Declaring Road in the Portobello Road District to be a
District Road.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-first
day of June, 1909.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN pursuance and in exercise of the powers vested in
him by "The Public Works Act, 1908," and of all
other powers enabling him in that behalf, His
Excellency the Governor of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby order and declare
that the road described in the Schedule hereto shall be,
and after the date of this Order in Council, be a district
road.
SCHEDULE.
All that portion of road in the Portobello Road District, in
the Otago Land District, leading generally in a northerly and
south-easterly direction to sections 66, 68, 70, 72, Block XV,
Burnsy District, and extending in an easterly direction
generally to Block XI, Section 10: Commencing at the
north-eastern boundary of Section 47, being a distance of
54 chains, 40 links, and is more particularly delineated on
the plan marked P.W.D. 24775, deposited in the office of the
Minister of Public Works, at Wellington, and thereon coloured
pink.

Directing Sale of Land under "The Public Works Act, 1908."

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-first
day of June, 1909.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section one hundred and nineteen of "The Public
Works Act, 1908," (hereinafter termed "the said
Act"), it is enacted that if any land, acquired or taken, or
taken, purchased, or acquired at any time under this or
any other Act, is not required for public work, and is not
sold or otherwise disposed of, the Governor may, by Order in
Council, publicly notify that such land will be sold by private
treaty, public auction, or public tender, upon such terms and
conditions set forth in the said Act:
And whereas it has been found expedient, and the Minister
has recommended that the land be sold, and has recommended
directing the sale of the land described in the Schedule
hereto:
And whereas the said land is not now required for the
public work for which it was taken, and it is desirable to
sell the same:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance of the power and
authority conferred upon him by the said Act, and acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby direct the sale of the
said land.

of Wellington, from the Provisions of Section 117 of "The
Public Works Act, 1908."

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-first
day of June, 1909.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by subsection one of section one hundred
and seventeen of "The Public Works Act, 1908" (herein-
after, provided that the said section shall not apply
in any case where the land has been acquired for a street,
road or street by resolution declares that the provisions
thereof shall not apply to any street, road, or street, or
portion thereof, unless and until such resolution is approved
by the Governor in Council:
And whereas by subsection two of section one hundred
and seventeen of "The Public Works Act, 1908," it is pro-
vided that such approval may be given absolutely or subject
to such conditions as the Governor by Order in Council
thinks fit to impose:
And whereas at a meeting of the Wellington City Council on
nineteen hundred and eight, the Council of the City of Wellington,
pursuant to section one hundred and eleven of the Act, and now
known as Princess Street, Wadestown, described in the
Schedule hereto, did by resolution declare that the pro-
visions of the said section one hundred and seventeen
should not apply to the said portion of street:
And whereas it is deemed expedient that such resolution
should be approved:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and in exercise of
the powers conferred on him by the Act, and acting by and
with the advice and consent of the Executive Council of the
Council of the said Dominion, doth hereby approve of the
said resolution.
SCHEDULE.
That portion of street in the City of Wellington, in the
Wellington Land District, known as Princess Street, Wades-
town, to which Sections 47, 48, 49, 50, and 51 have
frontages: Commencing at the south-western boundary of the
delineated on the plan marked P. W.D. 24731, deposited in
the office of the Minister of Public Works, at Wellington, in
the Wellington Land District, and thereon coloured green.

Native Land in the Omagoro Survey District taken for the
purposes of a Road.
PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this seventh
day of June, 1909.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS the land described in the Schedule
hereto is Native land, and is required to be taken
for the purpose of a road; and
And whereas the said land is held or occupied by Native
owners, and is not held by any European; and whereas
And whereas a map of the said land has been prepared in
duplicate, as required by the Public Works Act, 1908,
and approved by Council:
Now therefore, in pursuance and in exercise of the
powers vested in him by "The Public Works Act, 1908,"
and of all other powers in anywise enabling him in this
behalf, His Excellency the Governor of the Dominion
of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby
resolve to take the land for the purpose of a road; and it is hereby
and described in the Schedule hereto, is hereby taken for a
road.
