Exempting Buller and Molesworth Streets, New Plymouth, from the Provisions of Section 117 of “The Public Works Act, 1908.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this nineteenth day of December, 1908.

Present:

THE HONOURABLE JAMES CARROLL PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1908,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by subsection two of section one hundred and seventeen of “The Public Works Act, 1908,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:

And whereas on the twenty-sixth day of October, one thousand nine hundred and eight, the Council of the Borough of New Plymouth, the local authority having control of the streets known as Buller and Molesworth Streets, described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said streets:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.

THAT street in the Borough of New Plymouth, in the Taranaki Land District, known as Buller Street, commencing at its junction with Woolcombe Terrace, and running in an easterly direction to the eastern boundary of Section 1959, being a distance of 39½ chains, more or less; also that street in the said borough and land district known as Molesworth Street, commencing at its junction with Kawau Street, and running in an easterly direction to the eastern boundary of Section 1981, being a distance of 59 chains, more or less: as the said streets are more particularly delineated on the plan marked R. 10458, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1908,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

The Helensville Agricultural and Pastoral Association incorporated.—Notice No. 1264.

At the Government Buildings, at Wellington, this nineteenth day of December, 1908.

Present:

THE HONOURABLE JAMES CARROLL PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by “The Agricultural and Pastoral Societies Act, 1908,” His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby incorporate the members of the Helensville Agricultural and Pastoral Association, and such persons as shall hereafter be admitted members of the said association agreeably to the rules of the said association and the provisions of the said Act, into a body corporate under the style and title of “The Helensville Agricultural and Pastoral Association.”

Revoking Condition of Lease of Lands in Horowhenua East Village Settlement.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this nineteenth day of December, 1908.

Present:

THE HONOURABLE JAMES CARROLL PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon me by the fifth section of “The Land Act, 1908,” I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, do hereby revoke a certain Order in Council dated the third day of April, one thousand nine hundred and two, fixing terms and conditions of lease of village-homestead allotments in Horowhenua East Village Settlement, Wellington Land District, in so far as it affects the regulation that no married woman shall be eligible as a selector in the said village settlement.
