Wellington, and must be accompanied by marked
cheque or Post-office order for an amount equivalent to six
months' rent of the land, as an earnest of good faith, to cover
fee. The deposit in the case of the accepted tender will be
credited to the rent and premium, and in every other case it to
the person whose tender is accepted does not take up the
lease.

  1. The lessee shall have the right of way to the leased
    land from the landing shed to the water-mark.

  2. The lessee shall, at his own cost, put the lease, leased,
    together with the buildings and tram-line thereon, in good
    repair within twelve months from the commencement of the term
    of the lease, and will thereafter, during the currency, in the
    like good order and condition, fair wear-and-tear of the
    same, keep and maintain.

  3. The lessee shall paint the buildings twice during the
    currency of the lease with two coats of proper oil paint,
    and do in a workmanlike manner, the first of such paintings
    to be completed within three years from the commencement
    of the term, and the second, in the year prior to the expira
    tion of the lease.

  4. Within twelve months from the date of the lease, the
    lessee shall extend the tram line into the sea for an addi
    tional distance of 66 ft., and shall make such alterations to
    the tram-line as the Crown, having in mind the timber to be
    stored, and to instal such engines as may be necessary
    for the working of such tram-line, shall approve of, to the
    satisfaction of the Commissioner of Crown Lands.

  5. Should any body corporate now existing or required
    to be constituted hereafter be desirous, within two years of
    the lease, the Governor may determine the lease on giving
    six months' previous notice to the lessee of his
    intention to do so; and, in the event of the lease being so
    determined, the Government agree to settle with the lessee
    for an amount of its being so determined.

  6. Should any part of the land be required at any time
    thereafter during the currency of the lease, for roads,
    or other buildings in connection therewith, and for a road
    therefrom to the wharf or tram-line, a fair
    and a portion of the land required for such purposes,
    rent, a portion of the land to be taken for such purposes
    be deducted from the annual rent reserved by the lease of
    land, and the lessee shall not be entitled to any compensa
    tion in addition thereto than that deducted.

  7. The lessee shall during the currency of the lease, in
    such insurance office as the Commissioner of Crown Lands shall
    approve, insure, and keep insured, in the name of the Crown or its
    successor or assigns, as an insurance company approved of
    by the Commissioner of Crown Lands, such a sum as the Crown shall
    policy, and all receipts for premiums paid in respect thereof,
    shall be produced to the Commissioner of Crown Lands, upon
    being required.

  8. All improvements or repairs to the land or buildings
    and all works in connection therewith, which are made during
    the currency of the lease, and the lessee shall have no right
    to compensation or any payment in respect thereof.

  9. The lessee will have the right to charge storage for
    goods delivered into or from the tram-line, but such storage or
    freight charges shall not be more or less than the current
    general merchandise. He shall be obligatory on the lessee to
    receive into and deliver from the tram-line all goods which the
    public generally with regard to the storage, &c., of goods.

  10. Should the lessee commit any breach of the con
    ditions of the lease, it may be determined at any time with
    ten notices, in writing, by the Commissioner of Crown Lands
    to the lessee.

  11. The rent shall be payable to the Receiver of Land
    Revenue at Wellington, half-yearly in advance, and other
    days from the date of the acceptance of the tender.

  12. The highest or any tender will not necessarily be
    accepted.
