[No. 108

  1. Form of license. —(1) Every licensee of a vehicle shall
    contain the number of the license, and the number of the
    vehicle, and the number of packages which may be carried, or
    passengers that may be carried therein, and the date of the
    license, and the amount received for the same, and the name
    and the amount of the fee paid, and shall be signed by the Resident
    Officer.

(2) Every driver's and conductor's license shall contain
the number and the date thereof, the period covered thereby,
and the amount of the fee paid for the same, and shall be signed
by the Resident Officer.

(3) Registers of licenses shall be kept by the Resident Officer
of all licensed vehicles and licensed drivers and conductors,
and such registers shall be open to the free inspection of the
public at all reasonable times. Information as to licenses may
also be evidence unless and until the contrary is proved that
any vehicle or driver or conductor not appearing on such
register to be licensed, and every vehicle, driver, or conductor
found on such register, thereby to have been cancelled or to
be suspended, is not licensed.

PART IV.—STREETS AND PUBLIC PLACES.

  1. Injuries to Streets.—Every person who, not being au
    thorised by the Department or by-law, any—

(1) Encumbering by a stand or erecting or obstructing any
building, fence, ditch, or any other article or
material in a street or other public place, or to
plant any tree or shrub thereon.

(2) Places or causes to be placed any timber, earth, stones,
or other things.

(3) Dig up, remove, or alters in any way the soil, or
any part or materials thereof.

(4) Allows any water, tailings, or sludge, or any filthy
or offensive matter, to flow from any building or
land in his occupation on to a street.

(5) Causes or permits any timber or other heavy material,
or any machinery, either with or without any
wheels, to be dragged on a street.

(6) Causes or allows any coping, any retaining-wall,
foundation-wall, or fence erected on any land, or
any portion of same, to project on any street or
occasion, unless he can show to have any or fail
or to injure or obstruct an ofTence.

(7) Injures or destroys any tree, or shrub, or any other
soever by which any injury is done to any street
or any part of same, or any of the materials of
shall be liable to a penalty not exceeding £10 for every day
such obstruction, injury, or destruction continues to operate;
and the offender may be equally liable for the cost of the De
partment in removing any such encroachment, obstruction,
or injury, or in replacing any of the same as provided.
Provided that no penalty shall be imposed unless the infor
mation is lodged within one calender month by the Department
or some officer thereof.

  1. Obstructing Public Ways. —No person shall leave any hole,
    excavation, or dangerous obstruction of in any way in any
    or private street, or public place without fencing or enclosing
    the same, or without keeping a sufficient light Burning or open
    near the same from sunset to sunrise.

  2. Obstructing ways with goods —No person shall make any cellar-door
    or other opening from the footway of any public or private
    street, or public place without the consent of and and the
    in accordance with the Department in the dimensions.

  3. Entrances, &c., to Areas, &c. —The occupier of every
    building or land with areas, gratings, &c., opening on to any
    public or private street, or public place, shall keep in good
    repair and safe order, fences or enclosures of which the areas
    and shall not keep open for more than a reasonable time for
    loading to, or for any other purpose whatever, in accordance with
    certain cases and rules.

  4. Placing Obstructions on Streets. —No person shall place
    or leave, or cause to be placed or left on any street or public
    ing-materials, goods, or other things upon any public or
    private street or public place, without the consent of the the
    Department.

  5. Obstacles in Streets. —No person shall dig up or remove
    the soil of, or any paving material or roadway of any public
    private street, or public place, without permission from the
    Department ; and shall also, when any such work is allowed
    to the cases of any work lawfully executed on any private
    street or public place, or drain or channel without the same.

  6. Obstructing Drains. —No person shall obstruct or damage
    any culvert, drain, or drain-head built or in any way by or
    the local Department.

  7. Drippings not to fall on Footways. —The owner of every
    house or other building shall provide such appliances, either
    by providing gutterpipes, pipes, and drains, or otherwise,
    as effectually to prevent drippings, &c., from or upon any
    house, building, or verandah from falling upon any footway.

  8. Exposing Inflammable Matter. —No person shall leave any
    inflammable materials or matter in any building in any private
    or in any public street, or public place without permission
    from the Resident Officer.

  9. Projecting or other blinds. —No person shall roll out
    cases, or any carpet, fly any kite, use any bow and arrows,
    or play at any game in any private street, or public street,
    public or private street or place.

  10. Gates, &c., across Public Streets. —No person shall un
    necessarily place or permit to remain any vehicle or animal
    across any public or private street, or footway or public
    place, or any passage or gateway.

  11. Against discharging missiles. —No person shall throw
    or discharge any stone or other missile in any private or
    danger of any person or property being in any public or
    private street, or public place.

  12. Firearms and Fireworks. —(1) No person shall carry
    any loaded firearms or any other dangerous weapon in any
    public or private street or public place nor shall any person
    discharge any firearms within the same without having to fire
    any of the to discharge any firearms within the same without
    by-law shall not apply to any person in His Majesty's military
    or naval service, or to any constable, or to any special police
    man, or Volunteer on duty.

(2) No person shall set off any fireworks or explosive
material in or on any public or private street or public place,
so as to be to disturb or endanger any of His Majesty's
subjects.

  1. Against advertising on Public Buildings or in Public
    Places.
    —No person shall place, paint, affix, or in any way
    exhibit, or display any placard, bill, inscription, advertise
    ment, or notice—

(1) Upon or over any public building, public structure,
or public place.

(2) Upon or over any telegraph or telephone pole,
railway post, or lamppost, or in addition to any
other or upon any other or public place.

(3) On any public or private street, or footway, or public
place.

(4) Upon or over any privately owned house, building,
wall, fence, gate, or other structure or anything
in any private or public street or public place,
unless with the consent of the occupier of such
place ; or in the cases of any work lawfully
the premises on which such wall, fence, gate, or
other thing be, unless such consent will contravene
regard to Part XII of these by-laws, be lawfully
built.

  1. Exposing Articles. —No person shall expose for sale any
    article whatsoever on any footway.

  2. Obstructing Water. —No person shall prevent or ob
    struct or private street or public place any hope or other
    water-way from being used.

  3. Bathing. —No person shall bathe near to or within
    view of any public or private street or public place without
    being properly covered and exposed to the public.

  4. Depasturing Animals on Streets. —(1) No person shall
    depasture and or cause to be depastured any horse or any
    other cattle, for the purpose of depasturing or grazing the
    same, or in any way cause, suffer, or be an annoyance to
    any public place.

(2) No person shall allow any such animal as aforesaid
without being provided for purpose of depasturing or graze
or without proper guidance, or to wander in any public or
private street or public place.

  1. Leaving Vehicles unattended. —No driver of any vehicle
    without leaving the not be allowed to leave such vehicle in
    any public or private street or public place, or shall go for
    any time, or cause such vehicle or animal attached thereto,
    being in any such public or private street, or public place,
    without passing through the near wheel or wheels thereof
    and cause to be so as to be so as to effectually prevent the
    rotation of such wheel or wheels.

  2. Animals showing or testing horses in Streets. —It
    shall not be lawful to break in any horse or other animal
    in any street, or public place, or test the or by driving
    about any street, unless application to be made and license
    be appointed and advertised by the Department in that

    cart or other vehicle, or otherwise, to test or try any horse
    or other animal, or in any manner to injure any public or
    private street or public place.

  3. Injury to Street. —No person having the charge of any
    horse, mare, or other animal shall allow such to be or to
    within view of a public or private street, public place, or of
    any dwelling or of adjacent to a public or private street, or
    public place.

  4. Blasting. —No person shall blast any rock, stone, or
    timber in or near any public or private street or public place
