was duly held on the twenty-eighth day of September, one thousand nine hundred and eight : And whereas it is apprehended that the publication of the aforesaid notices may not have strictly complied with the provisions of section sixty-five of “The Municipal Corporations Act, 1908” : And whereas it appears that the ratepayers have not been misled by any such irregularity as there may have been in the proceedings aforesaid, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by section one hundred and twenty-one of “ The Local Bodies’ Loans Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the said special order shall be and be deemed to have been as good and effectual as if public notice of the second meeting had been given as prescribed by section sixty-five of “The Municipal Corporations Act, 1908,” and that such special order shall not be called in question by reason only of any such irregularity as aforesaid.

Validating Special Order in connection with a Loan of £2,250, Feilding Borough Council.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this second day of November, 1908.

Present:
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS the Feilding Borough Council lately proposed to raise a loan of two thousand two hundred and fifty pounds for (1) the construction of swimming-baths and caretaker's cottage, and the purchase of necessary land for the same; (2) the erection of public urinals; and (3) improving the entrances to the town: And whereas at a special meeting of the Council held in the forenoon of the thirty-first day of August, one thousand nine hundred and eight, a resolution (to operate as a special order) was passed for making and levying a special rate of three thirty-seconds of a penny in the pound upon the ratable value of all property of the Borough of Feilding within the boundaries as set out in such resolution : And whereas the first notice calling a second meeting for the twenty-eighth day of September, one thousand nine hundred and eight, to confirm the said resolution was signed by the Town Clerk after the holding of the said meeting of the thirty-first day of August, one thousand nine hundred and eight, and was published in the Feilding Star of that date, which is a newspaper in general circulation in the district, and which was issued in the evening of the thirty-first day of August, one thousand nine hundred and eight, after the holding of the said meeting on that day: And whereas the subsequent notices calling the second meeting were published in the Feilding Star of the seventh, fourteenth, and twenty-first days of September, one thousand nine hundred and eight : And whereas the meeting confirming the said resolution was duly held on the twenty-eighth day of September, one thousand nine hundred and eight, and the special order aforesaid has been duly gazetted : And whereas it is apprehended that the publication of the aforesaid notices may not have strictly complied with the provisions of section sixty-five of “The Municipal Corporations Act, 1908” : And whereas it appears that the ratepayers have not been misled by any such irregularity as there may have been in the proceedings aforesaid, and it is expedient to validate the same:

Validating the Voting-paper used at a Poll taken by the Eltham Borough Council on a Proposal to borrow £6,500, under “The Local Bodies' Loans Act, 1901,” for various Public Works.

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS the Eltham Borough Council lately proposed to raise a loan of six thousand five hundred pounds, under “The Local Bodies' Loans Act, 1901,” and its amendments, for the purpose of engaging in the following undertakings—viz., (1) for making streets within the Borough of Eltham, two thousand seven hundred and fifty pounds; (2) for water and drainage extensions within the Borough of Eltham, three thousand seven hundred and fifty pounds: And whereas at a poll of the ratepayers of the said Eltham Borough held on the fifteenth day of April, one thousand nine hundred and eight, the proposal to raise such a loan was sanctioned, but the voting-paper used at such poll was not in the form number one prescribed in the Schedule to “The Local Bodies' Loans Amendment Act, 1903”. And whereas it appears that the ratepayers have not been misled, and it is expedient to validate the proceedings so taken by the said Eltham Borough Council:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section one hundred and twenty-one of “The Local Bodies’ Loans Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct and declare that the voting-paper used at the said poll of ratepayers shall be taken to be as valid as though the same were in the required form, and doth hereby declare that the proceedings relative to the said loan shall not be called into question by reason only of the irregularity aforesaid.

Validating the Public Notification of the Special Order making the Special Rate in connection with the Loan of £5,000 applied for by the Hautapu Drainage Board.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this second day of November, 1908.

Present:
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS the Hautapu Drainage Board has applied to the Minister of Finance, under the provisions of “The Local Bodies' Loans Act, 1901,” and its amendments, which said Act and its amendments have been since repealed and re-enacted by “The Local Bodies' Loans Act, 1908,” for a loan of five thousand pounds, extending over two years’ expenditure, for the purpose of making and constructing drains and drainage-works, and exercising all the other powers vested in it by “The Land Drainage Act, 1904”: And whereas the public notification of the special order making the special rate was published in the Waikato Argus newspaper for four weeks, but was not published once in each week of the four weeks immediately preceding the date of the subsequent meeting at which the special order was confirmed, as required by section eleven of “The Counties Act Amendment Act, 1903,” then in force: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the said notifications:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section ten of “The Local Bodies' Loans Amendment Act, 1902,” and acting by and with the consent of the Executive Council of the said Dominion, doth hereby declare that such public notifications of the special order shall be deemed and taken to be as valid as though the said notifications had been properly published, and that the proceedings relative to the said loan shall not be called in question by reason only of the irregularity aforesaid.
