SCHEDULE.

All that area in the County of Waitotara, Blocks III and
IV, Waitotara Survey District, containing 30 ac. 0 rd. 20 p.,
comprising Section No. 15 and parts of Sections Nos. 14, 16,
17, 18, 19, 20, and 21, Block IV, Waitotara Survey District, as
shown on deposited plan No. 222, and being Crown land:
Bounded as follows: Commencing at a point on the south-
eastern corner of Section No. 17; thence south-westerly along
south-easternmost corner of that section; thence south-easterly
along the north-eastern side of the Wanganui and Patea Main
Belt Road; thence north-easterly along the south-eastern
boundary of Land Transfer deposited plan No. 222 (being a private
road), and continuing to the easternmost corner of the south-
most corner of Lot No. 61 on Land Transfer deposited plan
No. 201; thence westerly along the southern boundary of
the land comprised in the said deposited plan No. 222 to the
south-west corner of Lot No. 59 of that plan, being a
point distant 266 links along the southern boundary of Lot No. 60
to its westernmost corner, being the angle of the road
above mentioned; thence southerly along the road in an acute
opposite angle; thence south-westerly and south-easterly,
following the said road, for 100 links; thence westerly along
western and south western boundaries of Land Transfer
deposited plan No. 222 to the southernmost corner of Lot
No. 61 on the said deposited plan; thence southerly,
southerly along the last-mentioned road to the Virginia
Lake (formerly the Lake Virginia), due south from the junc-
tion of the north-west side of the last-mentioned road with
the Wanganui and Patea Main Belt Road; thence by the said
Virginia Lake generally in a south-easterly direction to the
north-easterly along the north-east boundary of the said
Virginia Lake to its easternmost corner; thence south-
westerly along the north western boundary of Section No. 15
to the northernmost corner of that section; thence north-
easterly along the south-eastern boundary of Section No. 15
for a distance of 2828 links to a point about the centre of
a private road; thence south-easterly along a private road a
distance of 49.2 links to the south-west side of Peake's
Road; thence south-easterly along the south-west side of
the said road for a distance of 462.2 links; thence south-
westerly, south-easterly, and south-westerly, by the southern
boundaries of Section No. 17 and south-western boundaries of a
series of the land comprised in Land Transfer deposited plan
No. 222 to the southernmost corner of the land comprised in
deposited plan No. 268; and thence south-easterly along the
south-western boundary of that plan to the commencing
point.

Declaring Land to be subject to Part I of "The Native
Land Settlement Act, 1907."

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth
day of October, 1909.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section four of "The Native Land Settle-
ment Act, 1907" (hereinafter called "the said Act"), it
is enacted that, when the Governor is satisfied that any Native
land is not required for occupa-
tion by the Maori owners, he may, by Order in Council, declare
the said land to be lawful for the Governor by Order in
Council to dispose of for settlement in the manner provided in
the said Act as from the date of such Order, and the same
shall thereupon become and be all intents and purposes domain,
notwithstanding that the said land may be situate within a Native
land district constituted under "The Native Land Act, 1909": And
whereas the said Commission has reported that the Native
land described in the Schedule hereto is not required for
occupation by the Maori owners, and is available for sale or
leasing:

Now, therefore, His Excellency the Governor, in pursuance of
this behalf vested in him by the aforesaid section four, His
Excellency, the Governor of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby declare that the land
specified in the Schedule hereto shall, as from the date of
this Order, be subject to Part I of "The Native Land Settle-
ment Act, 1907."

SCHEDULE.

All that parcel of land, containing by admeasurement 1,800
acres, more or less, being Part of Otaokawa No. 3 Block, situ-
ate in the Land District of Auckland, and being a portion
of the land known as Otaokawa No. 3 Block.
Bounded towards the north-east generally by Native land
and Section 1 of Block VI, Maungakawa Survey District;

towards the south by a line running from a point at peg IV
on the eastern boundary to a point on the western boundary
of No. 3C; Orakau; And towards the north-west by Native
land.

Drainage-works in Blocks VI, I, and X, Waikou Survey
District, and in Blocks I and III, Moeatoa Survey, and
Piako Survey District, Thames and Ohinemuri Counties.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth
day of October, 1909.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS it is provided by subsection one of sec-
tion nine of "The Native Land Settlement Act, 1907
(the Governor may from time to time take under "The
Public Works Act, 1908," in such public work as aforesaid,
whether under the provisions of section twenty of "The
River Boards Act, 1908," by Order in Council, any area
of Native land required for the purpose of the most effective development
of the drainage or other works authorised by this Act or for
any other purpose of such work) as aforesaid):

And whereas the lands described in the Schedule hereto
are adjacent to the land, or apart under the Hauraki
Plains Act, 1908," and are required for the purpose of sub-
section one of section nine of the said Act expressed the
most effective development of the main drain and of the
branch drains in a boundary of the main drain to carrying
out of the drainage authorised by such Act:

And whereas the said lands are not comprised in private
owners under a title which is not derived from the Crown:

And whereas there is contained within the boundaries of
the said lands as required by the ninetieth section of "The
Public Works Act, 1908":

Now, therefore, in pursuance and exercise of the powers
vested in him by the ninth section of "The Hauraki Plains
Act, 1908," and all other powers in anywise enabling him
by Order in Council, and with the advice and consent
of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby
declare that the lands herein, and described in particular
in the Schedule hereto, shall be deemed to be taken for the
works thereby authorised to be constructed as prescribed
by "The Hauraki Plains Act, 1908," and shall vest in His
Majesty the King as from the twenty-fifth day of October,
one thousand nine hundred and nine.
