ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-
fourth day of March, 1910.

PRESIDING IN COUNCIL.
IN pursuance and in exercise of the powers and authorities
conferred by "The Public Trust Office Act, 1908,"
"The Lunatics Act, 1908," "The Native Reserves Act,
1882," "The West Coast Settlement Reserves Act, 1892,"
"The Administration Act, 1908," "The Foreign Insurance
Companies' Deposits Act,1908," "The Public Service Classi-
fication and Superannuation Act, 1908," "The Government
Railways Act, 1908," "The Police Force Act, 1908," "The
Civil Service Act, 1908," "The Post and Telegraph Act,
1908," "The Education Act, 1908," and of any other Act or
law, His Excellency the Governor of the Dominion of New
Zealand, by and with the consent and advice of the Execu-
tive Council, hereby makes the following regulations, to take
effect on and from the first day of April, one thousand nine
hundred and ten:-
REGULATIONS.
- In these regulations, if not inconsistent with the
context,-
"The Act" means "The Public Trust Office Act,
1908":
Property shall be deemed to be placed in the Public
Trust Office when the Public Trustee is authorised
as trustee, executor, administrator, guardian, com-
mittee, agent, attorney, or otherwise to administer
or deal with such property:
"The Board" means the Public Trust Office Board as
constituted by the Act:
"Institution" includes an association, society, corpora-
tion, bank, savings-bank, and any Department of
the General Government of the Dominion:
"Common fund" means the common fund mentioned
in section 32 of the Act;
"Estate" means all the property which the Public
Trustee, as trustee, executor, administrator, guar-
dian, committee, agent, attorney, or otherwise, is
entitled to administer or deal with.

The Public Trust Office shall be situate in the City of
Wellington. Any premises which the Public Trustee from
time to time occupies for the purpose of carrying on the
business of the Public Trust Office shall be the Public Trust
Office for the purposes of the Act and these regulations. -
The office shall be open to the public from 10 a.m. to
1 p.m. and from 2 p.m. to 4 p.m., except on Saturdays, when
it shall close at noon; and it shall not be open at all on
Sundays, Good Friday, and Christmas Day, nor on such
other days or times as are duly declared or appointed by
Government to be general public holidays. -
The Board shall meet for the despatch of business at
such times and places as are from time to time appointed
by the Public Trustee, or by adjournment of a previous
meeting. -
The seal of the Public Trustee, as existing immediately
prior to the passing of the Act, shall be the seal thereunder:
Provided that the Board may, with the consent of the
Governor in Council, from time to time alter the form of
such seal. -
The seal shall be kept at the Public Trust Office, and in
the custody of the Public Trustee, under lock. -
Minutes of the proceedings or resolutions of the Board
shall be recorded in such manner as the Board may direct,
and shall, either at the meeting when the business is done
or at the next succeeding meeting, be confirmed by the
Board, with such alterations or variations as the Board
thinks proper, and, when confirmed, shall be signed by the
Chairman or presiding member at such meeting. -
The minutes of the meetings of the Board held under
the provisions of "The Native Reserves Act, 1882," or its
amendments, shall be kept in both the English and Maori
languages, and the latter shall be certified by a competent
interpreter to be a true translation of the former; and all
such minutes, and all proceedings of such Board connected
therewith, shall, when required by any member thereof, be
interpreted by some competent interpreter to the Native
members of the Board present at such meeting. -
The Public Trustee may fix the charges to be paid to
solicitors, land-brokers, and others in respect of the prepara-
tion and completion of securities to the Public Trustee. -
Wherever in connection with any estate the Public
Trustee is entitled to any of the charges under the scale
hereinafter set forth, he may deduct the same from any
funds in his hands or under his control belonging to the
estate; and, where the funds in the estate have been dis-
tributed, he may recover any such charges from the person
receiving such funds. -
Where through a mistake any overpayment has been
made, the Public Trustee may recover the same from the
person so overpaid. -
The Public Trustee shall from time to time, at such
convenient intervals as he thinks proper, but not exceeding
twelve calendar months at any one time, render accounts
showing the position and state of every estate in the Public
Trust Office to every person who is entitled thereto or in-
terested therein; and all such accounts shall be so ren-
dered free of charge. If any person requires extra copies
of such accounts, or a copy thereof at any other time
than the fixed period for rendering the same, such person
shall pay the charge prescribed in respect thereof: Pro-
vided also that the Public Trustee shall have the sole dis-
cretion as to who are the proper persons to whom such
accounts shall be rendered. -
For the purposes of section 32 of the Act, the interest
payable to the respective estates on moneys which form part
of the common fund shall be computed at the following
yearly rates:-
Class I.-On capital moneys belonging to a testate or in-
testate estate, or held under any deed of trust or settle-
ment:-
(a.) Whilst held for minors or persons under disability,
or for beneficiaries not entitled to payment at
call or on demand-4½ per cent. on sums up to
£3,000, and 4 per cent. on sums in excess of
£3,000.
(b.) Whilst held payable in the ordinary course of ad-
ministration for distribution or at call-3 per cent.
whatever the amount.
The Public Trustees shall fix the date on which any sum
passes from (a) to (b).
Class II.-On capital moneys received and held as attorney
or agent-Such rate as is agreed on, not exceeding the rate
in Class I (a). In the absence of an agreement no interest
shall be payable.
Class III.-On capital moneys belonging to the estates of
lunatics-4 per cent. whatever the amount.
Class IV.-On capital moneys received under "The Civil
Service Act, 1908," section 31 of "The Public Service Classi-
