Validating Proceedings in connection with Loan of £4,600, Onehunga Borough Council.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this tenth day of August, 1909.

Present:

THE HONOURABLE GEORGE FOW LDS PRESIDING IN COUNCIL.

WHEREAS the Onehunga Borough Council recently proposed to raise a loan of four thousand six hundred pounds, under “The Local Bodies’ Loans Act, 1908,” for the purpose of paying off a previous loan of the same amount for waterworks: And whereas an irregularity has occurred in the procedure to obtain such loan, inasmuch as the resolution required by section sixty-four of “The Municipal Corporations Act, 1908,” calling the special meeting of the Council to pass a resolution (to operate as a special order) raising such loan of four thousand six hundred pounds did not specify the place of such meeting: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the aforesaid proceedings:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section one hundred and twenty-one of “The Local Bodies’ Loans Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the said resolution calling the above-mentioned meeting of Councillors shall be taken to be as valid as though it had contained the full particulars required by section sixty-four of “The Municipal Corporations Act, 1908,” and that the proceedings in connection with the said loan shall not be called in question by reason only of the irregularity aforesaid.

Notifying Land in Wellington Land District for Sale by Public Auction.

PLUNKET, Governor.

IN pursuance of the powers and authorities conferred upon me by the one-hundred-and-twenty-sixth section of “The Land Act, 1908,” I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, do hereby appoint Wednesday, the twenty-ninth day of September, one thousand nine hundred and nine, as the time at which the land enumerated in the Schedule hereto shall be sold by public auction; and I do hereby fix the price at which the said land shall be sold as that mentioned in the said Schedule hereto.

Raurimu is situated on the North Island Main Trunk Railway, about twenty-six miles south of Taumarunui, and about thirty miles north of Raetihi.

Opening Lands in Auckland Land District for Sale or Selection.

PLUNKET, Governor.

IN pursuance and exercise of the powers and authorities conferred upon me by “The Land Act, 1908,” I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, having received the report of the Under-Secretary in this behalf, as provided in section one hundred and fifty-four of the said Act, do hereby declare that the lands described in the Schedule hereto shall be open for sale or selection on Wednesday, the twenty-ninth day of September, one thousand nine hundred and nine; and also that the lands mentioned in the said Schedule may, at the option of the applicant, be purchased for cash, or be selected for occupation with right of purchase or on renewable lease; and I do hereby also fix the prices at which the said lands shall be sold, occupied, or leased, as mentioned in the said Schedule hereto, and do declare that the said lands shall be sold, occupied, or leased under and subject to the provisions of “The Land Act, 1908.”

Mostly level land, part undulating; covered with fern, scrub, flax, and rushes; soil loam and clay, fair to good in quality, on sandstone formation; well watered by streams. Situated one mile from proposed Towai Railway-station by good formed road.

WHANGAREI COUNTY.—OWHIWA PARISH.

Altitude, 150 ft. to 350 ft. above sea-level. Undulating to very broken country, covered with mixed forest, comprising taraire, birch, tawa, manuka, rata, and a few small rimu-trees, with light undergrowth of keikei and ferns; soil fair to inferior in quality, on sandstone formation; indifferently watered. Situated about five miles from Parua Bay Wharf by formed road and bridle-track.
