ascertain who are the Natives beneficially entitled under
the trust recited in the said grant, and in what shares or
proportions:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the powers and authorities conferred upon him as afore-
said, and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby order
and declare that the investigation and determination of the
names of the Natives beneficially entitled under the said
trust, and the relative shares and proportions in which such
Natives are so entitled, and of any matter or question which
may arise in relation thereto, or which it shall be necessary
to determine for the purpose aforesaid, shall be and the
same are hereby brought within the jurisdiction of the said
Court. And it is hereby declared that this Order is made
under the provisions in that behalf of “The Native Land
Court Act, 1894,” and “The Land Titles Protection Act,
1908,” and that this Order shall operate accordingly as a
consent of the Governor in Council to the proceedings
hereby authorised.
SCHEDULE.
All that piece or parcel of land, containing 293 acres, more
or less, situate in the Land District of Auckland, and known
as Allotment 154, Parish of Te Puna, and being part of the
land comprised in a Crown grant dated the 24th day of
August, 1870.

At the Government House, at Wellington, this twenty-fifth
day of September, 1909.

His EXCELLENCY THE GOVERNOR IN COUNCIL.
I N pursuance and in exercise of the powers vested in him
by “The Public Works Act, 1908,” and of all other
powers in anyway enabling him in this behalf, His Excel-
lency the Governor of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby order and declare that
the road described in the Schedule hereto, known as the
Taheke Branch Road, shall, on and after the date of this
Order in Council, be a county road.
SCHEDULE.
TAHEKE BRANCH ROAD.
All that portion of road in the Wellington Land District,
Rangitikei County, known as the Taheke Branch Road,
commencing at the junction with the Taheke Road, and
proceeding generally in a northerly direction, fronting
Section 18, Block II, Tiriraukawa Survey District, and
terminating at the boundary between Sections 18 and 19,
Block II aforesaid, being a distance of 51 chains, or there-
abouts; as the said road is more particularly delineated on
the plan marked P.W.D. 25204, deposited in the office of
the Minister of Public Works, at Wellington, in the Wel-
lington Provincial District, and coloured red thereon.

District, Block X, Thames Survey District, and Block IV,
Piako Survey District, Thames and Ohinemuri Counties.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fifth
day of September, 1909.
Present:
His EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS it is provided by subsection one of sec-
tion nine of “The Hauraki Plains Act, 1908,” that
“the Governor may from time to time take under ‘The
Public Works Act, 1908,’ as for a public work, or purchase,
whether under the provisions of section twenty of ‘The
Maori Land Settlement Act, 1905,’ or otherwise, any area or
areas of land adjacent to the land set apart under this Act as
aforesaid, the acquisition of which is in the opinion of the
Governor necessary for the more effective carrying-out of
the drainage or other works authorised by this Act or for
the better disposal of the land so set apart”:
And whereas the lands mentioned in the Schedule hereto
are adjacent to the land set apart under “The Hauraki
Plains Act, 1908,” and the Governor has, in terms of sub-
section one of section nine of the said Act, expressed the
opinion that the acquisition of the lands described in the
Schedule hereto is necessary for the more effective carrying
out of the drainage authorised by such Act:
And whereas the said lands are held or occupied by Native
owners under a title which is not derived from the Crown:
And whereas maps in duplicate have been prepared of
the said lands, as required by the ninetieth section of “The
Public Works Act, 1908”:
Now, therefore, in pursuance and in exercise of the powers
vested in him by the ninth section of “The Hauraki Plains
Act, 1908,” and the ninetieth section of “The Public Works
Act, 1908,” and of all other powers in anyway enabling him
in this behalf, His Excellency the Governor of the Dominion
of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby
declare that the lands shown upon such maps, and described
in the Schedule hereto, shall be deemed to be taken for the
more effective carrying-out of the drainage-works authorised
by “The Hauraki Plains Act, 1908,” and shall vest in His
Majesty the King as from the fifth day of November, one
thousand nine hundred and nine.
