Description.
The lands described in the foregoing Schedule are situated in the Waiapu County, Hawke’s Bay Land District.
The Board cannot guarantee access by road to any of the aforesaid blocks.
The lands are described for the general information of purchasers, who are recommended nevertheless to make a personal inspection.
Abstract of Conditions of Sale.
- Land to be sold subject to the reserve price being the upset price.
- The highest bidder to be declared the purchaser, but the vendor reserves the right to refuse any bid.
- If any dispute arises as to any bidding the auctioneer shall put up the lot again at the last undisputed bid.
- Ten per cent. of the purchase-money to be paid on the fall of the hammer, balance to be paid in ten equal half-yearly instalments, the first of such instalments being payable on the 1st January, 1911.
- The purchaser to pay interest on unpaid purchase-money at the rate of 5 per cent. per annum, interest to be payable on the 1st days of January and July in each year, and to date from the signing of the contract of sale.
- Residence to conform with section 250 of the Native Land Act, 1909.
- Improvements to conform with section 251 of that Act.
- The purchaser, having complied with the residential and improvement conditions, shall, at the end of five years from the date of the contract of sale, upon payment of the balance of purchase-money, together with interest up to the date of payment, be entitled to a transfer of the fee-simple of the land.
- Land to be sold subject to the provisions of the Native Land Act, 1909, and the regulations made thereunder.

Situated about six miles from Tokomaru Bay, and about three miles from Waipiro Bay by main coach-road. Open fern land suitable for grazing only.
ABSTRACT AND CONDITIONS OF LEASE.
- Term of lease: Twenty-three years, with right of renewal for a further term of twenty-three years.
- The rental shall not be for less than the given upset rental for the first twenty-three years, and shall be computed at the rate of 5 per cent. on the then unimproved value for the further term of twenty-three years.
- Highest bidder to be declared the lessee, but the vendor reserves the right to refuse any bid.
- If any dispute arises as to any bidding, the auctioneer shall put up the lot again at the last undisputed bid.
- The first six months rent to be paid on fall of hammer, together with lease fee (£3 3s.), stamp duty (5s.), and registration fee (10s.).
- Term of lease commences on the 1st January, 1911. Lessee may enter into possession immediately.
- Rental to be paid half-yearly, in advance, on 1st January and 1st July in each year.
- Lessee to pay all rates, taxes, and assessments (land-tax excepted).
- Lessee not to transfer, sublet, or mortgage without the prior consent of the Board. Transfer not allowed until lessee has been one year in possession.
- Including all other land already owned, held, or occupied under a tenure of more than one year’s duration, no person may hold more than 3,000 acres; every acre of first-class land being reckoned as 7½ acres, and every acre of second-class land being reckoned as 2½ acres.
- Lessee to execute lease within thirty days after being notified that it is ready for signature.
- Residence to commence within four years in bush lands or swamp lands, and within one year in open or partly open lands, and to be continuous for six years.
- Lessee has no right to minerals without license, but he may use on the land any minerals for any agricultural, pastoral, household, road-making, or building purpose.
- Every lessee shall bring into cultivation,—
(a.) Within one year from the date of his lease, not less than one-twentieth of the land leased by him;
(b.) Within two years from the date of his lease, not less than one-tenth of the land leased by him;
(c.) Within four years from the date of his lease, not less than one-fifth of the land leased by him;
and shall, within six years from the date of his lease, in addition to the cultivation of one-fifth of the land, have put substantial improvements of a permanent character (as defined by the Land Act, 1908) on first-class land to the value of £1 for every acre of such land, and on second-class land to an amount equal to the net price of every acre of such land: Provided that in no case shall the additional improvements required on second-class land be more than 10s. per acre. - On expiry of term of lease lessee’s improvements will be valued and protected.
- Lease is liable to forfeiture if conditions are violated.
