Judea Drainage District Boundaries altered.

ORDER IN COUNCIL.

At the Government House, at Wellington, this first day of June, 1910.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS, in accordance with the provisions of section three of the Land Drainage Act, 1908, a majority of the ratepayers in the area described in the First Schedule hereto, situated in the County of Tauranga, have presented a petition to His Excellency the Governor of the Dominion of New Zealand, praying that the land comprised in the said area be excluded from the Judea Drainage District, as constituted under the provisions of the said Act: And whereas it is expedient to alter the boundaries of such drainage district in manner hereinafter appearing:

Now, therefore, in pursuance and exercise of the power and authority contained in section three of the Land Drainage Act, 1908, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby alter the boundaries of the said Judea Drainage District by excluding from such district the areas of land described in the said petition and in the First Schedule hereto, and doth hereby declare that the boundaries of the said drainage district shall be those described in the Second Schedule hereto.


FIRST SCHEDULE.

AREAS EXCLUDED FROM THE JUDEA DRAINAGE DISTRICT.

SECTION No. 73A, Parish of Te Papa; Sections Nos. 37, 38, 39, 40, 41, and 42, Suburbs of Tauranga; and the lands occupied by Robert Tuthill and Robert Hynds in the Township of Greerton.


SECOND SCHEDULE.

JUDEA DRAINAGE DISTRICT (ALTERED BOUNDARIES).

ALL that area in the Auckland Land District bounded towards the north by the Katikati-Tauranga Road from its junction with Cambridge Road to the Borough of Tauranga; thence towards the south-east and north-east by Borough of Tauranga to the Tauranga-Greerton Road at the easternmost corner of Section No. 60, Suburbs of Tauranga; thence towards the south-east generally by the last-mentioned road to the easternmost corner of Section No. 37, Suburbs of Tauranga; thence by that section and Sections Nos. 38, 39, 40, 41, and 42 to the Township of Greerton; thence by that township to the easternmost corner of Section No. 22A, Suburbs of Greerton; thence by the road forming the south-eastern boundary of that section to the Racecourse Reserve; thence by the Racecourse Reserve to Pye’s Pa Road; thence towards the east by that road to the road forming the southern boundary of Section No. 226, Te Papa Parish; thence towards the south by the road forming the southern boundaries of Sections Nos. 226 and 222; thence towards the south-west by the road forming the south-western boundaries of Sections Nos. 222 and 221 to the south-eastern corner of Section No. 142, Te Papa Parish; thence by the road forming the southern boundary of the last-mentioned section to the Kopurererua Stream; thence towards the west generally by that stream to the southernmost corner of Section No. 141; thence by the western boundary of that section to the road forming the southern boundary of Section No. 88, Te Papa Parish; thence by the last-mentioned road to Cambridge Road; thence towards the north-west by Cambridge Road to the place of commencement: excluding Sections Nos. 73A, 42A, 43, 44, and 45, Te Papa Parish.

Validating Proceedings in connection with a Loan of £1,600, to be raised by the Waipukurau Town Board.

ORDER IN COUNCIL.

At the Government House, at Wellington, this first day of June, 1910.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Waipukurau Town Board lately proposed to raise a loan of one thousand six hundred pounds for duplicating gas plant, extending gas-mains, &c., and providing meters, and refunding to General Fund Account amounts paid out on Gas Capital Account: And whereas, in accordance with section eight of the Local Bodies’ Loans Act, 1908 (as amended), the said Board duly published in the Waipukurau Press, a newspaper circulating in the district, the notice required by that section, the last publication thereof being on the twenty-ninth day of January, one thousand nine hundred and ten: And whereas the notice required by section eight (as amended) and the voting-paper prescribed by section eleven (as amended) both refer to the fact of there being a sinking fund for repayment of the loan, and the said notice states that the proposed loan is to be for a term of twenty-seven years, but (except as aforesaid) the provision for repayment of the loan is not set forth in the said notice and voting-paper: And whereas it appears that the ratepayers have not been misled by any such irregularities as there may have been in the proceedings aforesaid, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by section one hundred and twenty-one of the Local Bodies’ Loans Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the proceedings taken to obtain the consent required by section seven of the said Act, and doth also hereby order and declare that the said raising of the said loan has been duly authorised notwithstanding the irregularities aforesaid, and that such proceedings shall not be questioned by reason only of any such irregularities.
