Declaring Land to be subject to Part I of “The Native Land Settlement Act, 1907.”

At the Government House, at Wellington, this fifth day of July, 1909.

Present:

His Excellency the Governor in Council.

WHEREAS by section four of “The Native Land Settlement Act, 1907,” it is enacted that, when and as often as the Commission referred to therein has reported to the Governor that any Native land is not required for occupation by the Maori owners, and is available for sale or leasing, it shall be lawful for the Governor by Order in Council to declare that such land shall be subject to Part I of the said Act as from the date of such Order, and the same shall thereupon become, and at all times thereafter remain, subject to the said Part I of the said Act accordingly: And whereas the said Commission has reported that the Native lands specified in the Schedule hereto are not required for occupation by the Maori owners, and are available for sale or leasing:

Now, therefore, in pursuance and exercise of the powers in this behalf vested in him by the aforesaid section four, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby declare that the Native lands specified in the Schedule hereto shall, as from the date of this Order, be subject to Part I of “The Native Land Settlement Act, 1907.”

SCHEDULE.

All that parcel of land, containing by admeasurement 100 acres, more or less, situated in the Waoku Survey District, in the Land District of Auckland, and known as Horotiu B No. 1 Block. Bounded towards the north by Horotiu A No. 1 Block, towards the east by the Ohuri River, towards the south by Horotiu B No. 2 Block, and towards the west by a public road and Horotiu B No. 7 Block.

All that parcel of land, containing by admeasurement 80 acres, more or less, situated in the Waoku Survey District, in the Land District of Auckland, and known as Horotiu B No. 2 Block. Bounded towards the north by Horotiu B No. 7 Block, the crossing of a road, and Horotiu B No. 1 Block; toward the east by the Ohuri River; towards the south by Horotiu B No. 3A Block, the crossing of a road, and again by Horotiu B No. 3A Block; and towards the west by the Kakatahi Creek and unadjudicated Native land.

All that parcel of land, containing by admeasurement 40 acres, more or less, situated in the Waoku Survey District, in the Land District of Auckland, and known at Horotiu B No. 3B Block. Bounded towards the north by Horotiu B No. 3A Block, the crossing of a road, again by Horotiu B No. 3A, the crossing of a road, and again by Horotiu B No. 3A Block; towards the east by the Ohuri River; towards the south by Horotiu B No. 4 Block, the crossing of a road, again by Horotiu B No. 4 Block, the crossing of a road, and again by Horotiu B No. 4 Block; and towards the west by the Kakatahi Stream.

All that parcel of land, containing by admeasurement 40 acres, more or less, situated in the Waoku Survey District, in the Land District of Auckland, and known as Horotiu B No. 3A Block. Bounded towards the north by Horotiu B No. 2 Block, the crossing of a road, and again by Horotiu B No. 2 Block; towards the east by the Ohuri River; towards the south by Horotiu B No. 3B Block, the crossing of a road, again by Horotiu B No. 3B Block, the crossing of a road, and again by Horotiu B No. 3B Block; and towards the west by the Kakatahi Creek.

All that parcel of land, containing by admeasurement 60 acres, more or less, situated in the Waoku Survey District, in the Land District of Auckland, and known as Horotiu B No. 4 Block. Bounded towards the north by Horotiu B No. 3B Block, the crossing of a road; again by Horotiu B No. 3B Block, the crossing of a road, and again by Horotiu B No. 3B Block; towards the east by the Ohuri River and Waima South Blocks; towards the south by Horotiu B No. 5 Block, the crossing of a road, again by Horotiu B No. 5 Block, the crossing of a road, and again by Horotiu B No. 5 Block; and towards the west by the Kakatahi Stream.

All that parcel of land, containing by admeasurement 90 acres, more or less, situated in the Waoku Survey District,

in the Land District of Auckland, and known as Horotiu B No. 5 Block. Bounded towards the north by Horotiu B No. 4 Block, the crossing of a road, again by Horotiu B No. 4 Block, the crossing of a road, and again by Horotiu B No. 4 Block; towards the east by Waima South Block; towards the south by Te Puia Block, the crossing of a road, again by Te Puia Block, the crossing of a road, and again by Te Puia Block; and towards the west by the Kakatahi Stream.

All that parcel of land, containing by admeasurement 55 acres and 36 perches, more or less, situated in the Hokianga Survey District, in the Land District of Auckland, and known as Te Karaka No. 2A Block. Bounded towards the north by the Whanganamu Creek, towards the east by Te Karaka No. 2c Block, towards the south by the Hokianga River, and towards the west by the Waihou Lower Block.

All that parcel of land, containing by admeasurement 113 acres, more or less, situated in the Mangamuka Survey District, in the Land District of Auckland, and known as Motukiore G Block. Bounded towards the north-east by Old Land Claim No. 969 and Motukiore F Block, the crossing of a road, and again by Motukiore F Block, towards the east by Motukiore H Block, towards the south by Parapara Block, and towards the west generally by the Moeatoo Stream and the Hokianga River, and a road reserve.

All that parcel of land, containing by admeasurement 292 acres and 15 perches, more or less, situated in the Mangamuka Survey District, in the Land District of Auckland, and known as Motukiore K Block. Bounded towards the north-east by Motukiore O and Motukiore L Blocks, towards the south-east by Otautu Block, towards the south-west by Waima North Block and a public road, and towards the west by Motukiore M Block.

All that parcel of land, containing by admeasurement 391 acres, more or less, situated in the Maungataniwha Survey District, in the Land District of Auckland, and known as Mangamuka East C Block. Bounded towards the north-east by Mangamuka East Nos. 2 and 1B No. 1 Blocks, towards the south-east by Mangamuka East A Block, towards the south-west by Mangamuka East B Block, and towards the north-west by Mangamuka East D Block.

All that parcel of land, containing by admeasurement 1,640 acres, more or less, situated in the Maungataniwha Survey District, in the Land District of Auckland, and known as Mangamuka East No. 3B Block. Bounded towards the north generally by a forest reserve, Section 1, Block VII, Maungataniwha Survey District; towards the east by Section 1A, Block VII, Maungataniwha Survey District, and Section 1, Block XI, Maungataniwha Survey District, and Mangamuka East No. 1B No. 3 Block; towards the south by Mangamuka East No. 1B No. 3 Block aforesaid; and towards the west by Mangamuka East G Block.

All that parcel of land, containing by admeasurement 151 acres 3 roods, more or less, situated in the Punakitere Survey District, in the Land District of Auckland, and known as Te Ninihi No. 1 Block. Bounded towards the north by Kohatutaka Block, towards the east generally by Maungakawakawa and Te Ninihi No. 2 Blocks, towards the south by Section 1, Block X, Punakitere Survey District, and Kohatutaka Block aforesaid, and towards the west by Kohatutaka Block aforesaid.

All that parcel of land, containing by admeasurement 151 acres 3 roods, more or less, situated in the Punakitere Survey District, in the Land District of Auckland, and known as Te Ninihi No. 2 Block. Bounded towards the east by Maungakawakawa Block, towards the south by Section 1, Block X, Punakitere Survey District, and towards the west and north by Te Ninihi No. 1 Block.

All that parcel of land, containing by admeasurement 100 acres, more or less, situated in the Waoku Survey District, in the Land District of Auckland, and known at Mangawhero I Block. Bounded towards the north by Mangawhero H Block and a road, towards the east by the crossing of a road and Mangawhero E Block, towards the south by Mangawhero J Block, and towards the west by Sections 4 and 5, Block II, Waoku Survey District.

All that parcel of land, containing by admeasurement 100 acres, more or less, situated in the Waoku Survey District, in the Land District of Auckland, and known as Mangawhero J Block. Bounded towards the north by Mangawhero I Block, towards the east by Mangawhero E and F Blocks, towards the south by Mangawhero G Block, and towards the west by Section 4, Block II, Waoku Survey District.

All that parcel of land, containing by admeasurement 65 acres, more or less, situated in the Waoku Survey District, in the Land District of Auckland, and known as Mangawhero K Block. Bounded towards the north-east by Mangawhero L Block, towards the south by a State forest reserve, towards the west generally by Sections 16, 15, 14, and 13 of Block VI, Waoku Survey District, and towards the north-west by Mangawhero G Block.
