(c.) Where money is the subject of a deed
of trust or of a settlement, ante-nuptial
or otherwise, then upon such money
being distributed among the bene-
ficiaries (not being the settlor, his
executors, administrators, or assigns),
on their becoming absolutely entitled
thereto in possession, the only charge
shall be ... £1 per cent.
(d.) Upon the gross capital of any estate in
which the Public Trustee is acting as
attorney or agent, the charge shall be
as arranged between the Public Trustee
and his principal, with the consent of
the Board.
(e.) Upon the gross capital of intestate or
lunatics' estates realised by the Public
Trustee,—
On any sum up to £250 .. £5 per cent.
On the next £9,750 .. £2½ per cent.
On all over £10,000 .. £1¼ per cent.
Provided that with respect to all as-
sets consisting of cash, or of balances
to credit of any current accounts in
any institution, or with respect to
any fixed deposits in any institution,
or with respect to moneys received
under any policy of life or accident
assurance, or mortgages, bonds, and
debentures, and compensation-
moneys received into an estate,
under any Act, the charge shall be ..
Minimum charge under (c), (d),
and (e) .. 10s.
(f.) Upon the gross income of any estate
or agency, realised or unrealised,—
On the first £2,000 per annum .. £5 per cent.
On all over £2,000 per annum .. £2½ per cent.
Provided that on all interest from
debentures and dividends from
shares the charge shall only be .. £2½ per cent.
(g.) Upon unrealised real or personal pro-
perty (not being money) transferred or
delivered in kind to any person en-
titled thereto, being a devisee, legatee,
next-of-kin, cestui que trust, benefici-
ary, or other person of a like charac-
ter, but not including a person en-
titled as principal under any power
of attorney or agency, upon the value
of such property as fixed by the Public
Trustee,—
Up to £10,000 .. £1½ per cent.
On all in excess of £10,000 .. 10s. per cent.
Minimum charge .. £1.
(h.) For re-sealing foreign probates or
administrations, or obtaining a fresh
grant thereof on behalf of foreign exe-
cutors or administrators, when no local
estate is to be dealt with, under the
provisions of Part II of “The Adminis-
tration Act, 1908,” exclusive of dis-
bursements,—
Where the value is not more than
£250 .. £2 2s.
Where the value is over £250 and
not more than £1,000 .. £3 3s.
Where the value is over £1,000 .. £5 5s.
(i.) Where assets outside the Dominion are
received by the Public Trustee, as
principal administrator, by grant or
any authority .. £1½ per cent.
(j.) On all sums lodged in the Public Trust
Office, being contributions under the
provisions of “The Public Service
Classification and Superannuation Act,
1908,” and any amendments thereof;
“The Government Railways Act,
1908,” Part II; “The Police Force
Act, 1908,” Part III; “The Civil Ser-
vice Act, 1908”; “The Post and Tele-
graph Act, 1908”; “The Education
Act, 1908” .. 10s. per cent.
(k.) Upon the gross capital and income
from any real property administered
under “The Public Trust Office Act,
1908,” Part II, “Unclaimed Lands” .. £7½ per cent.
(l.) Upon the gross produce of rents, in-
come, or revenue received from and
under the administration of any pro-
perty pursuant to “The Native Re-
serves Act, 1882,” and its amend-
ments .. £7½ per cent.
(m.) Upon the gross proceeds of rents, in-
come, or revenue received from and
under the administration of any pro-

perty pursuant to “The West Coast
Settlement Reserves Act, 1892,” and
its amendments .. £7½ per cent.
(n.) In all other cases not otherwise hereby
provided, on all sums lodged in the
Public Trust Office under or in pur-
suance of the provisions of any Act,
rule, or law in that behalf at the time
of lodging the same (provided that
where no interest is allowed no com-
mission shall be charged) .. £1 per cent.
(o.) For every lease (except leases under
“The West Coast Settlement Reserves
Act, 1892,” and its amendments) pre-
pared by the Public Trustee and
executed in favour of any lessee, exclu-
sive of stamp duty and registration fee
to be paid by the lessee .. £1.
(p.) For the Public Trustee’s consent to or
execution of an assignment or disposi-
tion of any leasehold, not being assign-
ment consequent upon a sale by the
Public Trustee .. 5s.
(q.) For application to be registered pro-
prietor under “The Public Trust Office
Act, 1908,” Part III, “Unclaimed
Lands” .. £1.
(r.) For any memorandum executed by the
Public Trustee under section 67 of
“The Property Law Act, 1908,” or sec-
tion 116 of “The Land Transfer Act,
1908” .. 5s.
(s.) For discharging mortgage under sec-
tion 75 of “The Property Law Act,
1908,” or section 117 of “The Land
Transfer Act, 1908,”—
Where the value is not more than
£250 .. £1 1s.
Where the value is over £250 and
not more than £1,000 .. £2 2s.
Where the value is over £1,000 .. £3 3s.
(t.) For each certificate issued under sec-
tion 5 of “The Foreign Insurance
Companies’ Deposits Act, 1908” .. £3 3s.
(u.) For making any copy of any document,
6d. per folio, but no charge less than
1s., subject to the Public Trustee’s dis-
cretion.
(v.) For production of documents of title 5s.
(w.) All sums lodged in the Public Trust
Office or coming under the control of
the Public Trustee, which arise out of
the provisions of or come within the
meaning of “wages and effects of de-
ceased seamen” in “The Shipping
and Seamen Act, 1908,” and all con-
tributions on account of sinking funds
by local bodies and by the Government
on account of Government Loans to
Local Bodies Sinking Fund, shall be
exempted from the charges hereby im-
posed.
36. For the purposes of these regulations commission shall
only be computed on the equitable estate or interest of real
estate and chattels real where any encumbrances are re-
gistered.
37. The Public Trustee may, with the consent of the Board,
reduce any of the charges hereinbefore authorised.
38. In addition to the above-mentioned charges there shall
also be chargeable and payable all expenses to which the
Public Trustee is put in postage, exchange, telegrams, legal
assistance, or legal proceedings or charges, fees payable in
any Court or public Department, surveys, the collection
of rents, auctioneers’ charges, and any other services or
expenses whatever which, in the opinion of the Public
Trustee, are necessary or expedient to be provided for or
incurred in the management of the estate or property to
which the charge relates, and also for any services rendered
by the Public Trustee not hereinbefore provided for.
