Order under Section 39 of “The Native Land Court Act, 1894.”
IN THE NATIVE LAND COURT OF NEW ZEALAND, AUCKLAND DISTRICT.
In the matter of an application under section 39 of “The Native Land Court Act, 1894,” by Mohi Tewara Ngawaka, for amendment or cancellation of the order of the Court of the 17th day of January, 1878, appointing successors to Mohi te Whara (alias Mohi te Wara), deceased, in the Maramarua Block, or Lot 62, Parish of Koheroa.
WHEREAS the above-mentioned application has been referred to the Native Land Court for inquiry and report, and the same has been duly reported upon: And whereas it appears that the order appointing successors to Mohi te Whara, deceased, in Lot 62, Parish of Koheroa, was made in error: Now, therefore, for the purpose of rectifying the said error, and in exercise of the power in that behalf vested in me as Chief Judge of the said Court by section 39 aforesaid, I hereby order that the order of the Court dated the 17th day of January, 1878, appointing successors to Mohi te Whara, deceased, in the above-mentioned land, be and the same is hereby amended by deleting the name of Hori Herewini as successor to Mohi te Whara, deceased, in the said land, and awarding his interest therein to the undermentioned persons in the proportion set out after the name of each respectively: Tau Mohi te Wara, m., 4/30; Rawiri Ngawaka, m., 4/30; Kararaina Ngawaka, f., 4/30; Ihaka Moehaki, m., 1/10.

Order under Section 39 of “The Native Land Court Act, 1894.”
IN THE NATIVE LAND COURT OF NEW ZEALAND, WELLINGTON DISTRICT.
In the matter of the Ngarara West A, Section 79 (part of); and in the matter of an application by Hira Parata, under section 39 of “The Native Land Court Act, 1894,” for amendment of the probate of the will of Wi Parata Waipunahau, deceased.
WHEREAS the above-mentioned application has been referred to the Native Land Court for inquiry and report: And whereas the same has been duly reported upon: And whereas it has been found that an error has been made in that part of Ngarara West A, Section 79, aforesaid (containing 118 acres 2 roods 10 perches, or thereabouts), was not excluded from the probate of the will of the said Wi Parata Waipunahau, deceased, as was intended, so that a succession order could be made therefor in favour of the successors of Peehi Wi Parata, deceased, and that the balance of the said section should be appointed under the will by the executors to Winara Wi Parata: Now, therefore, for the purpose of rectifying the said error, and in exercise of the powers vested in me in that behalf by section 39 aforesaid, it is hereby ordered that probate of the will of the said Wi Parata Waipunahau, deceased, be amended so as to exclude therefrom part of the said Ngarara West A, Section 79, containing 118 acres 2 roods 10 perches, or thereabouts.

IN THE NATIVE APPELLATE COURT OF NEW ZEALAND, AUCKLAND DISTRICT.
In the matter of the Poito Nos. 3 and 7 Blocks, and of an appeal by Weeti Katae and Heni Katae against the decision of the Native Land Court, given on the 27th day of October, 1909, on an application for investigation of title.
NOTICE is hereby given that, by notice to the Registrar, and with the approval of the Chief Judge, the said appeal has been withdrawn.

Petition for Incorporation by the Owners of the Ahikouka No. 2B and other Blocks.
IN THE NATIVE LAND COURT OF NEW ZEALAND.
In the matter of “The Native Land Court Act, 1894,” and its amendments, and of an application by the Native Minister to incorporate the owners of the Ahikouka No. 2B and other blocks. At a sitting of the Court held at Tuparoa, before Robert Noble Jones, Judge, and Rawiri Karaha, Assessor, on Thursday, the 2nd day of December, 1909.
UPON reading the application for incorporation lodged herein, and upon hearing all parties who claimed to be heard and the evidence adduced on their behalf, and the Court being satisfied of the consent of the majority of the owners of each of the undermentioned adjoining blocks, and that such blocks can be dealt with to the advantage of the owners thereof by such owners being incorporated as hereinafter appearing, it is ordered that the owners of the blocks of land more particularly described in the Schedule hereto shall be and the same are hereby constituted a body corporate within the meaning of section 122 of “The Native Land Court Act, 1894,” by the name of “The Proprietors of the Ahikouka 2B and adjoining blocks,” subject to the powers, liabilities, and incidents conferred or imposed by the said Act or any amendments thereof. The said lands aggregate about 4,628 acres 3 roods 4 perches, or thereabouts, and are bounded as follows: Towards the north by Ahikouka 1C, Wairoa 1A, Waiomatatini Block, and Te Herenga L; towards the east by Ahikouka 2A, the Pacific Ocean, and other portions of Ahikouka 2B and Reporua No. 3; towards the south by Takaroa 3 and 1, Reporua No. 1, Ngawhakatutu, and Kainanga No. 3; towards the west by Ahikouka 1C and Wairoa 1A.
And it is hereby ordered and directed that a general meeting of the proprietors of the said block shall be held at Waiomatatini on Saturday, the 29th day of January, 1910, at the hour of 2.30 o’clock in the afternoon, for the purpose of nominating a committee to administer the said land, and fixing the number of its members.
And it is hereby further ordered that the committee shall have full power to defray the reasonable costs and expenses consequent upon this incorporation or incidental thereto, and that the title to the said land hereby vested in the corporate body above named shall be subject to all existing rights, alienations, encumbrances, and contracts affecting the same or any interest therein.
