Special Order made by the Remuera Road Board, County of Eden, making By-laws.

THE following special order, made by the Remuera Road Board, is published in accordance with the provisions of “The Road Boards Act, 1908.”

REMUERA ROAD BOARD.

WHEREAS the Remuera Road District is situated within a County where “The Counties Act, 1908,” is not in operation within the meaning of section 141 of “The Public Works Act, 1905”: And whereas the Remuera Road Board (hereinafter termed “the Board”) is desirous of making the by-laws hereinafter set forth:

Now, the Board, in pursuance of the provisions of “The Road Boards Act, 1908,” “The Public Works Act, 1908,” and of every other power (if any) enabling it in that behalf, doth hereby ordain as follows:—

  1. No person shall drive, lead, or conduct any vehicle along any footpath in the Remuera Road District.

  2. No person shall drive, lead, or conduct any vehicle across any footpath in the Remuera Road District: Provided that nothing in this clause contained shall be construed to prevent any person from driving, leading, or conducting any vehicle across any footpath—

    (a.) At a crossing so constructed that such footpath shall not receive any damage or injury from such vehicle; or

    (b.) At any spot upon wooden planks which shall have been laid down upon such footpath for the full width thereof, and in such manner that the footpath shall not receive any damage or injury from such vehicle.

  3. No person shall connect any drain with a sewer in the Remuera Road District until he shall have left written notice at the office of the Board signed by himself specifying his intention to make such connection, the point at which the connection is to be made, and the route of any such drain, and until he shall have previously deposited with the Board the sum of one pound. The said sum shall be retained by the Board for the period of thirty-one days after the completion of the work of laying such drain and making such connection, and shall be absolutely forfeited to the Board if any footpath, road, channel, kerb, or other property under the control of the Board is not at that time restored in an efficient and workmanlike manner as far as may be to its condition immediately before such work was commenced, and if the same shall be so restored within the said period the said sum shall be returned.

  4. Every person making any drain or connecting any drain with a sewer in the Remuera Road District and disturbing the surface of any road or footpath therein, or disturbing any channel, kerb, or other property therein in the course of such work, shall upon the completion thereof restore in an efficient and workmanlike manner as far as may be such road, footpath, channel, kerb, or other property to its condition immediately before such work was commenced.

  5. These by-laws shall come into force upon their publication in the New Zealand Gazette.

  6. If an person shall commit a breach of these by-laws, such person shall be liable to a fine of an amount in the discretion of the Court inflicting the same, but in no case exceeding ten pounds.

The above by-laws were adopted by resolution and passed at a special meeting of the Remuera Road Board held on the twelfth day of November, one thousand nine hundred and eight, and such resolution was confirmed at a subsequent meeting of the said Board held on the twenty-first day of December, one thousand nine hundred and eight.

The common seal of the Inhabitants of the Remuera Road District was affixed hereto at a meeting and by order of the Remuera Road Board in the presence of—
