The Native Land Court Act, 1894," for the purpose of rectifying the said alleged error, mistake, or omission, and the said order of the said Court, and any subsequent orders or instruments of title issued pursuant thereto, may be subject of an order of the Chief Judge under the said section thirty-nine of "The Native Land Court Act, 1894."

Classification Regulation 7a: Including Transferred Officers.

At the Government Buildings, at Wellington, this twenty-second day of January, 1910.

WHEREAS by Order in Council dated the second day of May, one thousand nine hundred and eight, and published in the New Zealand Gazette of the fourteenth day of May, one thousand nine hundred and eight, regulations were made, under the authority of "The Electric Lines Act, 1884," "The Post and Telegraph Classification and Regulation Act, 1890," "The Post and Telegraph Classification and Regulation Act Amendment Act, 1891," "The Post and Telegraph Department Act, 1894," "The Post Office Act, 1900," "The Post and Telegraph Department Act, 1902," "The Post Office Act Amendment Act, 1906," and "The Post and Telegraph Classification Act, 1907," prescribing, inter alia, the conditions of appointment in the Post and Telegraph Department : And whereas it is expedient to amend such regulations in the manner hereinafter set forth:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the authority conferred upon him by "The Post and Telegraph Act, 1908," and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke Regulation 7 in the Schedule to the hereinbefore-mentioned Order in Council, and in lieu thereof doth make the regulation set forth in the Schedule hereto, and doth order that such regulation shall be read as part of the regulations hereinbefore mentioned, and shall have effect on and after the date of publication thereof in the New Zealand Gazette.
SCHEDULE.
7A. (1.) Save in the case of persons skilled in electricity telegraphy, or the like, and in the case of officers transferred from other Departments, and with the exceptions specified in clause 14 hereof, every person entering the Clerical Division shall enter as a cadet, shall be not less than fifteen nor more than twenty years of age, shall be subject to the probation herein directed, and shall be conditionally appointed at the minimum salary allotted to cadets.
(2.) Experts skilled in electricity or telegraphy, or in literature, science, or art, who have proved their qualifications to the satisfaction of the Minister, may enter at a higher age than twenty years, and may be appointed to such class as the Minister determines.
(3.) Officers transferred to the Post and Telegraph Department from any other Department may be classified in such division and class as the Minister determines, due regard being had to seniority and the nature of the duties to be performed by such officers.
