A PROCLAMATION.

WHEREAS the land mentioned in the Schedule hereto
is, under the Public Works Act, 1905, and "The
Public Works Act, 1908," for a certain work, to wit, for the purposes of a
gravel-pit, required to be taken :

And whereas it is considered by the Governor, acting by and with
the Governor's memorial, accompanied by a may and also
by Minister of Public Works, as being fit and also to be

Now, therefore, I, William Lee, Baron Plunket, the
Governor of the Dominion of New Zealand, in pursuance and
observance of the Powers and Authority and in him to do
"The Public Works Act, 1908," and of all other powers in
General or otherwise to him thereunto enabling do hereby
declare that, from and after the date of the publication
hereof in the New Zealand Gazette, the land described in
the Schedule hereto is hereby taken for the purposes of the
said gravel-pit.

particularly delineated on the plan marked and coloured as
aforesaid, deposited in the office of the Minister of Public
Works, Wellington, in the Wellington Land
District.

Given under the Hand of His Excellency the Right
Honourable William Lee, Baron Plunket, Knight
Commander of the Most Distinguished Order
of Saint Michael and Saint George, Knight
Commander of the Royal Victorian Order, Governor
and Commander-in-Chief in and over
His Majesty's Dominion of New Zealand and its
Dependencies; and issued under the Seal of the
said Dominion at the Government House, at
Wellington, this fifteenth day of June, in the
year of our Lord one thousand nine hundred
and nine.

Amending Part of a Proclamation taking Lands for a
Gravel-pit in Block VI, Whangaehu Survey District, Rangitikei
County.

A PROCLAMATION.

WHEREAS in pursuance of β€œThe Land Act, 1908,”
it is therein provided that "Every Proclamation,
Order in Council, or notice heretofore issued or made under
or in virtue of any Act or Acts thereby repealed, and every
regulation, by-laws, conditions, or rules made by the Governor
or the Governor in Council or by the Court, may be
amended or revoked from time to time :

And whereas by subsection (1) of section (9) of section
three hundred and forty-nine of the said Act that "all
Orders in Council, Proclamations, regulations, and all other
instruments made or in force at the passing of this Act,
orders, and rules or regulations made under such former
Act or Acts and which do not then expire, operate as if this
Act, shall continue and be in force, but may be revoked or
amended by the Governor in Council or by the
Governor or the Governor in Council as the case may be :

And whereas by the "New Zealand Gazette" of the fifth
May, 1909, a Proclamation was issued, dated the fifth
day of August, one thousand nine hundred and six, and
published in the New Zealand Gazette of the twenty-ninth
August, one thousand nine hundred and six, and therein

District Road.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-first
day of June, 1909.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers vested in him
by "The Public Works Act, 1908," and of all other
powers in that behalf enabling him, His Excellency the
Governor of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby order and declare
that the road described in the Schedule hereto shall, on and
after the date of this Order in Council, be a district road.

SCHEDULE.

ALL that portion of road in the Opoe Heads Road District,
in the Hawke's Bay Land District, being part of and adjacent
to the north-eastern boundary of Section 12, Block II,
Pukerimu Survey District, having an area of 1 acre 1 rood,
21 perches, and also that
portions 45, 46, 47, Block II, Portobello Survey District,
having an area of 1 rood, 16 perches: as the same are
more particularly delineated on the plan marked P.W.D.
