At the Government Buildings, at Wellington, this twenty-seventh day of January, 1909.

THE HONOURABLE JAMES CARROLL PRESIDING IN COUNCIL.
WHEREAS the land mentioned in the Schedules hereto is required for a certain public work, to wit, a Native school and access thereto:
And whereas the Native owners have agreed to make a free gift of the said land to His Majesty the King, and it has been made to appear that such agreement is sufficient for the purposes intended to be effected thereby:
And whereas by an order of the Native Land Court bearing date the thirtieth day of May, one thousand nine hundred and one, certain aboriginal Natives are declared to be the owners of the Awaroa A No. 3 Block, within which the said land is situated:
And whereas, as required by "The Public Works Act, 1908," maps have been prepared showing accurately the position and extent of the said land, and such maps are hereto attached:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise and pursuance of the powers and authorities conferred by "The Public Works Act, 1908," and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the land shown upon the said maps and described in the Schedules hereto, is hereby taken for the purposes of the said Native school and access thereto;
and shall vest in His Majesty the King as from the thirty-first day of March, one thousand nine hundred and nine.

Vesting Land in Maori Land Board under Section 24 of "The Maori Land Claims Adjustment and Laws Amendment Act, 1907."

At the Government Buildings, at Wellington, this twenty-seventh day of January, 1909.

THE HONOURABLE JAMES CARROLL PRESIDING IN COUNCIL.
WHEREAS by section twenty-four of "The Maori Land Claims Adjustment and Laws Amendment Act, 1907," it is enacted that any portion of any block of Maori land, not exceeding in any one case an area of five acres, which in the opinion of the Native Minister is suitable as a site for a fruit-preserving factory, dairy factory, cheese-factory, or creamery, or for any building required for any religious, charitable, educational, or public purpose, may be dealt with as in the said section is provided:
And whereas the land described in the Schedule hereto is land which, in the opinion of the Native Minister, is suitable as a site for a cheese-factory:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby declare that the said land is vested in the Waiariki District Maori Land Board for an estate in fee-simple in possession, subject to all valid encumbrances, liens, and interests affecting the same, to be held and administered by the said Board for the benefit of the Maori owners, and in accordance with the provisions of the said section.
SCHEDULE.
ALL that area in the Auckland Land District, containing by admeasurement 1 acre 3 roods 31 perches, more or less, being part of Ruatoki No. 1 Block, situated in Block II, Waimana Survey District. Bounded towards the north by a right line bearing 85° 28', distance 669.4 links; towards the east by a right line bearing 190° 21', distance 299.9 links; towards the south by a right line bearing 265° 24', distance 669.3 links; and towards the west by a right line bearing 10° 16', distance 300.5 links: as the same is delineated on the plan marked 14834A, deposited in the office of the Chief Surveyor, at Auckland, and thereon bordered red.

Regulations under "The Native Land Court Act, 1894," amended.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-seventh day of January, 1909.

THE HONOURABLE JAMES CARROLL PRESIDING IN COUNCIL.
WHEREAS, in exercise of the powers conferred upon him by sections one hundred and twenty-six, one hundred and twenty-nine, and one hundred and thirty of "The Native Land Court Act, 1894" (hereinafter called "the said Act"), and of all other powers in and by the said Act him thereto enabling, His Excellency the Governor of the Dominion of New Zealand, acting under the advice and consent of the Executive Council of the said Dominion, did, on the first day of April, one thousand eight hundred and ninety-five, make certain rules and regulations (hereinafter called "the original regulations") for the purpose of giving full effect to the provisions of Division II, Part II, of the said Act:
And whereas the original regulations were gazetted on the fourth day of April, one thousand eight hundred and ninety-five: And whereas it is expedient to amend the original regulations in manner hereinafter appearing:
Now, therefore, in exercise of all and single the herein-before-recited powers, and of all other powers and authorities him enabling in this behalf, His Excellency the Governor of New Zealand, acting with the advice and consent of the Executive Council of the said Dominion, doth hereby amend and extend the original rules and regulations in manner appearing in the Schedule hereto.
SCHEDULE.

ORIGINAL Regulations 10 to 21 (both inclusive) shall be deemed to be directory, and not mandatory.

If there be any non-compliance with original Regulations 10 to 21, or any other irregularity in the nomination, election, or constitution of a committee, the Court may inquire into the same before making its order under original Regulation 20.

If the Court ascertains that such irregularities or non-compliance took place, it may nevertheless issue its order under said Regulation 20, and such order shall be valid; or the Court may in lieu thereof direct that the nomination and election of the committee be commenced de novo.

Where it has been directed that a committee be nominated and elected de novo, the original regulations and these regulations shall, mutatis mutandis, apply to such new proceedings, save and except only that in computing the time for holding the general meeting the same shall be computed from the date of such direction for the proceedings de novo, instead of from the date of the order of incorporation.

If in such proceedings de novo there be any further non-compliance or irregularities, the Court may, notwithstanding such irregularities or non-compliance, issue its order under original Regulation 20.
