to lose force and effect throughout New Zealand and only in
such waters or places as are specified in the regulations:
And whereas by Order in Council made on the twenty-
seventh day of August, one thousand nine hundred and
six, and published in the New Zealand Gazette of the thirty-
thirteenth day of the same month, regulations were made
providing that "The rivers or parts of rivers and other
waters from or in which no person shall take trout or salmon,
rivers or streams enumerated in this proviso to clause five of
the said regulations, and such other rivers, streams, or por-
tions by adding to the list of rivers or streams in which such
proviso is not to apply" be that for New Zealand hereinafter
such "The Waikanae and the Hokio Rivers":
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance of the power and
authorities conferred upon him by the said Act, and of all
other powers and authorities enabling him in that behalf,
and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby make
the following regulations for the prescribing of limits and the
list of rivers or streams therein mentioned within
which prohibitions or restrictions on the taking of trout or
lunres or baits the streams known as the Mungaroa Stream,
Akatarawa Stream, and Hutt River are not to be held
Maungaroa Stream, Akatarawa Stream, and Hutt River are not
to be held to be subject to the limits and restrictions on the
course to the Waikanae River; and doth hereby delete from
the said proviso the Waikanae River and the Hokio Stream."

Amending Regulations for Acclimatisation in the Auckland
Acclimatisation District.

ORDER IN COUNCIL.
At the Government House, at Wellington, this fifth day
of October, 1909.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by Order in Council dated the twenty-
seventh day of July, one thousand nine hundred and
seven, and published in the New Zealand Gazette No. 64,
of the twenty-ninth day of July, 1907, certain regulations
were made for trout-fishing in the Auckland Acclimatisation
District:

And whereas it is desirable to revoke clauses two, three,
and ten of the said regulations, and to make other regula-
tions in lieu thereof:

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the power and authority conferred upon him by Part II
of "The Fisheries Act, 1908" (hereinafter referred to as the
said Act), and of all other powers and authorities enabling
him in that behalf, and acting by and with the advice and
consent of the Executive Council of the said Dominion, doth
hereby revoke clauses two, three, and ten of the said regula-
tions of the twenty-seventh day of July, 1907, and doth
hereby make the following regulations in lieu thereof:

  1. The rivers and streams throughout the Auckland Acclima-
    tisation District, which includes the Counties of Whangarei,
    Hokianga, Hobson, Bay of Islands, Whangaroa, Mangonui,
    Otamatea, Rodney, Waitemata, Eden, Manukau, Franklin,
    Raglan, Kawhia, Awakino, Waitomo, and that portion of
    Ohura County lying to the north of a straight line running
    east and west through the southernmost point of the northern
    boundary of Pukekohe County, together with that portion
    of Piako County to the north of Rangitoto Mountain:β€”

REGULATIONS.

  1. Every whole-season license shall entitle the holder
    thereof to fish for acclimatised fish in all waters open to
    the Auckland Acclimatisation District for a period extending
    from the first day of October in any one year to the thirty-
    first day of May in the next succeeding year, but shall be
    subject, however, to the special limitations and restrictions
    hereinafter set forth.

  2. Every half-season license shall entitle the holder thereof
    to fish for acclimatised fish in all waters open to the Auckland
    Acclimatisation District for a period extending from the first
    day of May in any one year to the thirty-first day of October in
    any one year, or from the first day of October in any one year
    to the thirty-first day of October in the year following, both
    dates inclusive. Every half-season license shall be subject to
    the special limitations and restrictions hereinafter set forth.

  3. Every person found with any acclimatised fish during the
    period between the thirty-first day of May and the first day
    of October in any year, both dates inclusive, shall be deemed
    to be fishing during the close season.

  4. Except as provided for by the regulations regarding keep-
    ing of trout, no person shall use any method for taking trout
    or salmon which is not specified in the regulations set forth
    in the New Zealand Gazette of the eighth day of

  5. No person shall have in his or her possession,
    whether frozen, chilled, or otherwise, any Salmonida or
    trout taken within the Auckland Acclimatisation District.

  6. Provided that this regulation shall not apply to the possession of fish by a licensed dealer or an
    officer of the Auckland Acclimatisation Society for purposes
    of acclimatisation."

occupy a Part of the Foreshore of Kohukohu, Hokianga
River, as a Site for a Boatshed and Slip.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fifth day
of October, 1909.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS, there being no harbour board empowered
to deal with the undermentioned foreshore and
waters adjacent thereto, His Excellency the Governor,
acting by and with the advice and consent of the Executive
Council of the Dominion of New Zealand, doth hereby, in
pursuance and exercise of the powers and authorities con-
ferred by the Harbours Act, 1908, and all other powers and
authorities enabling him in that behalf, grant unto Messrs.
Thomas Hartley and Thomas Francis Hartley, trad-
ing under the style or firm of "Thomas Hartley and Son,"
of Kohukohu (hereinafter called "the licensees"), leave
to use and occupy (subject to the conditions hereinafter
mentioned) a part of the foreshore and waters of the
Hokianga River, in the Provincial District of Auckland,
having an area of one hundred and fifty-fifth of a perch,
more or less, as the same is shown on the plan marked
M.D. 3382, deposited in the office of the Marine Department,
at Wellington, and therein coloured red, for the
purposes of a boatshed and slip, and for no other purpose.

And whereas it has been made to appear to His Excellency
the Governor that the proposed boatshed and slip is for the
convenience and benefit of the public, and will not injuriously
affect the navigation or the public convenience of the
harbour, and will not interfere with any rights of Native
owners in the adjoining land:

And whereas it is desirable that a license should be granted
to the licensees on the conditions hereinafter expressed:

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of the
power and authority conferred upon him by the said Act,
and of all other powers and authorities enabling him in that
behalf, and by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby
approve of the object for which the said license is required
as for the purposes of the Act, and doth hereby declare that
the conditions for the grant of a license to the
licensees shall be as set forth in the Schedule hereto:

SCHEDULE.

  1. In these conditions the term "Minister" means the Minis-
    ter of Marine, as defined by "The Shipping and Seamen
    Act, 1908," or any person exercising the powers and functions
    acting by or under the direction of such Minister.

  2. This license may be revoked at any time by this Order
    in Council, and shall extend and apply only to the part of the
    foreshore and waters of the Hokianga River, in the Provincial
    District of Auckland, shown on the plan marked M.D. 3382,
    deposited in the office of the Marine Department, at Wellington,
    and therein coloured red.

  3. For the purposes of the concessions and privileges
    granted by this Order in Council, the licensees shall, on
    or before the first day of January in each year, pay to the
    Crown the sum of five shillings, and shall forward to the
    Marine Department two shillings as rent for the occupation
    of the foreshore, together with two copies of every document
    published in the New Zealand Gazette, and two copies of every
    plan submitted to the Minister, in compliance with this Order
    in Council.

  4. The licensees shall be entitled to the full and free payment
    of the proper dues, have free and full liberty to use the said
    foreshore and waters for the purposes aforesaid, but for no
    other purpose.

  5. His Majesty or the Governor, and all officers in the
    service of His Majesty or the Government of New Zealand,
    shall at all times have free ingress, passage, and egress into,
    upon, and out of the said boatshed and slip without
    payment.
