Altering the Middle-line of a Portion of the Helensville Northwards Railway.

A PROCLAMATION.

WHEREAS under the provisions in that behalf of sec-
tion one hundred and eighty-eight of “The Public
Works Act, 1908,” the middle-line of further portions of the
Helensville Northwards Railway was defined by Proclama-
tions dated the twentieth and twenty-second days of May
and September, one thousand nine hundred and eight, and
published respectively in the New Zealand Gazette of the
twenty-eighth and twenty-fourth days of May and Septem-
ber, one thousand nine hundred and eight: And whereas
it has been found necessary in the construction of such
railway to alter such line in manner hereinafter appearing:

Now, therefore, I, William Lee, Baron Plunket, the Go-
vernor of the Dominion of New Zealand, in pursuance and in
exercise of the powers conferred upon me by the aforesaid
section one hundred and eighty-eight, and of all other
powers and authorities enabling me in this behalf, do hereby
revoke so much of the Schedules to the said Proclamations
as defines the middle-line of the said portions of railway
beyond the point marked 77 miles 30 chains on the plan
numbered P.W.D. 23524 referred to herein; and in lieu
thereof do hereby proclaim and declare that the middle-
line of the part of the said portions of railway commencing
from the said point marked 77 miles 30 chains aforesaid
shall be as defined and set forth in the Schedule hereto.


SCHEDULE.

COMMENCING at a point marked 77 miles 30 chains in Native
land, Block VII, Otamatea Survey District, which point
is about 44¾ chains due south of northern boundary and
about 94½ chains due west of the eastern boundary of said
Block VII, Otamatea Survey District, being a point of the
railway as described in a Proclamation dated the 20th
day of May, 1908, and published in the New Zealand Gazette
No. 42, of the 28th day of May, 1908; proceeding thence
generally in a north-westerly direction for a distance of
4 miles 10 chains, and passing in, into, through, or over
the following lands—viz., Nukuroa Block, Native land,
Block VII, Otamatea Survey District; Native land, Nuku-
roa Block; Sections 51, 52, 53, 48, 146, 147, 145, and 144,
Block III, Otamatea Survey District; Sections 144 and 143,
and Pukearenga Block No. 3630, Block II, Otamatea
Survey District—and terminating in the said Pukearenga
Block No. 3630, at a point marked 81 miles 40
chains, which is about 45½ chains due south of the
northern boundary and about 22 chains due west of the
eastern boundary of Block II, Otamatea Survey District:
including all adjoining and intervening places, lands, reserves,
roads, tracks, rivers, streams, and watercourses: all in the
Land District of Auckland: as the same is delineated on the
plan marked P.W.D. 25354, deposited in the office of the
Minister of Public Works, at Wellington, in the Provincial
District of Wellington.

Licensing the Kauri Timber Company (Limited) to use and occupy a Part of the Foreshore of Mangonui Harbour as a Site for a Wharf.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-second
day of November, 1909.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by Order in Council dated the fourteenth
day of December, one thousand eight hundred
and ninety-five, and published in the New Zealand Gazette
No. 93, of the twentieth day of the same month, the
Kauri Timber Company (Limited), (hereinafter called “the
company”), was licensed to occupy a part of the fore-
shore and land below low-water mark of Mangonui
Harbour for the purpose of using and maintaining
thereon a wharf, erected in accordance with plan marked
M.D. 580, and deposited in the office of the Marine
Department at Wellington, for a period of fourteen
years from the first day of December, one thousand
eight hundred and ninety-five:

And whereas the company has made application for a
fresh license under “The Harbours Act, 1908” (herein-
after called “the said Act”), for a term of seven years,
computed from the expiry of the term of the said first-
mentioned license, and it is expedient to grant the same
for the term and subject to the conditions hereinafter
expressed:

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of
the power and authority vested in him by the said Act,
and of all other powers and authorities enabling him in
that behalf, and by and with the advice and consent
of the Executive Council of the said Dominion, doth
hereby approve of the purpose or object for which the
said license is required by the company as aforesaid;
and, in further pursuance and exercise of the said power
and authority, and with the like advice and consent as
aforesaid, doth hereby license and permit the company to
use and occupy, as from the fourteenth day of December,
one thousand nine hundred and nine, that part of the
foreshore and of the land below low-water mark imme-
diately contiguous thereto which is particularly shown
and delineated on the plan so deposited as aforesaid, for
the purpose of using the aforesaid wharf in connection
therewith, such license to be held and enjoyed by the
company upon and subject to the following terms and
conditions, that is to say:—

  1. The concessions and privileges conferred by this
    Order in Council shall extend and apply only to the
    parts of the foreshore and the land below low-water
    mark necessary for such wharf as shown on the plan
    marked M.D. 580, and deposited in the office of the
    Marine Department as aforesaid.

  2. In consideration of the concessions and privileges
    granted by this Order in Council, the company shall, on
    being supplied with a copy thereof, pay to the Minister
    the sum of two pounds ten shillings, and thereafter an
    annual sum of two pounds in advance, payable on the
    1st day of December, dating from the 1st day of De-
    cember, 1909, the first of such annual payments to be
    made on the company being supplied with a copy of this
    Order in Council.

  3. All persons shall at all reasonable times, upon pay-
    ment of the proper dues, have free and full liberty to use
    the wharf, and all rights of ingress and egress thereon
    and therefrom.

  4. His Majesty or the Governor, and all officers in the
    Government service acting in the execution of their duty,
    shall at all times have free ingress, passage, and egress
    into, through, and out of the wharf without payment.

  5. The company shall maintain the above-mentioned
    wharf in good order and repair, and shall at all times
    exhibit therefrom, and maintain at its own cost, suit-
    able and necessary lights for the guidance of vessels:
    Provided that no light shall be exhibited until after it
    has been approved of by the Minister.

  6. Any person authorised by the Minister may at all
    reasonable times enter upon the said wharf and view the
    state of repair thereof; and upon such Minister leaving
    at or posting to the last known address of the company
    a notice in writing of any defect or want of repair in
    such wharf, requiring it, within a reasonable time, to be
    therein prescribed, to repair the same, it shall with all
    convenient speed cause such defect to be removed or such
    repairs to be made.

  7. Nothing herein contained shall authorise the com-
    pany to do or cause to be done anything repugnant to or
    inconsistent with any law relating to the Customs, or
    any regulations of the Minister of Customs, or with
    any provisions of “The Harbours Act, 1908,” or its
