Validating the Public Notification of the Intention to raise a Loan of £300 to metal certain Streets, applied for by the Foxton Borough Council.

WHEREAS the Foxton Borough Council lately proposed to raise a loan of three hundred pounds, under “The Local Bodies’ Loans Act, 1908,” for the purpose of forming and metalling Gladstone, Futter, Hetta, Liddell, and Watson Streets, and Ravensworth Place: And whereas the provisions of section eight, subclause (c), of the said Act have not been complied with, inasmuch as the proposed security for the said loan was not stated in the four-weeks public notice of the intention to raise such loan, but such proposed security was duly stated in the subsequent four-weeks notice of intention to strike a special rate, and also on the voting-paper: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the same:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section one hundred and twenty-one of “The Local Bodies’ Loans Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the public notification of intention to raise the said loan, and doth hereby declare that the proceedings relative to such loan shall not be called in question by reason only of the irregularity aforesaid.

“The Public Service Classification and Superannuation Act, 1908.”—Extension of Time for the Employment of certain Temporary Officers in the Department of Labour.

WHEREAS by subsection two of section sixteen of “The Public Service Classification and Superannuation Act, 1908” (hereinafter termed “the said Act”), it is provided that the Governor may by Order in Council, in any case in which he considers that the public interest so far requires, authorise the temporary employment of any person or any class of persons for a longer period than is permitted by subsection one of section sixteen of the said Act:
And whereas, in the opinion of the Governor, it is expedient that, in respect to the hereinafter-mentioned persons employed in the Department of Labour, the period of temporary employment should be extended from six months to two years:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorise the temporary employment of the persons employed in the Department of Labour included in the Schedule hereto for two years in lieu of six months.

Appointing New Trustee and declaring Fresh Trusts in respect of Native Land.

WHEREAS by section forty-seven of the Maori Land Claims Adjustment and Laws Amendment Act, 1907, it is provided that “Whereas by deed dated the fourteenth day of April, eighteen hundred and ninety-nine, made between Wi Pere, Arapera Pere, Hetekia Pere, Moanaroa Pere, Riria Mauaranui, and Riripeti Rangikohera (hereinafter referred to as the beneficiaries) of the one part, and Walter George Foster of the other part, certain real and personal property in the Poverty Bay District was conveyed and transferred to the said Walter George Foster upon certain trusts declared in the said deed: And whereas by deed dated the fifteenth day of August, eighteen hundred and ninety-nine, and made between Mangatu No. 1, a corporation incorporated under ‘The Mangatu No. 1 Empowering Act, 1895,’ of the one part, and the said Walter George Foster of the other part, the said corporation did convey, assure, and set over to the said Walter George Foster a parcel of land in the Poverty Bay District containing twenty thousand acres, more or less, being Subdivision 1 of Mangatu No. 1 Block, upon the trusts declared in the said deed of the fourteenth day of April, eighteen hundred and ninety-nine: And whereas the beneficiaries, or such of them as are now surviving, desire to appoint a new trustee in place of the said Walter George Foster, and to alter the trusts upon which the said property is held, and it is expedient to give effect to such desire: Be it therefore enacted as follows: (a) On the application of the said Wi Pere on behalf of such beneficiaries as are surviving, and of the successors of such of them as are dead, the Governor may by Order in Council remove the said Walter George Foster from his position as trustee under the said deeds and appoint some other fit and proper person as trustee in his place, and may by such Order declare fresh trusts in respect of the residue of the real and personal estate now remaining subject to the trusts of the said deeds”:
And whereas the said Wi Pere, acting on behalf of himself and of the surviving beneficiaries alluded to in the foregoing recital, and also of the successors of such of the original beneficiaries as are now dead, did, on the twenty-first day of December, one thousand nine hundred and eight, by and with the consent of the surviving beneficiaries and of the trustee and guardian of the one successor to an original beneficiary deceased, there being no other successors to any deceased beneficiary save and except the surviving beneficiaries themselves, apply to His Excellency the Governor in Council to remove the said Walter George Foster from his position as trustee under the said deeds, and appoint Henry Cheetham Jackson and Hetekia te Kani Pere, being fit and proper persons, as trustees, instead of the said Walter George Foster and in his place:
Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby, by virtue of the said powers upon me conferred and of all powers me thereunto enabling, remove the said Walter George Foster from his position as trustee under the said deeds, and appoint Henry Cheetham Jackson and Hetekia te Kani Pere, both of Gisborne, being fit and proper persons, as trustees in the place of the said Walter George Foster; and I do, with the consent and approval of the Executive Council, hereby declare the fresh trusts in respect of the residue of the real and personal estate now remaining subject to the trusts of the said deeds, which fresh trusts are contained and set out in deeds respectively dated the twelfth day of April, one thousand nine hundred and seven, and the twenty-first day of December, one thousand nine hundred and eight, which said deeds are as follows:—
“This deed, made this 12th day of April, 1907, between Wi Pere, Arapera Pere, Hetekia te Kani Pere, and Moanaroa Pere, all of Gisborne (hereinafter called ‘the assignors’), of the one part, and Henry Cheetham Jackson, of Gisborne, Agent, of the other part.
“Whereas Walter George Foster, Esquire, of Wellington, has been for a long time trustee for the assignors and Riria Mauaranui, and Rangikohera, now deceased, to whom the assignors or some of them are successors: And whereas the assignors have applied to His Excellency the Governor to remove the said Walter George Foster from his position of trustee and to appoint the said Henry Cheetham Jackson: Now, this deed witnesseth that the assignors do and each of them doth hereby appoint the said Henry Cheetham Jackson their and each of their trustee in lieu of the said Walter George Foster on the following terms and conditions:—
“1. The term for which the said Henry Cheetham Jackson shall hold office of trustee shall be until the mortgages are paid off.
“2. Salary, £250 (two hundred and fifty pounds) per annum, payable quarterly.
“3. Trustee to have no power to sell or lease without consent of the majority of assignors, and such consent shall be in writing, signed before and witnessed by a Judge of the Native Land Court or a Stipendiary Magistrate.
“4. Trustee to provide out of estate or its annual profits £5 per week for each of the assignors, provided that such moneys shall be paid to them personally, and to no other person or persons upon any order or authority whatsoever. Such allowance and provision shall not be anticipated or
