And whereas the Council of the Borough of Petone, the local authority having control of the street known as Richmond Street, being the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to to the said street:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.

ALL that street known as Richmond Street, in the Borough of Petone, Wellington Land District, commencing at its junction with Peel Street, intersecting Jackson Street, and continuing to its junction with the Esplanade, all in the said borough; as the said street is more particularly delineated on the plan marked P.W.D. 25678, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red, and lettered A.B.

Exempting Road through Block II, Westmere Survey District, from the Provisions of Section 117 of “The Public Works Act, 1908.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this seventeenth day of January, 1910.

PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1908,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by subsection two of section one hundred and seventeen of “The Public Works Act, 1908,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:

And whereas on the fourth day of October, one thousand nine hundred and nine, the Waitotara County Council, the local authority having control of the road described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said road:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

THAT road in Waitotara County, Wellington Land District, known as Livingstone Road, commencing at its junction with Great North-western Road, and running in a south-westerly direction through Sections 91 and 155, Right Bank Wanganui River, Block II, Westmere Survey District, to its junction with Stanley Road; all in Westmere Survey District; as the said road is more particularly delineated on the plan marked P.W.D. 25386, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red, and lettered A.B.

Hobson County Council declared a Leasing Authority under “The Public Bodies’ Leases Act, 1908.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this seventeenth day of January, 1910.

PRESIDING IN COUNCIL.

WHEREAS the Hobson County Council is a body of persons having power to lease land held in trust reserved or set apart for public purposes, and has requested the Governor in Council to declare it to be a leasing authority within the meaning of “The Public Bodies’ Leases Act, 1908”:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in compliance with such request, and in exercise of the powers in this behalf conferred by the above-mentioned Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the Hobson County Council is a leasing authority within the meaning of “The Public Bodies’ Leases Act, 1908.”

Regulation under “The Land Act, 1908,” and “The Land Transfer Act, 1908.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this seventeenth day of January, 1910.

PRESIDING IN COUNCIL.

WHEREAS by section three of “The Land Act, 1908,” it is enacted that the Governor may from time to time make regulations for the purposes of that Act: And whereas by section two hundred and twenty-two of “The Land Transfer Act, 1908,” it is enacted that the Governor may by Order in Council gazetted make regulations for regulating the practice and conduct of business under that Act:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulation for the purposes of the said Acts, and doth hereby declare that such regulation shall come into force on the day of the publication thereof in the New Zealand Gazette:—

REGULATION.

In any case where a lease under “The Land Act, 1908,” has been registered under the provisions of “The Land Transfer Act, 1908,” and portion of the land so leased has subsequently been resumed or taken for any public purpose under the provisions of “The Land Act, 1908,” “The Public Works Act, 1908,” or any other statute, thereby causing a correspondent reduction of the rent payable under the lease, the following provisions shall apply:—

(a.) The Commissioner of Crown lands shall forward to the District Land Registrar a certificate under his hand in the form in the Schedule hereto, specifying the portion of land taken and the corresponding reduction of rent.

(b.) The District Land Registrar shall deposit such certificate in his office, and shall note on the registered instrument of lease and on the duplicate thereof, when forwarded to him for that purpose, a memorandum to the following effect:—

“Portion of land in this lease taken for [Name the purpose], as per deposited certificate, dated , 19 , and yearly rent reduced to [Name the reduced yearly rent].”

In the matter of lease from His Majesty to [Name of lessee], dated the day of , 19 , and registered as No of [Specify the land].

This is to certify that from the land comprised in the above-mentioned lease, portion thereof—to wit, the portion, described in the Schedule hereto—was taken by His Majesty
