Recreation Reserve in Auckland Land District brought under Part II of “The Public Reserves and Domains Act, 1908.”

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this thirteenth day of September, 1909.

BY virtue of the powers and authorities vested in me by the twenty-sixth section of “The Public Reserves and Domains Act, 1908,” I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the Auckland Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of Part II of the said Act; and such reserve shall hereafter be known as Takahue Domain, and be managed, administered, and dealt with as a public domain.

SCHEDULE.
TAKAHUE DOMAIN, MANGONUI COUNTY.

ALL that area in the Auckland Land District being Section No. 6A, Block XV, Takahue Survey District, and containing by admeasurement 4 acres 1 rood 27 perches, more or less. Bounded towards the west, north, and east by the Takahue River; and towards the south by Section No. 6, 255 links, the crossing of a road 100 links wide, and by Section No. 3, 248 links: be all the aforesaid linkages more or less: excepting a public road, 100 links wide, which intersects the section: as the same is delineated on the plan marked L. 1323, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Amended Regulations.—Leave of Absence and Travelling-allowances.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by “The Civil Service Act, 1908,” and “The Public Service Classification and Superannuation Act, 1908,” and of all other powers and authorities thereunto enabling him, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations respecting leave of absence and travelling-allowances of officers of the public service of New Zealand, and doth direct that such regulations shall come into force on the first day of October, one thousand nine hundred and nine.

REGULATIONS.
LEAVE OF ABSENCE.

  1. EVERY officer in the Civil Service may be granted leave of absence for recreation on the following scale:—
    (1.) When an officer has served for fifteen years or upwards, not exceeding three weeks in each year.
    (2.) When he has served less than fifteen years, not exceeding two weeks in each year.

  2. The granting of any such leave of absence shall be subject to the express conditions that the behaviour of the officer has been in every way satisfactory, that intermittent leave has been for a minimum number of days only, that absence from illness has not exceeded one week, and more generally that his official duties have been properly performed.

  3. No officer shall be entitled to claim leave of absence as a right, and if for any cause the head of the Department thinks such leave ought not to be granted, he may refuse the same in any case, subject to the approval of his action by the Minister.

  4. An officer failing to avail himself of the annual leave provided for will not on that account be entitled to a more lengthened leave in any subsequent year unless under special circumstances approved by the Minister.

  5. In cases of absence from illness or accident for any period extending over two days a medical certificate is necessary, but heads of Departments or other responsible officers may require that a certificate be supplied forthwith. The certificate should state the nature of the illness or accident.

TRAVELLING-ALLOWANCES AND TRAVELLING-EXPENSES.

  1. (1.) All salaried officers shall receive travelling-allowance for personal expenses at the following rates:—
    Per Diem.
    (1.) Officers drawing salaries not exceeding £400 s. d. per annum .. .. .. 10 0
    (2.) Officers drawing salaries exceeding £400 and not exceeding £600 per annum .. .. 12 6
    (3.) Officers drawing salaries exceeding £600 per annum .. .. .. 15 0
    Provided that while at sea the allowance shall be—
    For the first day .. .. .. 5 0
    For subsequent days.. .. .. 2 6
    (2.) Such allowances shall include meals and porterage.

  2. Travelling-allowances shall be paid only where an officer is necessarily absent from his headquarters at night; but, for all journeys where an officer is not obliged to be absent at night, actual expenses will be paid to an amount in no case exceeding the full daily rate above authorised for personal expenses, on production of a statement giving details of the nature of the charges, with dates, places, and to whom paid.

  3. The two preceding regulations shall not apply to cases in which a temporarily higher rate shall be specially sanctioned by a Minister; nor shall anything in these regulations preclude Ministers from specially authorising temporary special rates or amounts for travelling, to meet special cases, as hitherto.

  4. Cost of transport by land or sea will be paid by the Government, or, when paid by the officer travelling, the same will be recouped to him on production of vouchers; but no vouchers for such expenses will be required for sums of less than 5s., and vouchers for railway fares will not be required if the railway travelled upon and the extent of the journey is stated.

  5. All vouchers for travelling allowances or expenses must be made out in detail on the proper Treasury form, signed and certified by the claimant, and certified as correct by the head of his Department or other authorised authority.

  6. The nature of the duty on which the officer is travelling shall be stated on the voucher.

  7. No officer is to travel without the authority of the head of his Department.

GENERAL.

  1. All existing regulations as to leave of absence and travelling-allowances of officers of the public service are hereby modified in so far as they are inconsistent with these regulations.

  2. These regulations shall apply to all Departments of the public service, excepting the regulations regarding leave of absence, which shall not apply to the Government Railways Department.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section fifteen of “The Native Land Court Act, 1894,” it is enacted that the Governor in Council may, by Order, from time to time confer on the Native Land Court, as established by the said Act, jurisdiction in any matter or question referred to in such Order exclusively affecting the rights of Natives in any real or personal property: And whereas a Crown grant was issued on the twenty-fourth day of August, one thousand eight hundred and seventy, for, inter alia, the land described in the Schedule hereto to Maungapohatu and Te Wanakore, aboriginal chiefs, in trust for the Pirirakau Tribe, their heirs and assigns: And whereas it is expedient that the Native Land Court should be empowered to inquire and
