Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section four of “The Native Land Laws Amendment Act, 1895,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby except the interest of the said Karepa Kautuku in the said land from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of mortgage.

SCHEDULE.

ALL that piece or parcel of land, situate in the Whangara Survey District, containing 901 acres, more or less, known as Waiomoko No. 2, and comprised in a partition order of the Native Land Court bearing date the 24th day of July, 1894, in favour of Karepa Kautuku and others.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twentieth day of November, 1908.

Present :

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bonâ fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette.

And whereas the Aotea District Maori Land Board, by a recommendation made on the thirtieth day of September, one thousand nine hundred and eight, and received on the eighth day of October, one thousand nine hundred and eight, has recommended the Governor to except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of sale, the block or parcel of land particularised and set out in the Schedule hereto :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section four of “The Native Land Laws Amendment Act, 1895,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby except the said land from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of sale.

ALL that piece or parcel of land, situate in the Mount Robinson Survey District, containing 11 acres, more or less, known as Waitarere 6A, and comprised in a partition order of the Native Land Court bearing date the 27th day of November, 1905, in favour of Iwikatea Keremeneta and others.

Withdrawing Land from the Operation of “The Kauri-gum Industry Act, 1908.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twentieth day of November, 1908.

Present :

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section thirty-three of “The Kauri-gum Industry Act, 1908” (hereinafter termed “the said Act”), it is enacted that the Governor may by Order in Council declare that land set apart under the said Act as a kauri-gum reserve, and which is no longer required for the purpose of gum-digging, shall be no longer subject to the said Act, and thereupon the land shall cease to be a kauri-gum reserve, and shall be dealt with by the Land Board as ordinary Crown land; provided that such Order in Council shall only be issued in pursuance of a resolution of the Land Board, supported by such independent evidence as the Governor in Council deems necessary :

And whereas the Land Board of the Auckland Land District has duly passed a resolution recommending that the portion of Hakaru No. 1 Kauri-gum Reserve described in the Schedule hereto be excepted from the operation of the said Act, and it is expedient to give effect to such recommendation:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section thirty-three of the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of Hakaru No. 1 Kauri-gum Reserve described in the Schedule hereto shall be no longer subject to the provisions of the said Act.

SCHEDULE.

ALL that area in the Auckland Land District, containing by admeasurement 120 acres 2 roods 36 perches, more or less, being Section No. 149A of the Parish of Kaiwaka, Otamatea County, and forming part of the Hakaru No. 1 Kauri-gum Reserve, set apart by Order in Council dated the 21st day of August, 1899, and published in New Zealand Gazette No. 71, of the 24th day of August, 1899, page 1555. Bounded towards the north by a public road; towards the east by a public road and Section No. 150A of the Parish of Kaiwaka; towards the south-west by the northern portion of Section No. 11 of the aforesaid parish; and towards the north-west by a public road: as the same is delineated on the plan marked L. 5219/1, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twentieth day of November, 1908.

Present :

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the power and authority conferred by “The Public Reserves and Domains Act, 1908,” His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke an Order in Council, dated the twenty-ninth day of September, one thousand nine hundred and two, delegating powers to the Dorie Domain Board, and doth hereby appoint

THE SOUTH RAKAIA ROAD BOARD

to be the Dorie Domain Board, having, subject to the said Act, control of the land described in the Schedule hereto, which land is a public domain, and shall be called the Dorie Domain; and also doth hereby appoint Thursday, the third day of December, one thousand nine hundred and eight, at eleven o’clock a.m., as the time when, and the Road Board Office, South Rakaia, as the place where, the first meeting of the said Board shall be held.
