And whereas on the fourth day of November, one thousand nine hundred and nine, the Council of the City of Auckland, the local authority having control of the portion of the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said portion of the street:

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned.

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on Lots 73 and 71 of Allotments 31 and 42, Section 8, Suburbs of Auckland, within a distance of thirty-three feet from the centre-line of the said portion of street.


SCHEDULE.

ALL that portion of street in the City of Auckland known as Lincoln Street, along the frontages of Lot 71 and part of Lot 73 of Allotments 31 and 42, Section 8, Suburbs of Auckland; as the said portion of street is more particularly delineated on the plan marked P.W.D. 26201, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured purple.

Native Land taken for the Purposes of a Public School in Block V, Mangakahia Survey District, Hobson County.


PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this nineteenth day of April, 1910.

Present:

His Excellency the Governor in Council.

WHEREAS the land mentioned in the Schedule hereto is required for a public work, to wit, for the purpose of a public school in Block V, Mangakahia Survey District:

And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:

And whereas a map in duplicate has been prepared of the said land, as required by the ninetieth section of “The Public Works Act, 1908”:

Now, therefore, in pursuance and in exercise of the powers vested in him by the ninetieth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said public school; and the said land shall vest in the Auckland Education Board as from the thirtieth day of May, one thousand nine hundred and ten.

Regulations under “The Government Life Insurance Act, 1908.”


PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this nineteenth day of April, 1910.

Present:

His Excellency the Governor in Council.

WHEREAS by section seven of “The Government Life Insurance Act, 1908” (hereinafter referred to as “the said Act”), it is, among other things, enacted that the Governor may from time to time, by Order in Council gazetted,–

Direct the use of tables approved from time to time by him for determining the values of all annuities under the provisions of the said Act, and of tables so approved for payment of sums of money at death and otherwise under those provisions; and such tables respectively shall be valid and effectual so long as the same remain in force:

Regulate the mode and form of making contracts under the said Act, and the conditions precedent to such contracts in respect of medical certificates, and of extra rates of premium or fines in case of badness of lives or other contingencies declared by the regulations to be special risks:

Prescribe the mode of proving the age and identity and the existence or death of persons, and the mode of paying sums of money payable under the said Act, and the management of the accounts required to be kept:

Prescribe beforehand the terms upon which premiums paid under contracts for payments to be made at death or otherwise shall be returned to any person beneficially interested in the contract, and determine beforehand the cases or classes of cases in which no premium shall be returned:

And whereas it is expedient to direct the use of the tables hereinafter specified, and that certain of the rules and regulations now in force should be modified in manner hereinafter set forth:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in him by the said Act, and of all other powers and authorities in this behalf vested in him, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make and prescribe the rules and regulations set forth in the First Schedule hereto. And, in further exercise and pursuance of the powers and authorities aforesaid, and acting by and with the like advice and consent as aforesaid, His said Excellency doth order and direct the use of the several tables set forth in the Second Schedule hereto. And, lastly, in exercise and pursuance of the powers and authorities aforesaid, and acting by and with the like advice and consent as aforesaid, His said Excellency doth hereby order that this present Order in Council shall take effect on the date of the publication thereof in the New Zealand Gazette, and shall be read with the Order in Council made under the said Act on the nineteenth day of December, one thousand nine hundred and eight.


FIRST SCHEDULE.

CONDITIONS OF POLICIES TO BE INDORED.

Policies under Tables nVI, nVI₅₀, and 2VI₅₀ in the Second Schedule hereto shall be subject to the following conditions, which shall be indorsed on all such policies issued by the Commissioner, and shall be in substitution for those contained in paragraph 18 of the regulations contained in the Order in Council dated the 19th December, 1908. In all other respects such regulations shall, where not inconsistent, apply to policies issued under such tables.

Conditions.

(a.) Policies shall become void if the statements of the proposer as set forth in the proposal are knowingly untrue; or if any other paper or statement furnished by the proposer, on the faith of which the policy may have been issued, is at any time found to contain any wilfully untrue statement; or if there is at any time on the part of the proposer any fraudulent concealment from the Commissioner of any important particular.

(b.) Policies shall become void if payment of the annual or other premium is not made within the days of grace—namely, thirty days from the date stipulated in the policy.
