At the Government Buildings, at Wellington, this twenty-
seventh day of April, 1910.
Present:
The Right Honourable Sir J. G. Ward, K.C.M.G.,
PRESIDING IN COUNCIL.
WHEREAS the land described in the Schedule hereto
has been permanently reserved for plantation pur-
poses:
And whereas, in the opinion of the Governor, it is ex-
pedient to vest the said reserve in the Ashburton County
Council:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in exercise of the powers and authorities vested in him
by the fourth section of the Public Reserves and Domains
Act, 1908, doth hereby declare that, from and after the day
of the date hereof, the reserve described in the Schedule
hereto shall become vested in the Chairman, Councillors,
and Inhabitants of the Ashburton County, in trust, for
plantation purposes.
SCHEDULE.
All that strip of land, 200 links wide, containing by ad-
measurement 76 acres, more or less, being portion of the
old 3-chain railway reserve now designated Section No. 3809
(in red), situated in Blocks III, VI, VII, Ashburton Survey
District, Canterbury Land District, the south-eastern
boundary-line of which commences at the south side of
the Mitcham-Chertsey Road, and proceeds south-westerly
along the south-eastern boundary of the said 3-chain rail-
way reserve to the Main South Road: excepting from the
above-described area all intersecting public roads: as the
same is delineated on the plan marked L. 5349/10, deposited
in the Head Office, Department of Lands, at Wellington,
and thereon coloured pink.

by the Ohura Road, and towards the north-west by Sec-
tion No. 9, Block IX, Town of Mangaroa; as the same is
delineated on the plan marked L. 5383/1d, deposited in the
Head Office, Department of Lands, at Wellington, and
thereon coloured green.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-
seventh day of April, 1910.
Present:
The Right Honourable Sir J. G. Ward, K.C.M.G.,
PRESIDING IN COUNCIL.
WHEREAS by section seventy-eight of the Land Act,
1908 (hereinafter referred to as “the said Act”),
it is enacted that the Governor may from time to time, by
Order in Council gazetted, make regulations for carrying into
effect the provisions of the said section: And whereas it is
desirable to make the regulations hereinafter set forth:
Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
power and authority conferred by the said Act, and acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby make the following regu-
lations for the purposes of the said Act, and doth hereby
declare that such regulations shall come into force on the
day of the publication thereof in the New Zealand Gazette:—
REGULATIONS.

In these regulations, if not inconsistent with the con-
text,—
“Commissioner” means the Commissioner of Crown
Lands for the land district in which is situated
the land to be dealt with:
“Lessee” means the lessee of the land to be dealt
with. -
Every application to have recorded the particulars of
the nature and value of the improvements, and the state and
condition of the land before the making of such improve-
ments, shall be made in the form set forth in the First
Schedule hereto, and shall be signed by the lessee. -
Each application shall be accompanied by a deposit of
the sum of five pounds five shillings as payment or part-
payment, as the case may be, of the actual costs and ex-
penses incurred in ascertaining the particulars to be recorded. -
Should the expenses incurred not amount to the sum
deposited by the lessee, he shall be entitled to a refund of
such difference; and if the expenses incurred exceed the
amount deposited, the lessee, on being notified thereof, shall
pay the excess to the Commissioner. -
On receipt of the application, and lease, and deposit, the
Commissioner shall have the land inspected and a report
supplied containing the required details. -
Every report so supplied shall be made in the form set
forth in the Second Schedule hereto, but the actual cost of
inspection must be paid before the delivery of valuation to
the lessee. -
When the Commissioner has ascertained the particulars
to be recorded, his decision on all matters affecting the facts
to be recorded shall be final and conclusive. -
Every record shall be printed or written on parchment,
and shall be permanently preserved as an instrument of
title, and a certified copy thereof shall be entered in the rent-
ledger. -
Every such record shall be in the form set forth in the
Third Schedule hereto. -
The Commissioner shall supply, on demand, to any
person interested in and legally entitled to the same a copy
of such record.
