deposited in the Head Office, Department of Lands, at

WHEREAS by an Order in Council made on the
fifteenth day of July, one thousand nine hundred
and one, and published in the Gazette of the twenty-fifth
day of July, one thousand nine hundred and one, certain
powers were delegated to the Patutahi Town Domain Board
in respect of the Patutahi Town Domain therein described:
And whereas it appears expedient to revoke the said Order
in Council:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of the
powers conferred by "The Public Reserves and Domains
Act, 1908," and of every other power and authority enabling
him in this behalf, and acting by and with the advice and
consent of the Executive Council of the said Dominion, doth
hereby revoke the aforesaid Order in Council of the fifteenth
day of July, one thousand nine hundred and one.

Domain Board appointed to have Control of the Marsland
Hill Domain.

ORDER IN COUNCIL.
At the Government House, at Wellington, this second
day of February, 1909.
Present :
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section forty-seven of "The Public
Reserves and Domains Act, 1908" (hereinafter
termed "the said Act"), it is enacted that the Governor
may from time to time, by Order in Council gazetted,
appoint any local authority to be the Domain Board having,
subject to the said Act, control of any public domain:
And whereas by an Order in Council made on the seven-
teenth day of December, one thousand nine hundred and
eight, and published in the New Zealand Gazette of the
twenty-third day of December, one thousand nine hundred
and eight, the land described in the Schedule hereto was
brought under the operation of and declared to be subject to
the provisions of Part II of the said Act:
And whereas it appears expedient to appoint a Domain
Board to control the said domain:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the powers conferred by the said Act, and acting by and
with the advice and consent of the Executive Council of
the said Dominion, doth hereby appoint
THE NEW PLYMOUTH BOROUGH COUNCIL
to be the Marsland Hill Domain Board, having the control
of the domain described in the said Schedule hereto for the
purposes of and subject to the provisions of the said Act;
and doth hereby appoint Monday, the eighth day of March,
one thousand nine hundred and nine, at half past seven
o'clock p.m., as the time when, and the Town Hall, King
Street, New Plymouth, as the place where, the first meeting
of the Board shall be held.
SCHEDULE.
MARSLAND HILL DOMAIN.
ALL that area in the Taranaki Land District, containing by
admeasurement 7 acres 3 roods 31 perches, more or less,
being Section No. 2340 and part of Section No. 2343, Town
of New Plymouth. Bounded towards the north-west by
Fulford Street; towards the east generally by Sections
Nos. 762, 776, Brougham Street, Bulteel Street, Sections
Nos. 790, 802, the abutment of Baine's Terrace and the
Huatoki Stream; towards the south by the other part of
Section No. 2343, 583.4 links; and towards the west generally
by Section No. 2342 and Robe Street: excluding Section
No. 2341: be the aforesaid linkage more or less: as the
same is delineated on the plan marked L. 46827/38, deposited
in the Head Office, Department of Lands, at Wellington, and
thereon bordered red.

Authorising Maori Land Board to approve of Alienation of
Flax on Native Land.

ORDER IN COUNCIL.
At the Government House, at Wellington, this second
day of February, 1909.
Present :
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section twenty-six of "The Maori
Land Claims Adjustment and Laws Amendment
Act, 1907," it is provided that where any instrument of
alienation or partial alienation of flax or other indigenous
usufructs upon Native lands has been executed prior to the
passing of the said Act, any party thereto may apply to the
Maori Land Board of the district in which such lands are
situate, within two months of the passing of the said Act,
for its approval of such alienation:
And whereas on the twentieth day of January, one thou-
sand nine hundred and eight, application was made to the
Aotea District Maori Land Board for its approval of an
alienation under license to cut flax, dated the seventh day of
June, one thousand nine hundred and seven, from Matarena
Enoka and others to Alexander Arnold Nattrass, and trans-
ferred by the said Alexander Arnold Nattrass to the Karioi
Flax Company (Limited), authorising the licensees to cut
flax on the block of Native land known as Rangiwaea 4r16
No. 3B for the term of twenty-one years from the seventh
day of June, one thousand nine hundred and seven, at the
royalty rates and subject to the conditions in the said license
expressed:
And whereas, after due inquiry, the said Board has reported
to the Native Minister that such alienation should be per-
mitted, subject to the following modifications, that is to say:
(1) That the flax-cutting rights be limited to an area of two
hundred and thirty-nine acres, to be defined by partition;
(2) that the royalties to be paid be at the rate of twelve
pounds per annum for the right to cut flax, with a further
payment of four shillings per ton on all green flax cut;
(3) that all royalties be paid to the Native owners:
And whereas the Native Minister has approved such report
and referred the same to the Governor in Council, as required
by the said Act:
Now, therefore, in pursuance and in exercise of the powers
conferred on him by the above-in-part-recited Act, His
Excellency the Governor of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby authorise the
said Aotea District Maori Land Board to approve, by minute
endorsed thereon, of the said license ordering such alienation
before mentioned, modified in accordance with the report of
the said Aotea District Maori Land Board as hereinbefore
mentioned.
