(o.) A statement of the time to elapse between the date of the license and the complete installation and construction of all the hydraulic and electrical plant and works specified in the application.
(p.) Any further or other information which the Minister may require.
-
The Minister may require all or any of the aforesaid particulars to be verified on oath, and the application may be refused if, in his opinion, any of the particulars are unsatisfactory, or the quantity of water applied for is excessive, or the proposed use is improper.
-
If the Minister thinks the application should be further considered, he shall forward it to the Warden of the mining district in which the site of the proposed head-works is situate, or if it is not situate in a mining district, then to the Commissioner of Crown Lands of the land district, whereupon the following provisions shall apply:—
(a.) The Warden or Commissioner shall require a minute of the application to be advertised at the cost of the applicant, in such form and in such newspapers as he thinks fit, having regard to the nature and extent of the works, the route proposed for the transmission, and the interests likely to be affected.
(b.) The minute shall call on all persons having any objection to the proposed works to file notice thereof in the office of the Warden or Commissioner, and also to serve a copy thereof on the applicant, within such time before the day of hearing as the Warden or Commissioner prescribes.
(c.) Subject as aforesaid, the provisions of “The Mining Act, 1908,” and the regulations thereunder (including the provisions as to fees and costs) shall apply to the application and the hearing thereof in like manner, mutatis mutandis, as in the case of an application for the grant of a mining privilege, save that no survey shall be required unless the Minister considers it necessary, and also that in lieu of himself granting or refusing the application the Warden or Commissioner shall report thereon to the Minister with such recommendation as the Warden or Commissioner thinks fit.
CONDITIONS OF LICENSE.
- The license when issued shall be in such form and shall contain such conditions and provisions as the Governor in Council thinks fit, including conditions and provisions for the following purposes:—
(a.) A limitation as to time within which the powers conferred by the license shall be exercised, and a limitation as to the time within which the complete plant as specified shall be installed.
(b.) Power of inspection by the Minister and such officers as he appoints for that purpose both during and after construction of all works, so as to insure the provisions of the license being given due effect to, and the law as regards safety of life and property being duly observed.
(c.) Power to the Governor in Council to impose fines or suspend or cancel the license for breach of any of its conditions.
(d.) A statement of the time during which the license is to be current, and whether or not any renewal of the same can be obtained, and on what terms.
(e.) A rent-charge of 6d. per horse-power per month on the total horse-power capable of being developed by the whole of the water authorised to be used under the license, but the minimum rent-charge shall not be less than £2 10s. per month. A horsepower means the theoretical horse-power less 20 per cent. The rent-charge shall be reduced by one-half in every case where the water-power is used solely for generating electricity for mining purposes. The rent-charge shall be computed from the date of the license, and shall be payable during its currency, but the Minister may reduce the charge or waive it altogether, as he thinks fit, for any period not exceeding twelve months from that date.
(f.) A schedule of maximum charges that may be made by the licensee for the sale or supply of electricity, electrical power, or light.
(g.) Power to the Governor in Council to forfeit, without compensation, any water delivered at the head-works or dam in excess of the quantity which the turbines installed are capable of utilising.
- Before the issue of the license the licensee shall deposit with the Public Trustee the sum of £2 10s. for every Government head of water authorised to be used, but not exceeding a maximum deposit of £500. Such deposit shall be retained by the Public Trustee without payment of interest until the licensee produces a certificate under the hand of an officer appointed by the Minister to the effect that the licensee has within two years from the date of the license (or such extended period as the Minister authorises in writing) duly and properly, and to the satisfaction of the Minister, constructed and installed on the premises, in the manner provided by the above-mentioned plans and specifications, the whole of the hydraulic and electrical installations specified or provided for in the application for the license. In the event of such installation not being completed within the time specified the whole of the deposit shall be forfeited to the Crown.
