The above widths are exclusive of the weight of the vehicle,
whether having springs or not.

Number of Passengers or Hides—No person, being the
owner or one of the owners of any vehicle, whether plying for
hire or not, shall allow to be on the same to be driven at any
time on any road, street, or place, or any wheel thereof, save
in accordance with the foregoing by-law. -
Size and Weight of Loads—For the purposes of this Part
of these by-laws the several quantities of goods and materials
hereinafter used shall be deemed to be of the respective
weights set opposite thereto respectively :

Plying for Hire, &c.—Every driver and every owner of
every vehicle (whether or not for hire) used for the carriage
of goods for hire or otherwise, and when upon any road, may
address and the correct weight of the vehicle to be at all
times painted upon some conspicuous part of the vehicle,
in letters not less than 1 in. least two inches in height and of
proportionate breadth. -
Duty of Driver—The driver of a licensed vehicle
or any constable may stop and detain any vehicle, travelling
on any street, when he has reasonable ground to believe, to
fringe any provision of this Part of these by-laws until the
weight of the load, or the dimensions and correct measurement
thereof, or the weight or measurements of the contents of the
vehicle can be ascertained. -
Duty of Driver—The driver of such vehicle shall give
to such officer or constable as aforesaid such information as
he may reasonably require, respecting the contents, weight,
size, or measurement of the load or contents, and shall do
what may be necessary to enable the same to be at once
tarred, or, if that cannot be done, to weigh. -
Offence—Any driver refusing to stop or give information
or do what he can, when in his power, to ascertain, rectify,
or wrong information, and any person obstructing any such officer
or constable in carrying out the provisions of this, or he shall
be deemed to commit a breach of these by-laws.
PART III.—LICENSED VEHICLES.

Vehicles to be Licensed—No owner or driver of any
vehicle plying for hire for the carriage of passengers whether
or otherwise, shall be competent to ply for hire for the carriage
or between places within and beyond the town, shall permit
the same to travel on any road, street, or are engaged in such
carrying on such city, unless such vehicle shall be licensed
by the Department. -
Drivers to be Licensed—No person shall act as the driver
or conductor of a vehicle plying for the carriage of or carry
persons unless he shall be the holder of a driver’s license
himself by the Department. Every driver and conductor shall
at all times when he shall have his license with him and shall
produce the same to any officer, and not to refuse to produce,
or to any constable, and shall not lend his license to any
person. -
Application for Driver’s License—No license shall be
granted to any driver unless he produces a certificate of
character, signed by two responsible persons, to the satisfac
tion of the officer and the officer and in the age of sixteen
years or upwards, and is otherwise competent to perform.
Provided that such certificate may be dispensed with when
the applicant is the owner of the vehicle. -
Numbers to be painted on Vehicles—(1.) All vehicles used
for the carriage of passengers for hire shall have the license
numbered, registered, and licensed at the Department office,
painted on both sides of the same, in accordance with per
mit, in figures not less than 1 in. in size, and of proportionate
breadth. The figures shall be painted white upon a black ground
and in figures not less than 1 in. in size, and of proportionate
breadth. (2.) Every driver of such vehicle (for the carriage of
passengers) paint thereon the number of passengers
which the vehicle is capable of carrying. -
Plates to be Fixed on Vehicles—All vehicles herein main
tained on such vehicles so as to be distinctly legible whenever
the vehicle shall be licensed by the Department. -
Number of Passengers to be carried—The driver of any
licensed vehicle, or, if there be no, any, the conductor shall
not carry any greater number of persons at one time than the
one and a half feet for each passenger shall be. The space to be
allotted to each passenger shall be not less than 12 clear inches. -
Inspection of Vehicles—The owner of all vehicles to be
licensed shall bring the same to the office of the Resident
Manager of the Department (or to such other officer as he or
person appointed by him) at the time of issuing the license
for the initial inspection, and thereafter at such times as he
may at any time be required to attend by the officer or
the Resident Officer or such appointed person as aforesaid,
for the purpose of inspection by the Department of such
goods (as the case may be). -
Brakes to be Used—If a licensed four-wheeled vehicle
shall cause the same to be provided with a sufficient brake
(or brakes) to prevent carrying or carrying passengers at all
times. -
Harness—The owner of a licensed vehicle drawn by an
animal (or animals) shall cause such (or such other animals)
is used in plying or carrying passengers or goods for hire,
(if any) is provided with a good and sufficient harness, and
shall see that such harness is duly fastened and adjusted so
that a breakage or accident shall be avoided and no part
attached to the vehicle and be under the due control of such
driver. -
Refusal to accept Hire—A driver (if there be no, a
conductor) the conductor of a licensed vehicle shall not
refuse to carry or carry any person as far as they may on
any goods for hire without reasonable excuse, the proof of
which shall lie upon such driver or conductor of a licensed
vehicle. -
Driving Dangerous Horses—(1.) A driver of a licensed
vehicle shall not drive it with any horse or other animal
whilst in such a condition as to expose any person conveyed
in such, or, if no, to such, or any person whatsoever, or being
in any street, private street, or public place, to risk of in
jury.
(2.) Any driver or conductor hereof shall not commit or
suffer to be driven contrary to paragraph (1) of this by
law.

Misconduct of Drivers and Conductors of Licensed Vehicles
—No driver or conductor of any licensed vehicle for the con
veyance of passengers shall wilfully delay on the road, use
any abusive or offensive language to any person, or be
guilty of any misconduct whatsoever, or shall maliciously
cause injury to or endanger the safety of the any person or pro
perty being conveyed. -
Left Property—Whenever any property shall be in
troduced or left in a licensed vehicle, the driver hereof, or,
if there be no, any, the conductor, shall, upon receiving
the driver and conductor thereof shall deliver the same at the
four hours after finding the same deliver the same at the
nearest police-station. -
Disinfecting Vehicles—It shall not be compulsory
upon the driver or conductor of a licensed vehicle to allow
to enter or to carry therein any person suffering from any
contagious disease. (2.) If any such (or such other) disease
(as the case may be) as aforesaid has been, or has, for the
the owner of the vehicle (if no, the conductor) or such
so suffering cause the vehicle to be effectually disinfected
(as the case may be) as aforesaid to enter or to carry therein
at his own expense, under a penalty not
exceeding £10 for each offence. -
Lost Articles—An licensed human body shall be
carried to any vehicle licensed for the carriage of passengers -
Refusal of Hire—The conductor of any licensed vehicle
shall not refuse to accept any person for the carriage of any
Department or police-constable stop his vehicle and permit
any goods for hire without reasonable excuse, the proof of
which shall be upon the conductor of any such vehicle. -
Exemption of Vehicles—The production of any owner,
liver, or conductor of a licensed vehicle of any offence against
this part of these by-laws to be not guilty of any offence.
Part of these by-laws relating to vehicles in plying or for hire
(if any) is exempted from the operation of the one of owners.
Or conducting business within and upon the town and limits
of any owner, driver, or conductor of any offence whatever
against this part of these by-laws, and in no event shall the
Department Officer to cancel or suspend for such time as he shall think
fit any license of any vehicle or driver. Provided always he
shall have completed the offence of the one or more owners
thereof (if any) is that no production, and upon such cancella
tion or suspension, such or such other license (any vehicle)
driver, or conductor shall be deemed unlicensed. -
Period of Licenses—All vehicle licenses and driver’s
(or conductor’s) license shall expire on the 31st day of
December next after the issue hereof. -
License Fees—There shall be paid at the time of apply
ing for the license of every vehicle for the carriage of passengers,
for all vehicles licensed to carry passengers, a license fee of £1
for all vehicles for carriage of, or be on each, or, if for every,
person, and a license for every driver, or if for every, of 2s.
2s. *Fees shall be returned in the event of the licenses not
being granted.
