First Meeting of Hastings Fire Board.

SPECIAL ORDER.—POINT CHEVALIER ROAD BOARD.

By-laws regulating Heavy Traffic on Roads.

IN pursuance and in exercise of the powers conferred by “The Road Boards Act, 1908,” and “The Public Works Act, 1908,” the Point Chevalier Road Board makes the following by-laws, which shall come into force upon their being gazetted:—

  1. The owner of any vehicle engaged in heavy traffic used in carting stone, earth, road-metal, scoria-ash, meat, bricks, timber, minerals, coal, or any thing or things, upon any of the roads within the boundaries of the Point Chevalier Road District shall, before using such vehicle upon any such road, apply to the Point Chevalier Road Board for a license, and shall pay to the said Board the yearly license fee following, that is to say:—

For vehicles having tires of the width of 4½ in. or over … … … … … £ 5

For vehicles having tires of a less width than 4½ in. 10

  1. Provided nevertheless that the Board may in its discretion, and on application by the owner or driver of any vehicle engaged in heavy traffic used in carting such stone, earth, road-metal, scoria-ash, meat, bricks, timber, minerals, coal, or any thing or things, permit the owner or driver of such vehicle to use such vehicle for the purpose of carting stone, earth, road-metal, scoria-ash, meat, bricks, timber, minerals, coal, or any thing or things, upon or over all or any of the roads within the boundaries of the said road district, without having paid such license fee, upon the payment to the said Board of the following charges, by way of compensation for any damage likely to occur to such roads:—

For every load carried on any one day upon or over such road … … … s. d. 1 0

If more than three loads are carried in any one vehicle on any one day upon or over any such roads, then for the day … … … 3 0

  1. Any person who, after coming into operation of this by-law, shall use any vehicle for heavy traffic within the boundaries of the Point Chevalier Road District without having first paid the said license fee for such vehicle, or without having first obtained the permission of the said Board under clause 2 of these by-laws, and paid the charges prescribed thereunder, or who shall do or cause to be done, or be concerned in doing, anything contrary to any provision of these by-laws, or who shall omit to do anything required to be done by him by any such provision, shall be deemed to have committed a breach of these by-laws, and on conviction thereof shall be liable for each offence to a penalty not exceeding £5.

  2. “Heavy traffic” shall mean the transportation of any vehicle, engine, or machine which shall, together with any stone, earth, road-metal, scoria-ash, meat, bricks, minerals, timber, coal, or any thing or things being transported thereon, weigh more than 1½ tons avoirdupois to each pair of wheels.

“Owner” of any vehicle shall include a bailee or hirer entitled to the possession and use or profit thereof.

  1. Any constable or any officer of the Board may stop and detain any vehicle which, in his opinion, infringes any of these by-laws, and inspect, examine, and measure the tires thereof, and the weight and contents of such vehicle; and the driver or person for the time being in charge of such vehicle shall permit such inspection, examination, measurement, and weighing to be made accordingly, and shall, if so
