Removing Restrictions against Alienation of Native Land.

PLUNKET, Governor.

WHEREAS by section fourteen of “The Maori Land Laws Amendment Act, 1903,” it is enacted that, notwithstanding anything to the contrary in any Act, or in any Crown grant or other instrument of title, the Governor may, on the recommendation of the Board, remove any restriction on the alienation of land owned by Maoris: Provided that the decision of the Governor on any recommendation of the Board shall be given within six months from the date of the receipt of such recommendation:

And whereas the Aotea District Maori Land Board, by a recommendation made and passed by the said Board on the sixteenth day of March, one thousand nine hundred and nine, and received on the twenty-second day of March, one thousand nine hundred and nine, recommended the Governor to remove and revoke the restrictions against alienation contained in the instrument of title of the block of land particularised and set out in the Schedule hereto:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred upon and vested in me by the said Act, and of all other powers and authorities thereunto enabling, and in accordance with the recommendation of the Aotea District Maori Land Board aforesaid, do hereby remove and revoke the restrictions now existing against the alienation of the said land, so as to permit the same to be sold.

SCHEDULE.

All those pieces or parcels of land in the Waitara Survey District, together containing 50 acres, more or less, and known as Section 13, Block XI, and Section 62, Block VII, of the said survey district, and comprised in a Crown grant dated the 2nd day of February, 1885, containing the restrictions that the said land shall be “inalienable by sale, or by lease for a longer period than twenty-one years, or by mortgage, except with the consent of the Governor being previously obtained to every such sale, lease, or mortgage.”

As witness the hand of His Excellency the Governor, this tenth day of May, one thousand nine hundred and nine.

Removing Restrictions against Alienation of Native Land

PLUNKET, Governor.

WHEREAS application has been made to the Governor by the owner of the land described in the Schedule hereto, praying that the restrictions on the alienation of the said land may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has recommended that such restrictions be removed:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred upon him by the fifty-second section of “The Native Land Court Act, 1894,” and in accordance with the recommendation of the Native Land Court, doth hereby order and declare that all restrictions now existing against the alienation of the said land are hereby removed.

SCHEDULE.

All that piece or parcel of land, situate in the Harataunga Survey District, containing 147 acres, more or less, known as Waikanae No. 3, and comprised in a Crown grant dated the 1st day of December, 1885, containing the following restrictions: “Inalienable by sale or by mortgage, or by lease for a longer period than twenty-one years, except with the consent of the Governor previously obtained to any such sale, lease, or mortgage.”

As witness the hand of His Excellency the Governor, this tenth day of May, one thousand nine hundred and nine.

Native Lands in Thermal-springs District.—Delegating to Maori Land Board Powers as to leasing.

PLUNKET, Governor.

IN pursuance and exercise of the powers and authorities conferred upon me by section fifteen of “The Maori Land Laws Amendment Act, 1908,” and otherwise howsoever, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, do hereby delegate to the Waiariki District Maori Land Board, in respect of the lands named in the Schedule hereto, the several powers as to leasing of lands conferred upon me by “The Thermal Springs Districts Act, 1908.”
