Modifying License for Tram-line across New River Estuary.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-seventh day of June, 1910.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by Order in Council dated the third day of September, one thousand nine hundred and six, and published in the New Zealand Gazette No. 76, of the sixth day of the same month, the Invercargill Borough Council was licensed to construct a tram-line across the New River Estuary from Otatara to Invercargill, subject to the terms and conditions contained in such Order in Council:

And whereas it is desirable to modify such terms and conditions:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the Harbours Act, 1908, and of every other power and authority enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby modify the said terms and conditions as follows, namely:—

The terms and conditions hereinbefore referred to are hereby varied by authorising the suspension or discontinuance of all passenger and goods traffic over the said tram-line for a period not exceeding three years from the thirty-first day of March, one thousand nine hundred and ten, and by authorising the said tram-line to be used during the said period for the carriage of spoil and other material for the purpose of carrying out the reclamation-works described in an agreement made between the local authority and the Minister of Justice, for and on behalf of His Majesty the King, and dated the twenty-ninth day of January, one thousand nine hundred and ten.

Rotomanuka Drainage District, County of Waipa, constituted.

ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-seventh day of June, 1910.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS, in accordance with the provisions of the third section of the Land Drainage Act, 1908, a majority of the ratepayers in the area of land described in the Schedule hereto, situated in the County of Waipa, have presented a petition to His Excellency the Governor of the Dominion of New Zealand, praying that the said area be constituted a drainage district under the provisions of the said Act:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority contained in the third section of the Land Drainage Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby constitute and declare the area of land described in the Schedule hereto to be a district for the purposes of Part I of the said Act, and to be called by the name of the “Rotomanuka Drainage District”; and also, in pursuance and exercise of the power and authority contained in the fourth section of the said Act, doth hereby declare that the Board of Trustees for the said district shall consist of seven persons, to be elected as members of the said Board under and in accordance with the said Act.


SCHEDULE.

ROTOMANUKA DRAINAGE DISTRICT.

ALL that area in the Auckland Land District bounded by a line commencing at the intersection of the Te Awamutu-Hamilton Road by the northern boundary of Ngaroto Parish; thence easterly along the northern boundary of that parish to the easternmost corner of Section No. 174, Te Rapa Parish; thence along the north-eastern boundary of that section; thence along the south-eastern side of the road forming the north-western boundaries of Sections Nos. 175 and 176 to the northernmost corner of the last-mentioned section; thence along the north-eastern and southern boundaries of the said Section No. 176 and part of the north-eastern boundary of Section No. 175, Te Rapa Parish, to its easternmost corner; thence along the northern boundary of Ngaroto Parish to its north-eastern corner; thence along the eastern boundary of that parish to its south-eastern corner; thence along the southern boundary of the said Ngaroto Parish to the Te Awamutu-Hamilton Road; and thence north-westerly and northerly along the eastern side of that road to the place of commencement.

Validating the Public Notifications with respect to a Loan of £800 proposed to be raised by the Petone Borough Council.

ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-seventh day of June, 1910.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Petone Borough Council lately proposed to raise a loan of eight hundred pounds sterling under the Local Bodies’ Loans Act, 1908, for the purpose of the extension and formation of Nelson Street northwards, the extension of Nelson Street culvert, and the diversion of Percy’s Creek by way of Nelson Street culvert to the sea:

And whereas the provision of section eight of the Local Bodies’ Loans Act, 1908, have not been complied with, inasmuch as the notice to raise the said loan required by that section, although published four times, was not published once in each week for four successive weeks: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by section one hundred and twenty-one of the Local Bodies’ Loans Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the public notification of intention to raise the said loan, and doth hereby declare that the proceedings relative to such loan shall not be called into question by reason of the irregularity aforesaid.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-seventh day of June, 1910.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Petone Borough Council lately proposed to raise a loan of six thousand five hundred and fifty pounds sterling under the Local Bodies’ Loans Act, 1908, for providing a system of drainage for the lands within the boundaries of the borough situated north of the stop-bank, and such other lands as can conveniently be connected with the proposed drainage system:

And whereas the provisions of section eight of the Local Bodies’ Loans Act, 1908, have not been complied with, inasmuch as the notice to raise the said loan required by that section, although published four times, was not published once in each week for four successive weeks: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by section one hundred and twenty-one of the Local Bodies’ Loans Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the public
