Constituting the Town District of Warkworth, in the County of Rodney.

PLUNKET, Governor

A PROCLAMATION.

WHEREAS it is enacted by “The Town Boards Act, 1908,” that the Governor may declare that any area wherein there are not less than fifty householders shall be a town district: And whereas a petition has been presented to the Governor by the inhabitants within the area mentioned and described in the Schedule hereto, praying that such area may be constituted a town district under “The Town Boards Act, 1908”:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in me by “The Town Boards Act, 1908,” and of all other powers enabling me in this behalf, do hereby proclaim and declare that the said area shall be a town district, and the same is hereby constituted a town district under “The Town Boards Act, 1908,” by the name of the Warkworth Town District. And, in further pursuance and exercise of the said powers, I do hereby proclaim, declare, and appoint that the Board of Commissioners for the said district shall consist of five members.

SCHEDULE.

WARKWORTH TOWN DISTRICT.

ALL that area in the Auckland Land District bounded towards the north-west by the north-western boundaries of Sections Nos. 48, 49, 50, and 51, Mahurangi Parish, from the northernmost corner of Section No. 48 to the westernmost corner of Section No. 51; thence towards the south-west by Section No. 52 to the Mahurangi River; thence across that river and by Sections Nos. 63 and 64; towards the south-east by parts of Sections Nos. 65, 66, and 71 to the Mahurangi River; thence towards the north-east generally by the Mahurangi River to the head of navigation at the falls; thence across that river and along its northern bank to the south-western corner of Section No. 47, Mahurangi Parish; and thence by that section to the place of commencement: as the same is delineated on the plan marked 1908/948, deposited in the office of the Department of Internal Affairs, at Wellington, and thereon bordered red.

Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House, at Wellington, this twelfth day of February, in the year of our Lord one thousand nine hundred and nine.

Allocating Land reserved and taken for a Railway to the Purposes of a Road at Frankton, in the County of Waipa.

A PROCLAMATION.

WHEREAS the land mentioned in the Schedule hereto forms part of land taken for the purposes of the Kaipara-Waikato Railway, and it is considered desirable to allocate such land to the purposes of a road:

And whereas it has been certified by the Minister of Railways that such land is not required for railway purposes: And whereas such land is situated in the County of Waipa, the local authority of which has assented to the issue of this Proclamation:

And whereas His Excellency the Governor is of opinion that the said local authority can conveniently construct and maintain the said road:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in exercise and pursuance of the powers and authorities vested in me by section one hundred and ninety-seven of “The Public Works Act, 1908,” and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and

ERRATUM.—In the Schedule to the Order in Council dated 20th January, 1909, and published in New Zealand Gazette No. 9, page 346, declaring part of Okaka Road, Rangitikei County, a county road, for “1 mile 37 chains” read “1 mile 3·75 chains.”
