Declaring Portion of Ohura Road, in the Whangamomona County, to be a County Road.

ORDER IN COUNCIL.

At the Government House, at Wellington, this first day of June, 1910.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and in exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.


SCHEDULE.

OHURA ROAD.

ALL that portion of the road in the Taranaki Land District, Whangamomona County, known as the Ohura Road, commencing at a point 21 miles 79 chains from the centre of Broadway, Stratford, and running in a north-easterly direction generally along frontage of Sections 1, 2, and 3, and through Sections 4 and 5, and along frontage of and partly through Section 6, all in Block XI, and along frontages of Subsections 7, 1b, and 1c, and part 1b, to a point at the entrance of the Ngatimaru Railway-station yard, 26 miles 68 chains from the centre of Broadway, Stratford, all in Block VII, Ngatimaru Survey District, being a distance of 4 miles 69 chains, more or less; as the said portion of road is more particularly delineated on the plan marked P.W.D. 26713, coloured red, and deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District.

Declaring Portions of the Ohura Road to be a Government Road.

ORDER IN COUNCIL.

At the Government House, at Wellington, this first day of June, 1910.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and in exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portions of the road described in the Schedule hereto shall, on and after the date of this Order in Council, be a Government road.


SCHEDULE.

ALL those three portions of road in the Taranaki Land District known as the Ohura Road, commencing at its junction with the Poro-o-tarao-Taumarunui Road at Kawakawa, and proceeding thence in a north-westerly and south-westerly direction generally through Blocks IX, XII, and XI, Tangitu Survey District, Block I, Rangi Survey District, Blocks IV, III, II, and VI, Ohura Survey District, to a point about 20 chains north-east of its junction with Waitewhena Road, being a distance of 25 miles 29 chains, more or less.

Also that portion commencing at a point about 15 chains north-east of the eastern boundary of Section 7, Block V, Ohura Survey District, at 28 miles 14 chains from the Poro-o-tarao-Taumarunui Road, and proceeding thence in a south-westerly direction generally through Blocks VI, V, IX, and XIII, Ohura Survey District, Block I, Heao Survey District, Blocks IV, III, VII, VI, X, and XIV, Pouata Survey District, to a point near the north-western corner of Section 40, Block XIV, Pouata Survey District, at 44 miles 19 chains from the centre of Broadway, Stratford, being a distance of about 37 miles, more or less.

Also that portion commencing at a point about 10 chains south of the south-western corner of Section 2, Block I, Mahoe Survey District, at 38 miles 6 chains from the centre of Broadway, Stratford, and proceeding thence in a south-westerly direction generally through Block I, Mahoe Survey District, Blocks IV, III, VIII, and VII, Ngatimaru Survey District, to a point about 15 chains north of the south-western corner of Subdivision 3 of Pohokura Block, Block VII, Ngatimaru Survey District, at 26 miles 68 chains from the centre of Broadway, Stratford, being a distance of 11 miles 72 chains, more or less.

As the said portions of road are more particularly delineated on the plan marked P.W.D. 26713, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon lettered A–B, C–D, E–F, respectively, and coloured red.

Licensing the Northern Wairoa Co-operative Dairy Company (Limited) to use and occupy a Part of the Foreshore at Mangawhare, Northern Wairoa River, as a Site for a Coal-bin.

ORDER IN COUNCIL.

At the Government House, at Wellington, this first day of June, 1910.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned under the Harbours Act, 1908 (hereinafter called “the said Act”), the Northern Wairoa Co-operative Dairy Company (Limited), of Mangawhare, Northern Wairoa (hereinafter called “the company”), has applied to the Governor in Council for a license under the said Act to occupy a part of the foreshore and of the land below low-water mark at Mangawhare, Northern Wairoa, in order to erect and maintain a coal-bin thereon; and, in accordance with the one-hundred-and-fiftieth section of the said Act, has deposited a plan in the office of the Marine Department at Wellington (marked M.D. 3518) showing the area of foreshore and land below low-water mark intended to be occupied, and the manner in which it is proposed to erect the coal-bin: And whereas the Governor in Council has approved of the purpose for which the said foreshore and land below low-water mark is to be occupied: And whereas it is expedient that a license should be granted and issued to the company under the said Act, for the purpose aforesaid, on the terms and conditions hereinafter expressed:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the object for which the said license is required by the company as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the company to use and occupy that part of the foreshore and land below low-water mark on which the coal-bin is to be erected, as shown on the plan so deposited as aforesaid, for the purpose of erecting and maintaining the said coal-bin, such license to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.


SCHEDULE.

  1. IN these conditions the term “Minister” means the Minister of Marine, as defined by the Shipping and Seamen Act, 1908, and includes any officer, person, or authority acting by or under the direction of such Minister.

  2. The concessions and privileges conferred by this Order in Council shall extend and apply only to the part of the foreshore and land below low-water mark occupied by the coal-bin, as shown on plan marked M.D. 3518.

  3. In consideration of the concessions and privileges granted by this Order in Council, the company shall, on being supplied with a copy thereof, pay to the Minister the sum of two pounds ten shillings, and thereafter an annual sum of one pound in advance, such annual payments to
