Revoking an Order in Council taking Land for a Cemetery
in Block VIII, Tokomaru Survey District.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-
ninth day of April, 1910.

Present :

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
PRESIDING IN COUNCIL.

WHEREAS by the Public Works Amendment Act,
1909, it is enacted that if at any time after the
issue or making of any Order in Council taking land under
the Public Works Act, 1908, and before the payment
or award of any compensation in respect of the taking
thereof, it is found that any error in form or substance
exists in or in relation to that Order in Council, the
Governor may, by a subsequent Order in Council gazetted,
revoke the former Order in Council either wholly or so far
as he thinks necessary: And whereas it is found that the
Order in Council taking land for a cemetery in Block VIII,
Tokomaru Survey District, made under the Public Works
Act, 1905, dated the twenty-ninth day of July, one thou-
sand nine hundred and seven (hereinafter termed “the
said Order in Council”), and published in the New
Zealand Gazette
No. 67, page 2308, of the first day of the
following month, contains an error both in form and in
substance: And whereas compensation in respect of the
taking of the said land has not been paid or awarded:

Now, therefore, in pursuance and in exercise of the
powers vested in him by the Public Works Amendment
Act, 1909, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby revoke the said Order in Council.

Revising Telephone Exchange Regulations.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-
ninth day of April, 1910.

Present :

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
PRESIDING IN COUNCIL.

WHEREAS by Order in Council dated the seventeenth
day of January, one thousand nine hundred and
ten, and published in the New Zealand Gazette of the
eighteenth day of January, one thousand nine hundred and
ten, regulations were made under the authority of the
Post and Telegraph Act, 1908 (hereinafter termed “the
said Act”), inter alia, prescribing the charges to be levied
for connection with a telephone exchange: And whereas it
is expedient to alter and amend such regulations in the
manner hereinafter set forth:

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
power and authority conferred upon him by the said Act,
and acting by and with the advice and consent of the Ex-
ecutive Council of the said Dominion, doth hereby revoke
the regulation numbered twenty, under the heading “Tele-
phone Exchanges,” in the Schedule to the above-recited
Order in Council, and in lieu thereof doth hereby make the
regulation set forth in the Schedule hereto; and doth order
that such regulation shall be read as part of the regulations
first herein mentioned, and shall have effect on and after
the date of the publication of this Order in Council in the
New Zealand Gazette.


SCHEDULE.

  1. For connections over three miles in length the sub-
    scriber will be charged at ordinary rates on the first three
    miles. For the portion beyond that distance he will be
    required to pay the cost of erection of the line and an
    annual maintenance charge of £1 for each quarter of a mile
    or fraction thereof if the line is on poles specially erected,
    or 10s. for each quarter of a mile or fraction thereof if the
    wire is on an existing line of poles, or if the wire is already
    in existence and the subscriber has not been required to
    pay the cost of erection the charge will be 15s. for each
    quarter of a mile or fraction thereof. After the expiration
    of three years the rate for the poles specially erected shall
    be 10s. per annum for every quarter of a mile or fraction
    thereof.

Varying Conditions as to setting back the Building-line
of Portion of Eden Vale Road, in the Borough of Mount
Eden, imposed by an Order in Council under Section 117
of the Public Works Act, 1905.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-
ninth day of April, 1910.

Present :

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
PRESIDING IN COUNCIL.

WHEREAS by section three, subsection one, of
the Public Works Amendment Act, 1908, it is,
inter alia, enacted that when by any Order in Council
issued in pursuance of section one hundred and seventeen
of the Public Works Act, 1905, as amended by section
three of the Public Works Act Amendment Act, 1906,
conditions have been imposed with respect to the building-
line in the case of any street or road exempted from
the provisions of those sections, the Governor may from
time to time, by Order in Council, on the application of
the local authority having control of that road or street,
amend the first-mentioned Order in Council by cancelling
or varying the conditions imposed thereby, and any such
cancellation or variation may extend to the whole or to any
part or parts of the said road or street:

And whereas by an Order in Council dated the sixteenth
day of September, one thousand nine hundred and seven,
and published in the New Zealand Gazette, page 2846, of
the same month, exempting portion of the street described
in the Schedule thereto, and known as Eden Vale Road,
Mount Eden, from the provisions of section one hundred
and seventeen of the Public Works Act, 1905, a con-
dition was imposed “that no building or part of a building
shall at any time be erected on either side of the said
portion of street within a distance of thirty-three feet from
the centre-line of the said portion of street”:

And whereas the Mount Eden Borough Council, the local
authority having control of the said street, has made
application that the said Order in Council may be amended
by striking out the condition with regard to the building-
line on the north side of the said portion of street, and
it is desirable that such application should be granted:

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and in exercise
of the powers conferred by the Public Works Amendment
Act, 1908, and of all other powers in anywise enabling
him in this behalf, and acting by and with the advice
and consent of the Executive Council of the said Do-
minion, doth hereby amend the said Order in Council
by varying the said condition with regard to the building-
line so that it shall only apply to the south side and not to
the north side of the said portion of street known as Eden
Vale Road.
