And whereas it has been alleged that the said orders were made through an error, mistake, or omission within the meaning of section thirty-nine of “The Native Land Court Act, 1894”:

And whereas an application has been made to His Excellency the Governor in Council to consent to the making of an application to the Chief Judge of the Native Land Court, in pursuance of the provisions of section thirty-nine of “The Native Land Court Act, 1894,” to amend the said orders for the purpose of rectifying the said alleged error, mistake, or omission:

And whereas the Governor in Council, after due inquiry made, is satisfied that a prima facie case has been established, and that it would be inexpedient to dispose of it by remedial legislation, or by any other procedure which would obviate legislation:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance of all powers and authorities in that behalf vested in him by “The Land Titles Protection Act, 1908,” or otherwise howsoever, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the making of an application to the Chief Judge of the Native Land Court, in pursuance of the provisions of the said section thirty-nine of “The Native Land Court Act, 1894,” for the purpose of rectifying the said alleged error, mistake, or omission, and that the said orders of the said Court, and any subsequent orders or instruments of title issued pursuant thereto, may be subject to an order of the Chief Judge under the said section thirty-nine of “The Native Land Court Act, 1894.”

Domain Board appointed to have Control of the Kurow Domain.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of March, 1909.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by section forty of “The Public Reserves and Domains Act, 1908” (hereinafter termed “the said Act”), it is enacted that the Governor may from time to time, with respect to any public domain, appoint such persons (not exceeding nine) as he thinks fit to be a Domain Board having, subject to the said Act, control of such domain:

And whereas by an Order in Council made on the seventeenth day of December, one thousand nine hundred and eight, and published in the New Zealand Gazette of the twenty-third day of December, one thousand nine hundred and eight, the land described in the Schedule hereto was brought under the operation of and declared to be subject to the provisions of Part II of the said Act:

And whereas it appears expedient to appoint a Domain Board to control the said domain:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

DAVID MCCULLOUGH, and
WILLIAM FRANCIS CONDON

to be the Kurow Domain Board, having the control of the land described in the said Schedule hereto for the purposes of and subject to the provisions of the said Act; and doth hereby appoint Thursday, the sixth day of May, one thousand nine hundred and nine, at seven o’clock p.m., as the time when, and Munro’s Hall, Kurow, as the place where, the first meeting of the Board shall be held.


SCHEDULE.

KUROW DOMAIN.

All that area in the Otago Land District, containing by admeasurement 12 acres 1 rood 18·8 perches, more or less, being Allotment No. 2A of subdivision of parts of Sections Nos. 5 and 14, Block I, and 10 and 11, Block IV, Kurow Survey District, Waitaki County. Bounded towards the north by Allotment No. 1A of said subdivision; towards the east by a road-line; towards the south by Allotment No. 3A of said subdivision; and towards the west by part of Section No. 16, Block IV, Kurow Survey District: as the same is delineated on the plan marked L. 1125/1, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Fixing Pilotage for Picton.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of March, 1909.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by the two hundred and seventh section of “The Harbours Act, 1908” (hereinafter termed “the said Act”), it is, among other things, enacted that every Harbour Board shall have power from time to time, by by-laws, to do the following things for and within the limits of the harbour under the control of such Harbour Board—namely, to fix pilotage rates, to determine the nature of the services for which pilotage rates shall be payable for and within the limits of the harbour under the control of such Harbour Board, and to fix and authorise the levying of Harbourmaster’s fees:

And whereas by the ninth section of the said Act is it enacted that in harbours where there is no Harbour Board the Governor in Council shall have all the powers, functions, duties, and authorities by that Act conferred upon Harbour Boards, and may exercise the same in accordance with the said Act:

And whereas there is no Harbour Board for the Harbour of Picton, and it appears expedient to make a by-law for the purpose hereinafter set forth:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, in pursuance and exercise of the powers and authorities vested in him by the said Act, doth hereby make the following by-law in respect of the Harbour of Picton, and doth hereby order that such by-law shall come into force on the first day of April, one thousand nine hundred and nine:—

BY-LAW.

The pilotage rates and Harbourmaster’s fees set forth in the Schedule hereto are hereby fixed and authorised to be levied and taken at the harbour in the said Schedule mentioned.


SCHEDULE.

PICTON HARBOUR.

Pilotage Rates.

STEAMERS, inward, 1d. per ton register; outward, ½d. per ton register. Sailing-vessels, inward, 2d. per ton register; outward, 1d. per ton register.

The rates are payable when the services of a pilot are taken.

Harbourmaster’s Fees.

For removing vessels from one place to another within the harbour when a pilot is not taken: Steamers, ½d. per ton register; sailing-vessels, 1d. per ton register.

Vesting Gravel Reserves in the Selwyn County Council.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of March, 1909.

Present:

WHEREAS the lands described in the Schedule hereto have been duly set apart for gravel-pits:

And whereas, in the opinion of the Governor, it is expedient to vest the said reserves in the Selwyn County Council;
